The NACC orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. GENERAL CONDITIONS 1. Failure to comply with all conditions stated herein, and with other regulatory measures shall be all related statutes and oth g y , deemed cause to revoke or modify this Order. 2 . This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3 . This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4 . The work authorized hereunder shall be completed within one year from the date of this Order (under the Town Bylaw) and three years (under the State Act) unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act and/or the Town ByLaw; (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5 . This order may be extended by the issuing authority for one or more periods of up to one year each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. 7 . No work shall be underta ken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department or Court have been completed. �` #242-538 Lot 3A Willow St. 3 s 8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the North Andover Conservation Commission on the form at the end of this Order prior to commencement of the work. 9 . A sign shall be displayed at the site not less than two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection, File Number 242-538 . " 10. Where the Department of Environmental Protection is requested P q to make a determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 11. Upon completion of the work described herein, the applicant shall request in writing that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 12 . The following wetland resource areas are within the 100 ' buffer zone of the proposed work: bordering land subject to flooding, and bordering vegetated wetland. These resource areas are significant to the interests of the Act and Town Bylaw as noted above. These resource areas are also significant to the recreational and wildlife interests of the Bylaw. The applicant has not attempted to overcome the presumption of significance of 1 these resource areas to the identified interests. i 14 . The NACC agrees with the applicant' s delineation of the wetland resource areas on the site as shown on the plans dated 10/26/90 and revised 11/1/90, 11/15/90. 1 PERFORMANCE & DESIGN STANDARDS 15. The NACC finds that the intensive use of the upland areas and i buffer zone proposed on this site to construct an industrial building will cause further alteration of the wetland resource areas during the construction activities. In order to prevent any alteration of wetland resource areas�beand =resource the Notice of Intent and approved herein10 ' no-cu b be .established--from the edge of the a Jacent wetland areas (exclusive of sedimentation basins) . 16. The applicant shall ensure that 2e 6' swamp white oak (and 1 its root system) shown on the plans in the rear of the building ' will be undisturbed as a result of this project.. The contractor S will contact the Conservation Administrator at least 48 hours rior to any excavation within 50 ' of this tree. i L17 A subsurface impervious barrier, not less that 40 mil thick hall be placed under the rip rap in the rear of the building. �' 18 . No earthen embankment in the buffer zone shall have a slope steeper than 2 : 1. Any slopes of steeper grade shall be \ rapped to provides permanent _-stab.ilization.-._.. 19 . All effluent catch basins shall contain oil/gasoline traps, and it shall be a continuing condition of this order, even after a Certificate of Compliance is issued, that the oil/gasoline traps in the catch basins be maintained. All catch basins shall be free of all accumulated silt and debris before a Compliance is issued and the owner or his/her agent shall so specify in the request for a Compliance. j r #242-538 Lot 3A Willow St. 5 sj _� CHANGES 20. Any changes in the submitted plans, Notice of Intent, or resulting from .the aforementioned conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds said changes to be significant, the NACC will call for another public hearing (at the expense of the applicant) . Within 21 days of the close of said public hearing the NACC will issue an amended or new Order of Conditions. Any errors found in the plans or information submitted by the applicant shall be considered as changes. CONSTRUCTION r231. The applicant or contractor shall notify the NACC in writing of the identity of the on-site construction supervisor hired to coordinate construction and to ensure compliance with this Order. � / 2-Z. Prior to any activity on site, the applicant shall submit a �;.,+ the NACC detailing the construction schedule/sequence to g proposed work on site to complete this project. \sequence of P P 7 i 23 . The applicant shall submit, to the NACC, a written progress report every 3 months detailing what work has been done in or near resource areas and what work is anticipated to be done over the next period. This will update the construction sequence , listed above -"- --- - 24 . Wetland flagging shall be checked prior to start of construction and shall be re-established where missing so that required erosion control measures between construction activity and wetland resource areas can be properly placed. 