The NACC orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. GENERAL CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of property rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by-laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this order. 5. This Order may be extended by the issuing authority for one or more periods of up to one year each upon application to the issuing authority at least 30 days prior to the expiration date of the Order (Refer to Section VIII (p.15) of the North Andover Wetland Regulations). 6. Where the Department of Environmental Protection (DEP) is requested to make a determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 7. The proposed work includes: Construction of a 19,000 s.f.addition for a manufacturing facility,parking,utilities and appurtenances partially within the buffer zone of vegetated wetlands. The work shall conform to the following (except as noted in the remainder of this document where revisions may be required): Notice of Intent filed by: United Realty Trust DATED 11/19/96 Plans prepared by: MHF Design Consultants,Inc. entitled"Site Plan-Sheet 3 of 8" DATED REV 12/16/96 entitled"Grading and Utilities Plan-Sheet 4 of 8" DATED REV 12/16/96 Report prepared by: MHF Design Consultants,Inc. entitled"Drainage Analysis and Design" DATED 10/7/96 9. The following wetland resource areas is affected by the proposed work: Buffer Zone to Bordering Vegetated Wetland (BVW). This resource area is significant to the interests of the Act and Town ByLaw as noted above. This resource area is also significant to the recreational and wildlife interests of the ByLaw. The applicant has not attempted to overcome the presumption of significance of this resource area to the identified interests. 10. The NACC agrees with the applicant's delineation of the wetland resource areas on the site as shown on the plans dated REV 12/16/96. Prior to the issuance of a Certificate of Compliance, the applicant will submit a plan showing the site's wetland delineation at a scale identical to the Town wetland map for this location. 11. Issuance of these Conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding or storm damage. 12. The conditions of this decision shall apply to, and be binding upon, the applicant, owner, its employees and all successors and assigns in interest or control. 13. The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site to construct the 19,000 square foot addition will cause further alteration of the wetland resource areas. In order to prevent any alteration of wetland resource areas a twenty one foot (21') No-Disturbance Zone and a forty eight foot(48') No-Construction Zone shall be established from the edge of the adjacent wetland resource area. The conservation administrator and/or other agents of the NACC do not have the authority to CAWinword\OOC\242-843.doc 2 NACC 1/8/97 DEP FILE # 242 - 843 waive these setbacks as established under the local bylaw. No disturbance of existing grade, soils or vegetation is permitted in the No-Disturbance zone. (See Appendix 5 of the local Regulations). 14. All catch basins shall contain oil/gasoline traps, and it shall be a continuing condition of this order, even after a Certificate of Compliance is issued, that the oil/gasoline traps in the catch basins be maintained. All catch basins shall be free of all accumulated silt and debris before a Compliance is issued and the owner or his/her agent shall so specify in the request for Compliance. CAWinword\OOC\242-843.doc 3 NACC 1/8/97 t DEP FILE # 242 - 843 PRIOR TO CONSTRUCTION 15. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department or Court have been completed. 16. This Order shall be recorded by the applicant at the Registry of Deeds immediately after the expiration of all appeal periods. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the North Andover Conservation Commission on the form at the end of this Order prior to commencement of the work. 17. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bearing the words "Massachusetts Department of Environmental Protection,File Number 242-843." 18. Any changes in the submitted plans caused by the applicant, another Board's . decision or resulting from this Order of Conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds said changes to be significant, the NACC will call for another public hearing (at the expense of the applicant). Within 21 days of the close of said public hearing the NACC will issue an amended or new Order of Conditions. Any errors found in the plans or information submitted by the applicant shall be considered as changes. The proposed project may be still under review by other local or state boards or agencies. This may result in changes to the project plans or wetland impacts. If any such changes occur a revised plan and an explanation of the revisions shall be submitted to the NACC for review and approval prior to the start of construction. No work shall begin on a project until written approval has been granted by the NACC. 19. The applicant shall contact the Conservation Office prior to site preparation or construction and shall arrange an on-site conference with an NACC representative, the contractor and the applicant to ensure that all of the Conditions of this Order are understood. This Order also shall be made a part of the contractor's written contract The applicant or contractor shall notify the NACC in writing of the identity of the on-site construction C:\Winword\OOC\242-843.doc 4 NACC I/8/97 DEP FILE # 242 - 843 supervisor hired to coordinate construction and to ensure compliance with this Order. 