NORTH ANDOVER SELECT BOARD MINUTES NOVEMBER 28, 2022
Call To Order: Chair Janice Phillips called the open meeting to order at 7:00PM in the Select Board Room.
Select Board in Attendance: Chair Janice Phillips, Laura Bates, Clerk Rosemary Smedile and Richard Vaillancourt were
present.
Non-Board Members in Attendance: Town Manager- Melissa Murphy Rodrigues, Assistant Town Manager- Laurie
Burzlaff were present.
EXECUTIVE SESSION
Chair Phillips stated the Board will enter Executive Session with the School Committee to discuss strategy with respect to
litigation - Pursuant to M.G.L. c.30A, Section 21(a)(3).
MOTION: Mr. Vaillancourt motioned that the Select Board enter into Executive Session pursuant to M.G.L. c.30A, Section
21(a)(3) to discuss strategy with respect to litigation. Ms. Smedile seconded. Roll call vote: Bates- yes, Vaillancourt- yes,
Smedile- yes, Phillips- yes. Motion approved 4-0.
The Board returned to Open Session at 7:00PM. The open session meeting was recorded.
PUBLIC COMMENT
None
LICENSING
MOTION: Mr. Vaillancourt motioned to open a meeting of the North Andover Licensing Commission. Ms. Bates seconded.
Motion approved 4-0.
PUBLIC HEARING- Application from Dicor Restaurant Corp., 1060 Osgood Street for change of category from wine
and malt on premises liquor license to all alcohol on premises liquor license
MOTION: Ms. Bates motioned to open the public hearing for application from Dicor Restaurant Corp., 1060 Osgood Street
for change of category from wine and malt on premises liquor license to all alcohol on premises liquor license. Ms. Smedile
seconded. Motion approved 4-0.
Veronica Churchill, owner of restaurant, was present at the meeting to discuss receiving a full liquor license. There was no
public comment.
MOTION: Mr. Vaillancourt motioned to close the public hearing for application from Dicor Restaurant Corp., 1060
Osgood Street for change of category from wine and malt on premises liquor license to all alcohol on premises liquor
license. Ms. Bates seconded. Motion approved 4-0.

PUBLIC HEARING- Application from Abbott Salem, Inc. d/b/a Brix Grill, 701 Salem Street for an all alcohol on
premises liquor license and entertainment license
MOTION: Ms. Phillips motioned to open the public hearing for application from Abbott Salem, Inc. d/b/a Brix Grill, 701
Salem Street for an all alcohol on premises liquor license and entertainment license . Ms. Bates seconded. Motion approved
4-0.

Attorney Brian Vaughn was present at the meeting on behalf of Jim and Michael Xenakis, owners of Brix Grill, to apply for a
full liquor license. Mr. Vaillancourt stated his concern with the liquor license being allowed until 1:00AM, 7 days a week.
Ms. Smedile asked if there were any public comment. There was no public comment.
MOTION: Ms. Phillips motioned to close the public hearing for application from Abbott Salem, Inc. d/b/a Brix Grill, 701
Salem Street for an all alcohol on premises liquor license and entertainment license . Mr. Vaillancourt seconded. Motion
approved 4-0.

for an all alcohol on premises liquor license . Ms. Bates seconded. Motion approved 4-0.
Entertainment and common victualler licenses for Abbott Salem, Inc. d/b/a Brix Grill, 701 Salem Street will be posted on the
next agenda.
Application from Justin Pronovost d/b/a Garlic Breath Pizza LLC for a common victualler license at 733 Turnpike
Street
Justin Pronovost was present at the meeting.
MOTION: Mr. Vaillancourt motioned to approve the application from Justin Pronovost d/b/a Garlic Breath Pizza LLC for a
common victualler license at 733 Turnpike Street. Ms. Phillips seconded. Motion approved 4-0.
Applications from Paul Gallant of Merrimack College for two one day wine and malt liquor licenses for receptions at
the Church of Christ the Teacher on December 1, 2022 from 5:00PM to 9:00PM and December 16, 2022 from 1:00PM
to 4:00PM
Jeff Doggert of Merrimack College was present at the meeting.
MOTION: Mr. Vaillancourt motioned to approve the applications from Paul Gallant on behalf of Merrimack College for two
one day wine and malt liquor licenses for receptions at the Church of Christ the Teacher on December 1, 2022 from 5:00PM
to 9:00PM and December 16, 2022 from 1:00PM to 4:00PM. Ms. Bates seconded. Motion approved 4-0.
Application from LaPage, LLC d/b/a Sobol for common victualler and entertainment licenses at 544 Turnpike Street
Sylvie and Natalia Roccia were present at the meeting.
MOTION: Mr. Vaillancourt motioned to approve the application from LaPage, LLC d/b/a Sobol for common victualler and
entertainment licenses at 544 Turnpike Street, subject to receipt of satisfactory fire alarm and sprinkler testing and reports.
Ms. Bates seconded. Motion approved 4-0.
Discussion regarding license renewals
Laurie Burzlaff asked the Select Board how to proceed if the licenses are not ready by the next Select Board meeting. The
Select Board discussed how to proceed going forward. Mr. Vaillancourt asked how many are outstanding. Ms. Burzlaff stated
17. Ms. Rodrigues stated a letter from the Town Manager’s Office will be sent to the outstanding apllicants indicating
everything must be in by December 9th or the license will not be renewed.
MOTION: Mr. Vaillancourt motioned to close a meeting of the North Andover Licensing Commission. Ms. Phillips
seconded. Motion approved 4-0.
Request of the Festival Committee to use the common on May 21, 2023 from 6:00AM to 6:00PM, to close
Massachusetts Avenue from 7:00AM to 6:00PM and to waive any municipal fees for the Sheep Shearing Festival