25. Prior to any Y activit on the site, a filter fabric fence backed by a single row of staked hay bales shall be placed between all construction areas and wetland areas per Soil Conservation Service or D.E. P. standards. This barrier will be placed as shown on the plan dated 11/15/90. This silta tion barrier shall be inspected and approved by the NACC prior to the start of construction and shall remain intact until all disturbed areas have_ been mulched, seeded, and stabilized -- a-prevent- - erosian�- 3n--additian, a snow fenced shall be placed in front of `I r the siltation fence anywhere that-con-struction is _wi-th-in 10 feet '"of the wetland line.", _.11 erosion prevention and sedim-entation - � —= 42-538 Lot 3A Willow S-24 t. - 6 protection measures found necessary during construction by the - NACC shall be implemented at the direction of the NACC. 26. The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of 100 hay bales and sufficient stakes for staking these bales. Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the normal control of erosion. 27 . Upon completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done either by i. sodding, or by loaming, seeding, and mulching according to Soil Conservation Service standards. If the latter course is chosen, stabilization will be considered once complete vegetative cover has been achieved. 28 . No exposed area shall remain unfinished for more than thirty ) days, unless approved by the NACC. X ( 9 . There shall be no stockpiling of soil or other materials " within twenty-five (25) feet of any resource area. 30. After p oper 'at `g alI-3isturbed-areas located within a resource area which will not remain as wetland areas, shall be 1 loamed (minimum of 4" of quality loam) , limed, fertilized and seeded. This shall all be done in accordance with SCS guidelines. All disturbed areas located within wetland resource areas which are to be only temporarily disturbed during II' construction, shall be restored to their original grade, soil profile and vegetative cover. Soil used for this purpose will either be wetlands topsoil or a minimum of 4" of quality loam. 31. During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant as soon as practical . No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. 32 . Washings from concrete trucks, or surplus concrete, shall not 41 be directed to, or dumped in, any drainage system or wetland ' resource area. _---- - --------- 33 . All waste generated by, or associated with, the construction activity shall be contained within the construction area, and away from any wetland resource area. There shall be no burying of spent construction materials or disposal of waste on the site by any other means. The applicant shall maintain dumpsters at the site for the storage and removal of such spent construction #242-538 Lot 3A Willow St. 7 materials off-site. 34 . Accepted engineering and construction standards and procedures shall be followed in the completion of the project. OTHER CONDITIONS 35. Members of the NACC or its agent shall have the right to enter upon and inspect the premises to evaluate and/or effect compliance with this Order of Conditions. The NACC reserves the right to require, following field inspection, additional information or resource protection measures. I 36. Issuance of these Conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding or storm damage. 37. No underground storage of fuel oils shall be allowed on any lot within one-hundred (100) feet of any wetland resource area. This Condition shall survive this Order of Conditions, and shall . run with the title of the property. This condition is issued under the authority of the Town of North Andover's Wetland Protection ByLaw. 38 . Fertilizers utilized for landscaping and lawn care shall be organic and low-nitrogen content, and shall be used in moderation. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. This condition is issued under the authority of the Town of North Andover's Wetland Protection ByLaw. 39 . The conditions of this decision shall apply to, and be binding upon, the applicant, owner, its employees and all successors and assigns in interest or control . 40. A proper bond or a deposit of money or negotiable securities running to the Town of North Andover shall be provided in the amount of $7500. 00 which shall be in all respects satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the North Andover Town Treasurer before commencement of work. Said bond or deposit of money shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, and Town Counsel, and shall be released after completion of the project, provided that provision, satisfactory to the NACC, has been made for performance of any conditions which are of continuing nature. The applicant may propose a bond release schedule keyed to completion of specific portions of the project for the NACC' s review and approval. This condition is issued under the authority of the Town of North Andover' s Wetlands Protection Bylaw. #242-538 Lot 3A Willow St. 8 41. In addition to the requirements of Conditions No. 11, the applicant shall submit a letter to the NACC from a Registered Professional Civil Engineer certifying compliance with this Order of Conditions and the approved plans referenced herein (or approved revisions) . A stamped "As-Built" topographic plan of all areas within the jurisdiction of the Wetlands Protection Act and Bylaw shall be submitted when a Certificate of Compliance is requested. This plan will include: a. "As-Built" elevations of all drainage ways constructed within 100 feet of any wetland resource area. b. "As-Built" elevations and grades of all filled or altered wetland resource areas. C. Distances to all structures and elevations within 100 feet of any wetland resource areas. 