20. The applicant shall submit a construction schedule/sequence to the NACC detailing the proposed sequence of work on site to complete this project. 21. Wetland flagging shall be checked prior to start of construction and shall be re-established where missing so that erosion control measures can be properly placed and wetland impacts can be monitored. 22. A row of staked hay bales backed by trenched siltation fence shall be placed between all construction areas and wetlands. The erosion control barrier will be properly installed and placed as shown on the plans approved and referenced herein and shall be inspected and approved by the NACC prior to the start of construction and shall remain intact until all disturbed areas have been permanently stabilized to prevent erosion. All erosion prevention and sedimentation protection measures found necessary during construction shall be implemented at the direction of the NACC. 23. The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, a minimum of fifty (50) hay bales and sufficient stakes for staking these bales (or an equivalent amount of silt fence). Said bales shall be used only for the control of emergency erosion problems, and shall not be used for the normal control of erosion. 24. A check payable to the Town of North Andover shall be provided in the amount of$5,000 which shall be in all respects satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the North Andover Town Treasure before commencement of work. Said deposit of money shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, and Town Counsel, and shall be released after completion of the project, provided that provision; satisfactory to the NACC, has been made for performance of any conditions which are of continuing nature. The applicant may propose a bond release schedule keyed to completion of specific portions of the project for the NACC's review and approval. This condition is issued under the authority of the local ByLaw. CAWinword\00C\242-843.doc 5 NACC 1/8/97 DEP FELE # 242 - 843 DURING CONSTRUCTION 25. Immediately upon completion of the dwelling foundation, and prior to further construction activities associated with the site, the applicant shall complete a plan prepared by a Registered Professional Land Surveyor (R.P.L.S.) which accurately depicts the foundation location and ifs proximity to wetland resource areas as approved under this Order of Conditions. Said plan shall be submitted to the Conservation Administrator for approval. 26. Upon beginning work, the applicant shall submit written progress reports every month detailing what work has been done in or near resource areas, and what work is anticipated to be done over the next period. This will update the construction sequence. 27. Any fill used in connection with this project shall be clean fill, containing no trash, refuse rubbish or debris, including but not limited to lumber, bricks, plaster, wire,lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts on any of the foregoing. 28. No exposed area shall remain unfinished for more than thirty (30) days, unless approved by the NACC. 29. No regrading in the buffer zone shall have a slope steeper than 2:1 (horizontal: vertical). Slopes of steeper grade shall be rip-rapped to provide permanent stabilization. 30. There shall be no stockpiling of soil or other materials within twenty-five (25) feet of any resource area. 31. Washings from concrete trucks, or surplus concrete, shall not be directed to, any drainage system, or wetland resource area. 32. All waste generated by, or associated with, the construction activity shall be contained within the construction area, and away from any wetland resource area. There shall be no burying of spent construction materials or disposal of waste on the site by any other means. The applicant shall maintain dumpsters (or other suitable means) at the site for the storage and removal of such spent construction materials off-site. 33. Accepted engineering and construction standards and procedures shall be followed In the completion of the project. CAWinword\00C\242-843.doc 6 NACC 1/8/97 DEP FILE # 242 - 843 34. Members of the NACC or its agent shall have the right to enter upon and inspect the premises to evaluate and/or effect compliance with this Order of Conditions. The NACC reserves the right to require, following field inspection, additional information or resource protection measures. 