MOTION: Mr. Vaillancourt motioned to approve the request of the Festival Committee to use the common on May 21, 2023
from 6:00AM to 6:00PM, to close Massachusetts Avenue from 7:00AM to 6:00PM and to waive any municipal fees for the
Sheep Shearing Festival. Ms. Smedile seconded. Motion approved 4-0.
Request of John Watters to raise the Irish Flag at the Common for St. Patrick’s Day from March 10, 2023 through
March 24, 2023
MOTION: Mr. Vaillancourt motioned to approve the request of John Watters to raise the Irish Flag at the Common for St.
Patrick’s Day from March 10, 2023 through March 24, 2023. Ms. Smedile seconded. Motion approved 4-0.
Approve application and guidelines for Electric Bill Assistance Program
Ms. Rodrigues explained that the program for residents who are not currently participating in a financial assistance program
with National Grid. Ms. Bates asked how income will be verified. Ms. Burzlaff explained through paystubs, tax returns and
other income verifying documents.
MOTION: Mr. Vaillancourt motioned approve the application and guidelines for the Electric Bill Assistance Program, as
presented. Ms. Smedile seconded. Motion approved 4-0.

MOTION: Ms. Bates motioned to appoint Gerald Brecher, Norma Lochmann and Guillermo Vicens to the 400 Great Pond
Road Committee, Pamela Lathrop to the Cultural Council through June 30, 2024, Mike Nolan to the Patriotic Observance
Committee through June 30, 2024 and Joan Thompson to the Council on Aging through June 30, 2025. Mr. Vaillancourt
seconded. Motion approved 4-0.
CONSENT ITEMS
A. Accept grant in the amount of $66,560 from DHCD for consultant to explore reuse of Senior Center building
B. Accept donation of a van from Merrimack Valley Regional Transit Authority for the senior center
MOTION: Ms. Bates motioned to accept all consent items. Mr. Vaillancourt seconded. Motion approved 4-0.
APPROVAL OF OPEN SESSION MINUTES OF NOVEMBER 17, 2022
MOTION: Ms. Bates motioned to approve the Open Session minutes of November 17, 2022. Mr. Vaillancourt seconded.
Motion approved 4-0.

- Cram-A-Cruiser Food Drive
- Tree lighting moved to 12/14
- Mitten Tree in Town Hall Lobby is available to donate hats and gloves
- Resignation was received from Frank Rossi with the Greater Lawrence Technical School Committee. This will
require action from both the Select Board and School Committee for a replacement.
- Received correspondence from Republic Services Trash that a third truck is now in town assisting with trash
collection. An In-Town Supervisor for Republic Services has also been added.
Select Board Report
- Ms. Smedile mentioned that the parade was awesome!
- Ms. Smedile stated Tree Lighting postponement was a good idea
- Ms. Bates mentioned the Fire Department’s Toy Drive
- Ms. Phillips mentioned the Merchant Association’s Bingo
- Mr. Vaillancourt spoke about the upcoming Santa Breakfast at the Senior Center
ADJOURNMENT
MOTION: Ms. Bates made a MOTION, seconded by Ms. Smedile to adjourn the Select Board meeting at 8:20PM. Motion
approved 4-0.