42 . The following special conditions shall survive the issuance of a Certificate of Compliance for this project: 19 . Maintenance of catch basins. 31. Discharge or spillage of pollutants. 37 . Prohibition of storage of fuels underground. 38 . No work shall commence on-site until all appeal periods have elapsed and an Order of Conditions has been recorded with the Registry of Deeds. 15 . These orders regulate .all work taking place within the Buffer Zone, as defined by MGL C. 131, s. 40 as well as any water discharge into a Resource Area from a point source. 16. Any change (s) made in the above-described plan, unless specified otherwise in this order, which will alter an area subject to protection under the Wetlands Protection Act, or any change (s) in activity subject to regulation under M.G. L. Chapter 31, Section 40, shall require the applicant to inquire of the Department, in writing, whether the change (s) is significant enough to require the filing of a new Notice of Intent. A copy of such a request shall at the same time be sent to the North Andover Conservation Commission. 17 . Members and agents of the North Andover Conservation Commission and the Department, shall have the right to enter and inspect the premises to evaluate compliance with the conditions stated in this Superseding Order, and may require the submittal of any data deemed necessary by this Department for that evaluation. 18 . This order shall apply to any successor in control or successor in interest of the property described in the Notice of Intent and accompanying plans. 19 . Upon completion of the project, the applicant shall submit with their request for a Certificate of Compliance, an affidavit prepared by a professional engineer or land surveyor registered in the Commonwealth of Massachusetts, stating that the site has been developed in accordance with the requirements of this Superseding Order of Conditions, based upon an on-site inspection and the referenced site plan. Additionally, the applicant shall submit an as-built plan prepared by a registered professional engineer; or land surveyor of the Commonwealth, for all work that has been proposed within the area of the Department ' s jurisdiction. Such plan shall indicate in a clear manner the final and actual conditions of the site. 20. Special Conditions numbered 17 25, 32 , 38 , 39 , and 41 shall extend beyond the Certificate of Compliance, in perpetuity, and shall be referenced in the Certificate of Compliance. The applicant shall notify the Department and the North Andover Conservation Commission, in writing, 48 hours before any activity commences on the project site and shall advise the North Andover Conservation Commission of the name (s) and telephone number (s) of the person(s) responsible on site for compliance with this Order. This list shall be re-submitted if any changes are made to it. 22 . Prior to any activity on site, the applicant shall submit a construction schedule/sequence to the Department and the North Andover Conservation Commission detailing the proposed sequence of work on site. 23 . The developer or contractor responsible for the project ' s completion shall be notified of, and understand, the requirements of this Superseding Order. A copy of this Order shall be on-site while activities regulated by this Order are being performed. 24 . At least every three months construction activity occurs on site, and for as long thereafter as ground remains unstabilized, the applicant shall submit a report from a registered professional engineer, to the Department and the North Andover Conservation Commission certifying that, to the best of his knowledge and belief based on a careful site inspection, all work is being performed in compliance with this Superseding Order of Conditions. This is to facilitate review of compliance to the plan and these conditions. The inspection engineer shall notify the Department and the North Andover Conservation Commission immediately in writing if removed from or no longer involved in the project. 25. A permanent 10 foot "no cut" zone shall be established from the edge of the Bordering Vegetated Wetland (exclusive of sedimentation basin/velocity dissipator placement) . 26. The applicant shall ensure that the 26" swamp white oak (and its root system) shown on the plan in the rear of the building will be undisturbed as a result of this project. The contractor will contact the North Andover Conservation Commission at least 48 hours prior to any excavation within 50 feet of this tree. 27 . A subsurface impervious barrier, no less than 40 mm thick, shall be placed under the rip-rap in the rear of the building. 28 . No earthen embankment in the Buffer Zone shall have a slope steeper than 2 : 1. Any slopes of steeper grade shall be rep-rapped to provide permanent stabilization. 