Petition summary and The required variances are Section 195-7.1 Lot Area Section 195-7.2 Street Frontage, Section 195-7.3 Yard Setbacks and Section 195-
background 7.8 and Exceptions in the R-4 Zoning Laws,
We are asking the Zoning Board to deny these variances and uphold the current zoning laws,which are put in place to protect current
homeowners.
• The North Andover R-4 zoning laws state that a buildable lot must be 12,500 square feet,This lot is 4,547 square feet.This
special variance requests that 7,953 square feet be granted(a 63%variance).
• A single-family home on this lot will adversely affect neighbor's privacy,degrade the look and feel of our neighborhood,and
likely impact our home values.
• This property was purchased in the early 1900s.The history of this lot shows that there have been multiple unsuccessful
attempts to build on it.Nothing about this lot has changed since the prior failed attempts to build,The last variance attempt was
in 2000 which fell under the current zoning laws and did not pass.
• The application includes supporting materials that indicate a hardship due to paying taxes on this lot.A landowner has the right
and responsibility to request a zoning assessment in which the town classifies a lot as buildable or not.To our knowledge,the
landowner and/or those who inherited the land,did not pursue this zoning assessment option.Therefore,the land remained
taxable as a buildable lot,We do not believe that this qualifies as a financial hardship since the landowner chose not to act to
change the taxable status and therefore self-created this scenario they believe is a hardship. In addition,abutters have asked to
purchase this property on several occasions, but the landowner denied the offers.
• The abutting property, Lot 13 Highland View Ave,was empty and did go up for sale.The landowner had the opportunity to
purchase this lot to extend the square feet.
• The developer and the current landowner are not planning on living at this properly.Neither has a vested interest in our
neighborhood.
Action petitioned for We, the undersigned, are concerned neighbors who urge our Zoning Board members to act in the favor of the
neighborhood and NOT grant the variances needed to build a single-family home on the lot at 34 Wentworth Avenue.
