Any changes in coordinates, heights, frequericy (ies) or .use of greater power will void this determination. Any future construction or alteration, including increase in heights, power, or the addition of other transmitters, requires separate notice to the FAA. This determination does include temporary construction equipment such as cranes, derricks, etc . , which may be used during actual construction of the structure . The shadow would not completely obstruct the air traffic controller's view of this taxiway since it left more than half of the taxiway in plain view. Therefore, this Determination of No Hazard is granted under the following condition: The height of the building and any appurtenances shall not exceed the height of 179 feet A.MSL and therefore will not create a greater shadow on the adjacent taxiway than was plotted in the original study. This determination concerns the effect of the proposal on the safe and efficient use of the navigable airspace by aircraft and does not relieve the sponsor of compliance relating to laws, ordinances, or regulations required by other governmental bodies. Please refer to Aeronautical Study Number 00-ANE-0347-OE in any future correspondence concerning this structure. Attachment