29 . All disturbed or exposed soil surfaces shall be temporarily stabilized with hay, straw, mulch or any other protective covering and/or method approved by the U.S . Department of Agriculture Soil Conservation Service. Page -3- File #242-538 Special Conditions 30. All final earth grading shall be permanently stabilized by the application of loam and seed or sod. 31. The storm drainage system shall be constructed during the initial phase of the project so that it may be functional during construction. Said structures shall be kept free of silt and debris to ensure their proper operation. All storm drains shall have siltation control fabric placed on top under the covers and shall be maintained until construction is completed. 32 . Catch basins or manholes shall be fitted with sumps and oil/gasoline traps which shall be maintained and cleaned at least twice a year or more frequently if needed. This is a continuing condition of this order and will not expire after the issuance of a Certificate of Complian ce. 33 . All catch basin drainage points, or other point source discharge points, shall have .rip-rap, silt ponds or velocity dissipators installed as shown on the plans to disperse stormwater energy. 34 . Washings from concrete trucks, or surplus concrete, . shall not be directed to, or dumped into, any drainage system or wetland resource area. 35. Prior to any earth moving activity, a row of filter fabric fencing, backed by one row of staked haybales placed end to end, shall be placed upgradient of all resource areas along the limit of activity between all disturbed areas and the wetland. This shall also define the limit of activity downgradient of which no work shall take place. Additionally, snow fencing shall be placed upgradient of the siltation fence in any place that construction is within 10 feet of the wetland edge. These erosion and maintained in a state of good repair siltation controls shall be mai until all disturbed areas have been stabilized, or until a determination by the Department stating that control measures are no longer necessary. 36. The applicant shall move swiftly to control any erosion problems r that occur on the site. The Department reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. 37 . Any dewatering activities on the project site in which water will be released to Resource Areas or storm drains shall make use of a settling pond or similar device to remove sediment before water is released. 38 . Fertilizer utilized for landscaping and lawn care shall be low in nitrogen content and shall be used in moderation. Pesticides and herbicides shall not be used on site within 100 ft. of a resource area. Page -4- File 242-538 Special Conditions 39 . No sodium based or other deicing agent is to be used on paved surfaces, and any arrangement for snow removal shall so stipulate. 40. Equipment storage and refueling operations shall be situated in an upland area at a distance greater than 100 feet from a Bordering Vegetated Wetland. 41. There shall be no underground storage of fuel or other hazardous substance on the property within the Buffer Zone. 42 . All debris, fill and excavated material shall be stockpiled far enough away from resource areas as possible and surrounded by staked haybales to prevent sediment from surface runoff entering not less than 25 feet) . At no time shall an debris the wetlands ) Y ( or other material be buried or disposed of within that line marked on plan as a Resource Area or Buffer Zone. Findings Pursuant to M.G.L. Chapter 30, Sections 61 to 62H Inclusive (M.E. P.A. ) This project as described in the Notice of Intent for DEP File #242-538 is "categorically exempt" pursuant to the "Implementation of the Massachusetts Environmental Policy Act" as adopted by the Secretary of Environmental Affairs. This project is "categorically exempt" as the Wetlands Thresholds established under 301 CMR 11. 26 (7) (a) of M.G. L. Chapter 30, Section 62 to 62H inclusive, have not been exceeded. This finding is only applicable to activities proposed for the above-reference file number before the Department of Environmental Protection, Division of Wetlands. It does not relieve the applicant from complying with additional M.E. P.A. requirements when applying for permits from other applicable departments or agencies. The original calculations were revised in order to calculate the 100 year flood plain south of the new road, prior to exiting the site via 2-24" diameter ' culverts. The upstream wetland was modeled as a detention pond since some attenuation will occur. ' The actual site as proposed was analyzed and compared to the original work done for the subdivision. The runoff shall be "ultimately" controlled by the central detention pond existing in ' the present park. The letter contains a profile of the company and its operations which I believe provides most of the information that the Planning Board and Town Departments have requested including a short history of the corporation, the products it produces, size of work force hours foperation n p p o s o and details of material and chemicals which are part of their manufacturing processes, and how they are handled. I would also like to address several other