Dear Mr. &Mrs. Marcus:
The proposed onsite wastewater system design plan for the above site dated 5/18/22 with a final
revision date of 12/5/22 has been approved for issuance of a Disposal System Construction
Permit(DSCP). Once issued, a DSCP will authorize the construction of the onsite wastewater
system per the plan referenced above and as allowed under Title 5 of the Massachusetts
Environmental Code (310 CMR 15.000). You will need involvement from the designer of the
onsite wastewater system throughout the installation process so you should be sure to coordinate
with them.
The design has been approved for use in the construction of an upgrade on-site wastewater
system for a 3-bedroom home utilizing the proposed effluent filter in the septic tank,pump tank
with pump and an Enviro-Septic soil absorption system as indicated on the design plan. The
designer has selected the use of a non-traditional onsite wastewater system component for use at
this location. This component is approved for use in Massachusetts with a number of conditions
and stipulations as described below.
The goal for system upgrades is to achieve full compliance with state and local onsite wastewater
regulations. In this instance full compliance was not achieved because the design includes a
request for Local Upgrade Approvals seeking to vary from the standards of full compliance.
This letter serves to document the endorsement of these Local Upgrade Approvals by the North
Andover Health Department.

This design plan approval is valid for 2 years from the above date. During this time, a licensed
septic system installer should obtain a permit and complete this work, and a Certificate of
Compliance be endorsed by the installer, designer, and the Town of North Andover. If these
activities are not completed within this time period then it is possible a new design plan will need
to be completed and submitted for review. In the event an imminent health problem such as
sewage backup into the dwelling is occurring the North Andover Board of Health may reduce the
time period for which this plan is valid.
This approval is subject to the following conditions. Please be sure to review these with the
designer and installer.
Prior to the issuance of a Disposal System Construction Permit:
a. The area of the proposed Soil Absorption System(SAS) is to be staked and
flagged to identify the location(s) and to prevent activities which might damage
the soil absorption system. Stockpiling of materials and equipment within the
SAS area is prohibited
b. A deed notice indicating the presence of a non-traditional onsite wastewater
system component is to be recorded on the deed and a copy provided to this office
c. The System Installer must provide in writing a demonstration that they are
certified by the manufacturer or have otherwise received appropriate training for
installation of the type of wastewater system proposed for use, or that such
certification or training is not necessary
Throughout the project:
a. If site conditions are found in the field to be different from those indicated on the
design plan, installation of the onsite wastewater system shall stop and the
designer and this office notified within 24 hours
b. The brand and model of effluent filter specified on the design plan is to be
utilized. The installer is to demonstrate these have been made part of the onsite
wastewater system
c. If groundwater is present at the bottom portion of the excavation for the soil
absorption system(SAS)the excavation is to be dewatered prior to the placement
of any fill. No fill is to be placed for the SAS during rain or snow storms. Prior to
placement of any needed fill in the SAS,the bottom is to be scarified and
relatively dry and the fill material is to be stockpiled at the edge of the excavation
and filled in gradually
d. Inspections are to be performed by the designer of the onsite wastewater system
as needed to properly oversee and document construction. At a minimum these
are the initial excavation, prior to backfilling, and during backfilling as well as
any other component of the construction which the designer wishes to examine
e. Inspections are to be completed by the Town of North Andover at a minimum as
follows:
i. Bed bottom
ii. Tank bottom

iii. Final installation of components, confirmation of proper component
selection, examination of construction methodology, and system operation
iv. Final grade
v. Sand fill will be collected from at least one location and analyzed for
compliance with specifications in Title 5
f. No components are to be covered until a final component inspection has been
. completed
g. No excavation for or work associated with construction of the soil absorption
system is to occur from November 30 to April 1
After construction:
h. Within 30 days of completion of construction the installer and designer are to
confirm if the installation work was completed in compliance with the design plan
referenced in the DSCP and with Title 5, and if so shall certify this on a
Certificate of Compliance form
i. If changes have been made to the approved plans then preparation of an as-built
plan is required to be completed by the designer. If no changes have been made
to the approved plans then the approved plan shall be modified by the designer to
show the distances from a known structure to the system components.
j. Within 30 days of completion of construction of the non-traditional onsite
wastewater system components the installer and designer are to confirm if the
installation work was completed in compliance with the Standard Conditions for
Alternative Soil Absorption Systems issued by MassDEP
k. No sewage shall be discharged to the onsite wastewater system until a Certificate
of Compliance has been issued by this office
In addition,you should be aware of the long-term operation guidelines of an onsite wastewater
system(these are not part of the DSCP but are mentioned below as information for the property
owner):
1. An onsite wastewater system can function as an integral part of the infrastructure of
the property if it is properly operated and maintained. This is the responsibility of the
owner of the property and is generally not specified by regulation. You are
encouraged to contact a wastewater system pumper/service provider to partner with
you to implement steps needed to assure the longevity of the onsite wastewater
system being installed at this location
2. The design plan specifies the use of an effluent filter inside the tank. This component
is required to be examined at least annually and cleaned as needed
3. The design plan specifies a non-traditional system component which is allowed for
use under the Standard Conditions for Alternative Soil Absorption Systems issued by
MassDEP. These conditions require:
a. Notification of this office within 24 hours of any system failure
b. At the time of a System Inspection that a number of additional items beyond a
typical System Inspection are to be examined and documented
c. That connection to a sanitary sewer be made and the system abandoned within
60 days of such a connection being made available since the MassDEP has not
determined that the non-traditional components being used are equivalent in

the public health and environmental protection offered by a sanitary sewer
system
d. No structures are to be constructed over the actual soil absorption system or
the conventional primary or reserve soil absorption system, nor any other
condition created which precludes the installation of the conventional system
shown on the design plan
The issuance of a DSCP does not construe and/or imply compliance with any permits, approvals
or licenses which might be needed from other agencies such as the Conservation Commission,
Zoning Board, Planning Board, Building Inspector, Plumbing Inspector and/or Electrical
Inspector.