35. During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant within one (1) business day. No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. CAWinword\00C\242-843.doc 7 NACC 1/8/97 DEP FILE # 242 - 843 AFTER CONSTRUCTION 36. No underground storage of fuel oils shall be allowed on any lot within one- hundred (100) feet of any wetland resource area. This condition shall survive this Order of Conditions, and shall run with the title of the property. This condition is issued under the authority of the Towns Wetland protection ByLaw. 37. Fertilizers utilized for landscaping and lawn care shall be organic and low- nitrogen content, and shall be used in moderation. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. This condition is issued under the authority of the Towns Wetland Protection ByLaw. 38. Upon completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done either by loaming and seeding according to SCS standards. If the latter course is chosen, stabilization will be considered complete once vegetative cover has been achieved. 39. Upon completion of the project, the applicant shall submit a letter to the NACC from a Registered Professional Civil Engineer certifying compliance with this Order of Conditions and the approved plans referenced herein (or approved revisions). Certification includes, but is not limited to, verification that the limit of work coincides with the approved "NO- DISTURBANCE/NO-BUILD" zones. A stamped "As-Built" topographic plan of all areas within the jurisdiction of the Wetlands Protection Act and ByLaw shall be submitted when a Certificate of Compliance is requested. This plan will include: a) "As-Built" elevations of all drainage.structures constructed within 100 feet of any wetland resource area; b) "As-Built' elevations and grades of all filled or altered wetland resource areas; c) Distances from structures to wetland resource areas. Structures include, but are not limited to, septic systems, stone walls, retaining walls, and approved decks; d) A line showing the limit of work. "Work" includes any disturbance of soils or vegetation; e) Location of all subsurface utilities entering the property; CAWinword\00C\242-843.doc 8 NACC 1/8/97 1 DEP FILE # 242 - 843 f) Location of existing erosion controls. 47)Furthermore, the following information must be submitted to the NACC when requesting a Certificate of Compliance: a) The name and address of the current landowner; b) The name and address of the individual/trust or corporation to whom the compliance is to be granted; c) The street address and assessor's map/parcel number for the project; d) The DEP file number; e) A statement certifying compliance with the Order of Conditions and approved plans. 48. The following special conditions shall survive the issuance of a Certificate of Compliance (COC) for this project: 0 25' No-Disturbance Zone and a 50' No-Construction Zone shall be established from the edge of adjacent wetland resource areas except in those locations approved under DEP # 242-843. Future work within 100' of existing wetland resource areas will require a separate filing with the NACC (refer to Section XI (page 18) of the Regulations for performance standards within these zones) The Conservation Administrator and/or other agents of the NACC do not have the authority to waive these setbacks as established under the local ByLaw; e Maintenance of catch basins; o Discharge of spillage of pollutants; o Prohibition of storage of fuels underground; o Limitations on the use of fertilizers, herbicides and pesticides. In general, the site is developed with an existing two story commercial building with associated parking and landscaped grounds bounded by a ' forested coniferous/deciduous hillside to the west. Topography is generally rolling with an overall slope to the east. The wetland is comprised of an intermittent swale located to the west and southwest of the proposed addition. This channel originates at a groundwater seep and flows ' northerly, through a red maple shrub swamp and ultimately dispersing into a red maple swale which discharges surface flow to the east. This swale extends to the east, towards the intersection of Willow Street South Extension and Flagship Drive and continues off-site to the east beneath Willow Street South Extension. Fugro utilized a multiparameter methodology to confirm the state and federal jurisdictional ' wetlands, and reviewed soil characteristics in the field as well as literature review of the Soil Conservation Service maps. Soil characteristics were examined in the wetlands and adjacent uplands. Field evaluations were utilized in conjunction with the Soil Conservation Service Soil ' Survey of Essex County,Northern Part published in February, 1981 (SCS Survey). According to Sheet 36 of the SCS Survey, the soils within the aforementioned wetland are classified as ' Whitman and as very poorly drained. Upland soils were mapped by SCS