Dear Mr. Marcum: Department personnel have observed that on March 26, 2002, activity occurred at Eastprint, Inc., 350 Willow Street South,North Andover, Massachusetts in noncompliance with one or more laws, regulations, orders, licenses,permits,or approvals enforced by the Department. Enclosed is a Notice of Noncompliance which describes (1) the activity referred to above, (2) the requirements violated, (3)the action the Department now wants you to take, and (4) the deadline for taking such action. An administrative penalty may be assessed for every day from now on that you are in noncompliance with the requirements described in this Notice of Noncompliance. Notwithstanding this Notice of Noncompliance, the Department reserves the right to exercise the full extent of its legal authority in order to obtain full compliance with all applicable requirements, including, but not limited to, criminal prosecution, civil action including court-imposed civil penalties, or administrative penalties assessed by the Department. Notice of Noncompliance Page 2 of 7 SOURCE REDUCTION OPPORTUNITIES You may be able to cut environmentally driven costs and possibly reduce the regulatory requirements and fees applied to your firm if you eliminate or reduce the use of toxic materials or the generation of wastes (referred to as "source reduction"). As a result, you may save money, and improve quality and productivity. While inspecting your facility, Department personnel observed potential source reduction opportunities associated with your screen cleaning operation. Source reduction options you may want to evaluate for this operation(s) include but are not limited to substituting the use of thinner containing 80% toluene with one of non toxic or less toxic compounds. It is also possible that implementation of source reduction options may correct violations associated with your screen cleaning operation. Please note that changes to your process could alter the requirements, imposed on you by any of the laws and regulations that the Department enforces. Moreover, tracking annual usage of toxic substances and other inputs, if you are not already doing so, may lead to identification of additional source reduction opportunities. LOCATION WHERE NONCOMPLIANCE OCCURRED OR WAS OBSERVED: 350 Willow Street South,North Andover,Massachusetts DATE WHEN NONCOMPLIANCE WAS OBSERVED: March 26,2002 DESCRIPTION OF NONCOMPLIANCE AND OF THE REOUIREMENTS NOT COMPLIED WITH: Personnel from the Department conducted a compliance inspection at Eastprint, Inc. The following are the observed violations: HAZARDOUS WASTE (1) 310 CMR 30.331(1): [Printers Environmental Certification Workbook Section 3.1.7 Figure 1]: During the inspection, the most recent manifest was dated August 21, 1997. The regulation requires... A generator shall keep a copy of each manifest, signed in compliance with 310 CMR 30.314 through 30.316, for three years after the waste was accepted by the initial transporter or until the generator receives a signed copy from the designated facility which received the waste. The generator shall keep, for at least three years from the date the waste was accepted by the initial transporter, the copy of the manifest signed by the owner or operator of the facility which received the waste. (2) 310 CMR 3 0.3 53 (6)(h), (refers to 30.340(1)0)): [C-3.1.7 Figure 1]: During the inspection, it was noted that Eastprint, Inc., had a hazardous waste sign posted on the door to the room containing hazardous waste; however, there was no sign posted on the wall where the hazardous waste was being accumulated. The regulation requires that... All areas where wastes are accumulated shall have posted at all times a sign with the words "HAZARDOUS WASTE" in capital letters at least one inch high. Each such sign shall meet the guidelines set forth in the National Fire Protection Association's Code No_ 704. (3) 310 CMR 30.353(6)(h), (refers to 30.340(1)(k): [C-3.1.7 Figure 1]: During the inspection, it was noted that Eastprint, Inc. was not accumulating hazardous waste in a clearly marked area. The regulation requires that... All areas where wastes are accumulated for purposes of complying with 310 CMR 30.000 generally shall be clearly marked (e.g., by a clearly visible line or piece of tape on the floor, or by a gate or fence, or by a sign at the boundary of a clearly distinguishable area) so that they are clearly distinguishable at all times from all specific points of generation where wastes are initially accumulated solely for purposes of 310 CMR 30.340(4), and from all areas at the site of generation where wastes are not accumulated. (4) 310 CMR 30.353(6)(g), (refers to 30.685(1): [C-3.1.7 Figure 1]: During the inspection, it was noted that Eastprint, Inc. was accumulating hazardous waste, oil based inks, in an open 55 gallon drum, i.e. an open funnel inserted into a bung. The regulation requires that... A container holding hazardous waste shall always be closed during storage, except when waste is being added or removed. In the event that Eastprint, Inc. Notice of Noncompliance Page 4 of 7 Federal, State or local law or regulation requires a container to be vented, the container shall be vented in a manner that does not present a threat to public health, safety, or welfare or the environment. AIR QUALITY (5) 310 CMR 7.26(29): [C-1.1]: During the inspection,it was noted that Eastprint,Inc. had not self-certified as a midsize printer since 1999. The regulation requires that... Compliance Certification Requirement: (a) Beginning on September 15, 1998, and annually thereafter, each printer shall submit to