areas about which information has been requested. Water & Sewer Impact The proposed facility will use approximately 4850 GPD from the Town water system. Of this figure 3,000 GPD will be used in a water de-ionizing process. The balance is estimated to be needed for domestic purposes. Discharge into the Town Sewer system via Willow Street and the Flowage Inc. pump station on Route 114 will be approximately 4100 GPD comprised of 2,250 GPD of uncontaminated process discharge water and an estimated 1850 GPD from domestic use (calculated according to Title V of the State Sanitary Code). HVAC Equipment Noise The proposed facility will require an estimated 160 tons of air conditioning of which 75 tons will provide for the base building/office needs, and 85 tons will provide for the clean room/assembly and test areas where the manufacturing actually takes place. A question has been raised as to what extent the additional HVAC equipment serving the manufacturing areas will contribute to noise levels that are greater than is customary for a building of this type. Please be advised that 100% + increase in HVAC tonnage will not significantly increase the noise level at this facility because the roof-top HVAC units (RTU's) serving the manufacturing areas will .be, with the exception of added air purification filters, of the same type as those serving the base building/offices. The respective sound levels will, for practical purposes, merge as opposed to add to one another in a manner which is typical for wave phenomena such as light and sound. The meeting was attended by Ms. Elizabeth Sabounjian representing the DEP, Mr. Robert Webster of the Bayfield Company, developer of the North Andover Business Park and of the proposed project, Mr. James Bourgeois of EDC, Inc. , planner and architect, Mr. Thomas E. Neve of Neve Associates, Engineer, Mr. Curtis Young of Wetlands Protection, Inc. , Environmental Scientist, Mr. Richard Doucette, North Andover Conservation Commission Administrator and his intern, Art Allen. Ms. Sabounjian was presented with a Master Plan of the North Andover Busin ess Park and vicinity to familiarize her with the neighborhood. Mr. Neve proceeded to summarize how the neighborhood evolved into its . present form over a period of years via three separate industrial subdivisions/Orders of Conditions, the extent of constr uction to date, and the role the central wetland/flood storage area has played in the past and proposed hydrologic engineering. There was further discussion concerning best management practices to protect water quality and as to how they have historically been applied to this development. She questioned the capability of the rip-rap outfall structures proposed to be installed at the discharge points of the storm drainage system, particularly their ability to withstand scouring during extreme storm conditions. 2. She questioned the ability of the project as designed to contain an oil or chemical spill "at the proposed (or additional) loading dock(s) . The DEP asked that provisions be incorporated into the project which will contain a spill of up to 55 gallons. 3. She questioned whether any provisions were made on adjacent land owned by Bake-N-Joy Foods to sustain a slight increase in the 100 Year Flood Plain. It was agreed that we would answer these concerns and provide Ms. Sabounjian with appropriate documentation within 10 business days following our site meeting. Please find attached a revised set of project drawings which incorporate certain details which address the preceding questions. 1. Large river rocks will be placed at the outlets of the storm drainage system as per Detail A Sheet L3-1 in order to provide water velocity dissipation. These structures will prevent erosion scouring, or any movement of the rip-rap material from entering into the resource area under extreme rainfall conditions. 2. Detail B, Sheet L3-1 provides a variation of a the typical precast concrete catch basin which we propose to locate at the north west corner of the paved area. This structure will be sealed such that none of its contents can leach into the surrounding soil. Our calculations indicate that the oil separation and spill containment capacity of the structure is approximately 90 gallons. Any oil or volatile chemicals spilled at the proposed loading dock, or any additional loading docks which might be constructed in the future, will be trapped and contained at this point. The contents can be removed by simply pumping the structure clean. 3. Sheet L2-1 shows a Utility Easement which the developer has maintained across the East side of the Bake-N-Joy property. This easement was created when land was subdivided in 1985. It is shown on a plan entitled "Plan of Land in North Andover and Andover, MA prepared for the Bayfield Company by Thomas E. Neve Associates, dated September 11, 1985 revised December 31, 1985. " and recorded at the North Essex Registry of Deeds, Plan No. 10147. This easement for the most part will contain the additional land subject to flooding. Please understand that this flooding will occur during a 100 Year Event and the peak will last about 3 hours. I hope this report and the revised plans with additional details furnishes you wi th ith the requested information.