as Montauk-well drained and Woodbridge-moderately well drained. Field evaluations confirmed the SCS Survey findings within the wetlands and the adjacent upland. ' As defined under the Massachusetts Wetlands Protection Act (MWPA) (MGL Ch. 131, s.40), its Regulations (310 CMR 10.00), and the North Andover Wetlands Protection Bylaw and Wetlands ' Regulations two resource areas are present: Bank (310 CMR 10.54), and Bordering Vegetated Wetlands (BVW) (310 CMR 10.55). According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map for North Andover, Panel # 250098 0006C and 0008C, no ' portion of the 100 year flood plain is located within or adjacent to the site. The Massachusetts Natural Heritage and Endangered Species Program's (Program) Atlas of Estimated Habitats of Rare Wetland Wildlife (1995/96 Edition) has not mapped any known rare wetland wildlife habitat on this parcel. Fugro sent a letter (November 14, 1996) to the Program ' requesting a review of their records.for the entire site (i.e., upland and wetlands) for the presence of protected (i.e., rare, threatened, endangered, special concern) wildlife and plant species and/or critical habitats (See Appendices). According to the Massachusetts Natural Heritage Estimated ' Habitats for Rare Wetlands Wildlife, 1995-1996 Edition, South Groveland Quadrant there are no rare wetlands wildlife estimated habitats documented on the site. ' S-1 Notice of Intent• 165 Flagship Drive, North Andover,MA•November 18, 1996 5.2 Wetland Delineation Jurisdictional resource areas were delineated by a wetland scientist from Fugro in October 1996. ' The wetland boundaries were reviewed in accordance with Section 404 of the Clean Water Act, Massachusetts Wetland Protection Act (MGL Ch. 131, s. 40), its Regulations (310 CMR 10.00), ' and the North Andover Wetlands Protection Bylaw and Wetlands Regulations. The edges of freshwater vegetated wetland were flagged in the field using pink plastic surveyors tape labeled numerically. Wetland flags were subsequently surveyed as shown on the site plan depicting wetland resource areas (see Grading and Utilities Plan). Vegetated wetland delineations were also reviewed pursuant to Section 404 of the Clean Water Act in accordance with the Corps of Engineers Wetland Delineation Manual (1987) and relevant Corps of Engineers-New England Division wetland delineation policies. 5.3 Wetland Resource Areas The BVW associated with the intermittent stream and red maple swamp are dominated by a mature canopy and shrub species. The intermittent stream channel discharges flow to the north. ' A mosaic of braided stream channels and sheet flow discharge into a broad swale that conveys flow to the east, towards the intersection of Flagship Drive and Willow Street South Extension, and along the northern property boundary. The canopy is dominated by red maple (Ater rubrum) with swamp white oak (Quercus bicolor), ' red oak (Quercus rubra), and eastern white pine (Pinus strobus) co-dominating. The shrub layer is well established. Dominant shrubs include, northern arrowwood (Viburnum recognitum), highbush blueberry (Vaccinium corymbosum), sweet pepperbush (Clethra alnifolia), and swamp ' azalea (Rhododendron viscosum). Herbaceous species include cinnamon fern (Osmunda cinnamomea), jewelweed (Impatiens capensis), poison ivy (Toxicodendron radicans), and sphagnum moss (Sphagnum sp.). ' 5.3.1 Jurisdictional Wetland Resource Areas ' Jurisdictional resource areas were identified and demarcated in the selected portion of the site in accordance with the Massachusetts Wetlands Protection Act (M.G.L. c. 131, s. 40) and its Regulations promulgated at 310 CMR 10.00, and the North Andover Wetlands Bylaw. As ' indicated previously, the edge of the BVW(310 CMR 10.55) was demarcated by pink surveyor's flagging tape numerically labeled 1-9. The eastern boundary was demarcated from the southwestern corner of the existing building to the southwest. The wetland is located just above ' the top of the slope which coincides with the edge of the maintained lawn hillside. The boundary parallels a stone wall between flags 4 and 6 then diverges to the southwest, along the toe of a ' moderate slope, to Flag 9 "End". Wetland flags are illustrated on the "Grading and Utilities Plan" prepared by MHF Design Consultants, Inc., dated October 29, 1996. This elevation was determined as a component of the Willow Street Extension ' Notice of Intent hydrologic evaluation and does not extend into the site. Therefore, the site does not contain any Bordering Land Subject to Flooding (BLSF) which is protected as a resource area. Also, compliance with the North Andover Wetlands Bylaw and its regulations, no work is proposed within 25 feet of the wetland boundary. - 6.1.1 Compliance Evaluation As indicated previously, all proposed activities on the site meet the performance standards for Wetland Resource Areas of the Act and Regulations. No BVW, Land Under Watervay (LUWW), BLSF, Isolated Land Subject to Flooding (ILSF) or Bank will be directly altered for the proposed construction on the site. ' 6.2 Proposed Activities Within the Buffer Zone of Wetlands ' Work within 100-foot buffer zone of BVW includes a portion of the building and associated parking, drainage swales, portions of the access roadway, grading, and BMPs. As required by the North Andover Wetlands Bylaw, the project has been designed to provide a 50-foot no- construction setback and a 25-foot no disturbance setback along the entire wetland boundary. In accordance with the local by-law, no structures are proposed within 50 feet of the edge of wetlands. 