I have the following questions and comments based on Section 8.3 of the North Andover Zoning Bylaw: • 5(e)(v): The contour lines are very light. They must be made darker so that the plan may be read more easily. • 5(c)(vii): Explain storm water drainage system. • 5(e)(xii): Any signs proposed? • 5(e)(xx): Approval from FAA required? • 5(e)(xxii): What is the overall plan for this section of the airport? When will utilities be brought to this area? What provisions have been made for fire protection?Public safety? Sanitary issues? As you know I received no notice of the public hearing due to it being sent to the Lawrence airport manager. Additionally I received no notice of the Dec, 2nd meeting and had no chance to review the pending decision prior to the meeting. I was a little confiised to hear the board approve the site plan without being privy to the details. Having sat through the evening's proceedings, I was able to develope an accurate sense of the personalities that comprise the board. I'm pleased to say that I found them to be reasonable people with a genuine interest in resolving the problems that they were presented in an intelligent and professional manner, As an engineer,I particulary enjoyed the cominent on Boolean logic. In contrast to the board's demeanor, I thought that Fire Lt. Mclaikas' stance at the Technical Review Meeting ivas overly adversarial, Subsequent conversation with Fire Chief Dolan left me with a similar impression regarding him. As representatives of the Town of N. Andover, I would expect them to conduct themselves in a more professional and courteous manner when dealing with the citizens, I would like to present the facts regarding our objection to the requirement of a fire alarm. These are based upon pertinent sections of the Commonwealth of Mass Regulations, 6th edition March 1997. These are very extensive,and the result of a herculean effort to apply the rules pertaining to public safety in a fair and uniform manner. Regulations clearly indicate the basis of out objection to the installation of an automatic fire alarm. In addition to the reasons cited, I believe that a review of the North Andover fire logs will also show that aircraft hangar fires at Lawrence municipal airport are a rarity and there is no basis to declare the hangars as hazardous. Melauikas stated that the Fire Department would require an automatic fire alarm system in the Lawrence Airport hangers, The Planning Board requests that you make a recommendation to the Board and respond to Mr.Dokus's letter. The Planning Board will be making a decision on this application on December 16, 1997. Attached please find a copy of Mr.Dolius's letter regarding this issue. Dokus Date: 12/11/97 I appreciate the Planning Boards request for a recommendation relative to Mr. Dokus' proposal for hangers at the Lawrence Municipal Airport. Our recommendation is that the buildings comply with the use classification as determined by the building commissioner and conform with other hangers built on airport property which underwent review process by the Planning Board. It is the building commissioners responsibility to classify the building as to use group and in this case that classification has been determined to be Use group H, Once that determination has been made the fire department applies the appropriate level of required fire protection. If Mr. Dokus disagrees he has a right of appeal to the State Building Board of Regulations and Standards. In addition, the fire chief, by law has the right to insure proper fire protection and I refer to the attached copy of M.G.L. Chapter 148 Section 28. If Mr. Dokus does not agree with the fire chief's determination he may appeal to the Office of Fire Services and the State Fire Marshal. Mr. Dokus is aware of this because he has spoken to the compliance officer, Mr, William Middlemiss, in the State Fire Marshals office regarding this matter. In short the determination of how to enforce the Building Code rests with the Building Commissioner, Mr. Robert Nicetta and the determination relative to the enforcement of the Fire Code is delegated by the State Fire Marshal to the head of the local fire department. 1921 - 75 YEARS OF SERVICE E - 1996 I hope this information assists the board. No person other than an employee in the service of the common- wealth or any political subdivision thereof or in the service of an independent contractor acting for the commonwealth or any such subdivision shall pile, push or plow snow-or-ice on or against any,fire hydrant or other similar device used for fire protection which is located in any public o.private way so as to conceal such hydrant or device or cover any outlet thereof. Whoever violates this section shall be punished by a fine of not more than one hundred dollars. SECTION 28. Regulations to prevent f1re hazards and Tires.. Section 28. The board shall make such rules and regulations, and the head of the fire department shall make such orders or rules not inconsistent therewith, as may be necessary to promulgate a comprehensive fire safety code for the following purposes- (1)to prevent or remedy any condition in or about any building,structure or other premises or any ship or vessel which may tend to become a fire hazard or to cause a fire. The head of the fire department or any person designated by him who, in the performance of his official duties, observes any condition which lie believes to be a violation of any provision of the state building code or any amendments thereto, shall report the same to the authority charged with the enforcement of such provision. We have an issue regarding the requirement for a fire alarm system that we have not been able to resolve with the fire chief. I have enclosed a copy of a letter I received from Chief Dolan stating that it is the building commissioner's responsibility to determine the use group for the building. The Fire Department will then apply the appropriate level of fire protection for that use group. In addition the fire chief has the authority to insure proper fire protection. Dire regulations to support our position. Unfortunately,neither Mr.Dolan nor Mr.Nicetta acknowledged receipt of that correspondence and the postal service has no record of delivery although it was sent certified mail, return receipt requested., Assumiuu the lack of delivery was the fault of the postal service. I have seat duplicates of the October 15,' letters to both Mr, Dolan and Mr. Nicetta. I am looking forward to Mr Nicetla's review of the facts involved so that if necessary, an appropriate appeal may be submitted to the State Board of Building Regulations and Standards as suggested by Chief Dolan in his letter to you dated 12/11197. WINCHESTER,MA. 01890 (781)-729-5393 March 11, 1999 Robert Nicetta,Building Inspector 27 Charles St. No, Andover,Ma 01845 Dear Mr. Nicetta, Having received our occupancy certificate for the hangar at 280 Holt Rd., (Lawrence Airport), we are concerned with the restriction of"storage only" that it contains. The notice of decision of the planning board contained the restriction "storage of airplanes only. The site shall not be used for the storage of fuels or other flammable material." We are in agreement with this restriction concerning flammable materials,and with the requirement that "the hangar must comply with all state fire and building codes." Our concern is over the extension of the term `storage only' to restrict other areas that are part and parcel of our organization's activities. As explained to the planning board and subsequently approved by that body, the hangar will be used for assembly and subsequent inspection of home-built aircraft. As is the case with any new device, some adjustment or revision is generally necessary prior to obtaining satisfactory performance. This being the case, repair and alteration is likely to be an on-going activity at the hangar from time to time. We are well aware of the provisions of 780 CMR 407.2 which states that in a facility such as ours, repair and maintenance cannot be for profit. Indeed, our lease with the airport specifically prohibits any commercial activity by our organization, While I don't think that any problem exists regarding our activities, we have been advised by counsel to clarify this issue. Therefore would you please provide us with a letter stating that the"storage only"restriction does not apply in the narrowest sense? Thank you, Edwin A.