the Department a compliance certification in accordance with 310 CMR 70.00 and 310 CMR 7.26(29). As part of the certification, each large printer shall submit information the Department may specify, including: 1. the nature and amounts of emissions from the facility, 2. information which may be needed to determine the nature and amounts of emissions from the facility, and 3. any other information pertaining to the facility which the Department requires. (b) If, during the course of the certification period, a printer installs a new printing press or makes operational changes which will cause a modification of its size classification,the printer shall, within 60 days of operation of the new press or actual operational changes respectively, notify the Department in writing. Such printer shall comply with 310 CMR 7.26(20)through (29) based on the applicable new size classification as soon as the new press is operating or the operational change is made. (c) If, during the course of the certification period, a printer relinquishes an existing plan approval in accordance with 310 CMR 7.26(23)(a)(1) or(2), then within 30 days of such change the printer shall notify the Department in writing. (6) 310 CMR 7.26(20): [C-3.3.1]: During the inspection, it was noted that Eastprint, Inc. was not maintaining a rolling 12 month log indicating VOC potential emissions. The regulation requires that... Environmental Results Program: Lithographic, Graphic Arts, and Screen Printing. (a) 310 CMR 7.26(20) through(29) sets forth performance standards and recordkeeping requirements for lithographic, graphic arts and screen printing at facilities subject to 310 CMR 7.26(20)through (29)pursuant to 310 CMR 7.26(21). (b) Facilities subject to 310 CMR 7.26(20)through (29) are not subject to 310 CMR 7.18 12 , 1144,)and (25). (c) By complying with the recordkeeping requirements contained in 310 CMR 7.26(20)through (29), and with the certification requirements contained in 310 CMR 70.00, and by maintaining actual emissions below the levels contained in 310 CMR 7.26(20)(c)1. through 4.,the owner/operator of a facility subject to 310 CMR 7.26(20) through(29) restricts the federal potential emissions of the facility to below the applicable major source thresholds. As such, the operations will not be subject to 310 CMR 7.00: Appendix (Emission Offsets and Nonattainment Review), 310 CMR 7.00: Appendix C(Operating Permit Program), 40 CFR 52.21 (Prevention of Significant Deterioration), and 40 CFR 63 (Maximum Achievable Control Technology). For every rolling 12-month period as defined in 310 CMR 7.26(22), the potential and actual emissions of the facility shall be less than the following limitations: Eastprint, Inc. Notice of Noncompliance Page 5 of 7 1. 50 tons of VOC or NO,, or 100 tons of any other regulated air pollutant; 2. 10 tons per year of any HAP; 3. 25 tons per year of a combination of HAPs; and 4. Any lesser threshold for a single HAP that the EPA may establish by rule. (7) 310 CMR 7.26(28)(b)l. and 2.: [C-2.0]: During the inspection, it was noted that Eastprint, Inc. failed to have a complete set of MSDSs to determine if all cleanup solutions,inks, coatings and adhesives were in compliance with the performance standards referred to in the printers workbook. The regulation requires that... Each midsize printer shall maintain: 1. monthly purchase or usage records sufficient to demonstrate that the printer is a midsize printer, including but not limited to records concerning cleanup solutions, inks, coatings, adhesives, and incidental materials, excluding water-based inks/coatings/adhesives, ultraviolet inks,plastisol inks, and inks used in non-heatset offset lithographic printing; 2. records demonstrating that cleanup solutions, inks, coatings, and adhesives are in compliance with applicable standards set forth in 310 CMR 7.26(20) through(29) according to EPA test method 24 or 24A, as applicable, or an equivalent test methodology as determined by the Department and EPA, and appropriate documentation indicating compliance with the VOC composite partial pressure as defined in 310 CMR 7.00. (8) 310 CMR 7.26(26)(b)1.: [C-3.3.3 Table 1]: During the inspection, it was noted that Eastprint,Inc.was using cleanup solution(toluene containing thinner)which did not meet the performance standards. The solution had a vapor pressure in excess of 5 mm Hg. The regulation requires that... Cleanup solution standard: Cleanup solution used in screen printing shall meet the following standards, except that these standards do not apply to incidental materials: 1. cleanup solution shall have a VOC composite partial pressure of 5.0 mm Hg or less at 20' C (68°F), INDUSTRIAL WASTEWATER (9) M.G.L. c. 21, s.43(2)and 314 CMR 5.03(1)and(2) [C-3.2.1 and 3.2.2]: During the inspection, it was noted that industrial wastewater from screen cleaning operations is poured down a sink. The discharge point for the sink is unknown. No permits from state, local or federal authorities have been issued for this activity. Therefore, there is a potential for discharge of industrial wastewater to ground water. The requirements state,respectively: (1) M.G.L. c. 21, s. 43(2)provides,in part, as follows: "No person shall discharge pollutants into waters of the Commonwealth nor construct, install, modify, operate or maintain an outlet for such discharge or any treatment works,without a currently valid permit issued by the Director.No person shall engage in any other activity that may reasonably be expected to result, directly or indirectly, in discharge of pollutants into waters of the Commonwealth,nor