3. Continued Public Hearing of 23 Cleveland Street
The petition of Dawn Vargas for property at 23 Cleveland Street(Map 029.0, Parcel 0027),North Andover,
MA 01845 in the R-4 Zoning District. The Applicant is requesting a variance pursuant to Town of North
Andover Zoning Bylaws Section 195-7.3 Yards (setbacks) for one side setback in the R-4 Zoning District
for the purpose of extending an existing deck on the property; specifically,Applicant has requested a side
setback needing a relief variance of 14.09 ft. (side setback proposed is 5.91 ft, side setback required is 20
ft.).
Applicant is at the table and has submitted an updated plan. She has reduced the size of the proposed deck
and is now only requesting a relief variance of 9 ft., leaving a proposed setback of 11 ft. The side setback
required is 20 ft.
The board appreciates the reduction on the setback request.
Mark Couglin 84 Saunders Street is in support of the project.
Motion made by A. Cuscia to close the public comment. Seconded by S. Seide. The motion to close is
unanimous.
Notices and agendas are to be posted 48 horns in advance of a meeting excluding Saturdays,Sundays,and legal holidays. Please keep in mind the
Town Clerk's hours of operation and make necessary arrangements to be sure that posting is made in an adequate amount of time. A listing of topics
the Chair reasonably anticipates will be discussed at a meeting are to be listed on the Agenda. Note: Matters may be called out of order and not as

The Board deliberates.
Motion made by A. Cuscia to grant a variance pursuant to Town of North Andover Zoning Bylaws Section
195-7.3 Yards (setbacks)for one side setback in the R-4 Zoning District for the purpose of extending an
existing deck on the property; specifically,Applicant has requested a side setback needing a relief variance
of 9 ft. (side setback proposed is 11 ft, side setback required is 20 ft.). Seconded by M. Lis. R. Faigen voted
yes. A. Jacobs voted yes. A. Cuscia voted yes. M. Lis voted yes. S. Seide voted yes. The motion to approve
is unanimous 5-0. The following plans were referenced:
(1) Plan of Land prepared by Merrimack Engineering Services dated November 22,2022, containing
three(3)pages; and
(2) Photographs of the area of existing and proposed deck, undated, containing five (5)pages.
4. Discussion
2023 Election of Board Officers in January 2023.
5. Adjournment
Motion made by A. Jacobs to adjourn the meeting. Seconded by S. Seide. The vote to adjourn is
unanimous.