6.3 Stormwater Runoff Water Quality ' Construction methodology and sequence is proposed to address water quality, erosion protection, and sediment control issues. The design of the proposed drainage system will tie into and utilize the existing stormwater system to insure that the minimum surface water quality standards are met. The existing system of catch basins, manholes, swales, and pipes will direct runoff from the site to the existing outlet in the northeastern corner of the site. Sediment barriers will be installed ' at this outlet prior to any construction activities. Since the proposed site layout will remain below the build out capacity of the parcel, the existing stormwater treatment system for the commercial subdivision will provide sufficient treatment for the additional runoff(see Drainage Analyses and Design submitted under separate cover prepared by MHF). 6.4 Proposed Activities Beyond the 100-foot Buffer Zone Proposed activities beyond the 100 foot buffer zone, include portions of the 19,000 s.f. office ' building addition, associated paved parking, a parking lot runoff drainage ditch, grading, landscaping, and subsurface utilities. A siltation fence and haybale barrier will be installed approximately 25 feet from the wetland boundary which will also act as a visual barrier for the limit of work (see Grading and Utilities Plan). The site layout has been designed to allow for the 50-foot no construction set-back required by the North Andover Wetlands Bylaw. 6.5 Erosion and Sedimentation Control ' Prior to the start of construction, standard erosion and sedimentation controls will be installed between all proposed activities and adjacent wetland resource areas (see Grading and Utilities ' Plan). These controls will be inspected and maintained throughout the duration of construction and site disturbance. Any controls which are not performing as intended will be replaced and/or removed, and any other areas of the site which require additional controls will be addressed. No ' erosion control measures will be removed until all areas are mechanically or vegetatively stabilized. The proposed project is located in the North Andover Business Park Expansion at 165 Flagship Drive North Andover, Massachusetts. The property, Assessors Map 25 Lot 85, also known as Lot 3 North Andover Business Park Extension, consists of approximately 5.192 acres and contains an existing 2 story metal and masonry building with associated site utilities and structures. ' This project proposes an addition of a±19,295 s.f building and associated site improvements to the existing±31,690 s.f. building. Improvements include access improvements, additional parking, drainage ' and associated grading for the proposed addition. This property is part of the previously approved"Definitive Subdivision Plan, North Andover Business ' Park Extension, Willow Street-Flagship Drive", prepared by Thomas E. Neeve Associates, Inc. Dated December 1, 1989. Part of this plan included an overall, master hydrologic and hydraulic analysis, a stormwater management plan for the development of the park. This analysis confirms that the original master plan of stormwater management is adhered to for the ' proposed addition to the existing building and development of Lot 3. That is to say that the flows and drainage patterns for the proposed development of Lot 3 meet the requirements of the master plan. Drainage patterns are similar and flows are less than anticipated in the master plan of stormwater 1 management for this site and drainage areas. This proposed stormwater management plan utilizes the same methodology as the original master plan of stormwater management in order to develop peak flow rates for design of the proposed drainage system. The design standards of the North Andover Site Plan Regulations require the determination of the 2-yr, 10-yr and 100-yr peak flows for comparison to the master plan, design of the interior site drainage is based on the Rational Method for the 10-yr design storm while the intercepting g-ass lined swales are I desigr_ed to handle the 100-yr peak flows based on the peak flow as developed by the use of the USDA- SCS TR20 computer software. B. Hydrology. The approved original master plan of stormwater management for the "Definitive Subdivision Plan, North Andover Business Park Extension, Willow Street-Flagship Drive" assumed that the