construct, effect, maintain,modify or use any sewer Eastprint, Inc. Notice of Noncompliance Page 6 of 7 extension or connection, without a currently valid permit issued by the Director,unless exempted by regulation of the Director." (2) 314 CMR 5.03(1) and(2)provide in part as follows: "No person shall discharge pollutants to ground waters of the Commonwealth without a currently valid permit from the Department pursuant to M.G.L. c. 21, § 43 and 314 CMR 5.00, unless exempted in 314 CMR 5.05. No person shall construct, install,modify,operate or maintain an outlet for such a discharge or any treatment works required to treat such discharge without having first obtained a discharge permit in accordance with 314 CMR 5.03(1) and written approval from the Department for such activity. Any person who discharges or proposes to discharge.o ground waters of the Commonwealth may obtain a permit by filing the appropriate application forms in accordance with 314 CMR 5.00 and 2.00. Activities which constitute discharges of pollutants requiring a permit under 314 CMR 5.03(1) include,but are not limited to: (a)Any facility which discharges a liquid effluent onto or below the land surface; (b)Any facility which discharges a liquid effluent to a percolation pit,pond,or lagoon; (c)Any facility which discharges a liquid effluent via subsurface leaching facilities including but not limited to: leaching pits, galleries, chambers,trenches,fields and pipes; (d)Any facility which discharges a liquid effluent into a Class V injection well as defined in 310 CMR 27.00; or (e)Any facility with an associated unlined pit,pond, lagoon, or surface impoundment in which wastewaters or sludges are collected, stored,treated, or disposed and from which a liquid portion seeps into the ground." ACTION TO BE TAKEN,AND THE DEADLINE FOR TAKING SUCH ACTION: HAZARDOUS WASTE (1) Immediately upon receipt of this Notice, keep copies of all hazardous waste manifests, in accordance with the above referenced regulation. Photocopies of the missing manifests shall be obtained from the destination facility and sent to this office. Within thirty (30) days of your receipt of this Notice,this office must be in receipt of written confirmation that this has been done. (2) Immediately upon receipt of this Notice, post a sign with the words "HAZARDOUS WASTE", in accordance with the above referenced regulation. Within thirty(30) days of your receipt of this Notice,this office must be in receipt of written confirmation that this has been done. (3) Immediately upon receipt of this Notice, clearly distinguish waste accumulation areas from areas where wastes are not accumulated. Within thirty (30) days of your receipt of this Notice, this office must receive from you, in writing, confirmation that this has been done. (4) Immediately upon receipt of this Notice, close all containers accumulating hazardous waste, and continue to keep them closed except when waste is being added or removed. Within thirty (30) days Eastprint, Inc. Notice of Noncompliance Page 7 of 7 of your receipt of this Notice, this office must be in receipt of written confirmation that this has been done, and will continue to be done. AIR QUALITY (5) Immediately upon receipt of this Notice, contact the Department by calling Marc Cohen at (617) 292-5873 to obtain the self-certification forms you need to complete in order to comply with the aforementioned regulation. Within thirty (30) days of your receipt of this Notice, this office must receive from you, in writing, confirmation that this has been done. (6) Immediately upon receipt of this Notice, Eastprint, Inc. must amend its recordkeeping to include a rolling 12 month log defined as any consecutive 12 month period of time. Within thirty (30) days of your receipt of this Notice, this office must receive from you, in writing, confirmation that this has been done and will continue to be done. (7) Immediately upon receipt of this Notice, Eastprint, Inc. must keep all MSDSs in order to determine if cleanup solutions, inks, coatings, and adhesives are meeting the performance standards. Within thirty (30) days of your receipt of this Notice, this office must receive from you, in writing, confirmation that this has been done and will continue to be done. (8) Immediately upon receipt of this Notice, Eastprint, Inc. must use only cleanup solutions in accordance with the performance standards, i.e. 5mm Hg vapor pressure or less. If the solutions used are less that 55 gallons per year, they are exempt from this requirement. Within thirty(30)days of your receipt of this Notice, this office must receive from you, in writing, confirmation that this has been done and will continue to be done. INDUSTRIAL WASTEWATER (9) Immediately upon receipt of this Notice, obtain documentation, i.e. building plans, dye tests, etc. to determine the sink drain's point of discharge. If the discharge is to sewer, contact the Greater Lawrence Sanitary District by calling (978) 685-1612. The purpose of this inspection was to determine the compliance status of Eastprint, Inc. with regard to the Massachusetts environmental regulations referenced above. On the inspection date, regulatory violations were observed. On May 13, 2002, a Notice of Noncompliance (File No. NON-NE-02-9050-27A) was issued to Eastprint, Inc. On July 10, 2002, Department personnel conducted a follow-up inspection. Based upon observations made during the follow-up facility inspection, and a review of company records, it has been determined that Eastprint,Inc. had complied with the requirements of the Notice of Noncompliance as of the date of the follow-up inspection.