proposed lots within ' the development would be significantly developed. The master plan's site area drainage plan indicated. the division of Lots for the business park and the extent of impervious land (buildings, drives and parking areas) associated with each lot. This was done to develop proposed peak flows. Development of the business park is occurring with significantly less area becoming impervious land and 1 thus resulting in lower peak rates of runoff, and therefore, in general compliance with the stormwater management master plan. The direct comparison of the master plan and the Lot 3 as shown in the Definitive Subdivision Plan to the current configuration of Lot 3 and it's actual development is ' somewhat complicated by revisions to lot lines. Lot line revisions were due in part to wetland areas encountered during construction and development of other adjacent properties. This has resulted in the current configuration of Lot 3. The current configuration of Lot 3 is comprised partly of both th-_ ' Difinitive Subdivision Plan's Lot 2 and 3. This can be easily seen by overlaying the current configuration of Lot 3 on the Difinitive Subdivision Plan. Likewise, the following comparision of the current Lot 3 to the Definitive Subdivision Plan can be made by overlaying the current Lot 3 layout and proposed development on the Definitive Subdivision Plan, master plan's site drainage map. Given the preceeding, the following may be determined by this overlay of lot configurations and land uses: Impervious Land Overlay No. Lot 2 and Lot 3 of Definitive Subd. Plan. (Area within Lot 3 145,701 s.f. A with revised property lines) Lot 3 with existing and proposed addition 131,441 s.f. B Net Change (A decrease in the proposed impervious land area): 14,260 s.f. Given the net decrease in impervious land proposed for the same area, the resulting lower weighted runoff curve number, slightly longer times of concentration (due to less flow over paved surfaces and closed drainage systems), it follows that the resultant peak rates of runoff will be lower than those originally approved for the same area. The proposed Lot 3 addition along with the existing development will result in lower peak rates of runoff P P g g P than that which was approved in the Definitive Subdivisions stormwater management master plan. Further, it can be seen that drainage patterns of the stormwater management master plan are retained with the intended flow to the"Central Detention Basin". See Overlay plans A& B, 1"=100'. ' In summary, the proposed peak rates of runoff will be less for Lot 3 with the proposed addition, than to those determined and approved in the "Definitive Subdivision Plan, North Andover Business Park Extension, Willow Street-Flagship Drive". This is due to a net reduction in the proposed impervious land area and the retention of the proposed drainage patterns. 1 C. Hydraulics. The proposed interior drainage system is proposed to connect to the existing drainage system. Design is in accordance with the Drainage Design Criteria and Standards of the Town of North Andover. The 2- yr, 10-yr and 100-yr design storms were utilized to determine the peak rates of runoff for the sizir_g of drainage structures and the analysis of existing structures to determine adequacy. ' Drainage Design Basis: Drainage Design for Interior Site is based on the Rational Method, Q=CIA. ' The following coefficients of runoff are used: Undeveloped Woodland, rolling slope 5-10%, using soil texture clay for a factory of safety, ' C=0.50. Lawn areas, sandy loam, 0-5% slope, C=0.3. The ° etlernd plant community was evaluated for general health„ vigor, and abundance. Individual shrubs and saplings were identified and counted. Herbadeous species were identified and abundance was characterized as either common, occasional, or rare, In addition, physical characteristics such as surficial hydrology, erosion, and soil conditions were documented. The May 14, 1997' inspection was conducted in the early growing season„ thnrus the woody vegetation was only partially leafed out and not all the herbaceous species had sprouted. The mature tree canopy along the fringe of the replacement area and those trees saved within the replacement area appeared to all be in good condition, except one white oak ( uercus alba) which had broken off approximately 30 feet high. Since the tree damage is at 30 feet„ ENSR does not believe the damage is associated with the excavation of the replacement area. This damage may have occurred during a winter storm, possibly the April 1 1997 blizzard. All shrubs and saplings were in good condition at the time of the monitoring evaluation. An additional monitoring evaluation will be conducted later in the 1997 growing season and a report will be issued to the Conservation Commission at that time, This replacement area complements the adjacent forested wetland habitat and, as it matu9res„ is expected to be a valuable edge habitat component of the overall wetland system.
