You have verbally inquired as to what zoning district the airport was located and if it was an allowed use.
The airport is located in the Industrial 2(12)District. Airport use is not found listed in either Table 1—
Summary of Use Regulations nor the detailed District Use Regulations of the North Andover Zoning Byy
law. The airport pre-existed zoning and is there by right. However,I am of the opinion that the airpoty
pursuant to M.G.L, 40A, Section 6 and Section 9—Nan-Confornung Uses of the North Andover Zoning,
By-law,is non-conforming in the district in which it is located

Re: Falcon Air—492 Sutton Street
I have reviewed the site plan for the referred project and have the following comments:
• Pursuant to Section 9—Non-Conforming uses—the applicant will have to petition the Zoning Board of Appeals
(ZBA)for a Special Permit as the erection of an airplane hanger is not an allowed us in the Industrial-2(I-2)District.
• The submitted site plan indicates the proposed structure being constructed on the Iease line. I am of the opinion that
the building setback lines will be required fi•om the lease line and a variance is required by the ZBA,

Dear Mr. Simons:
We have prepared a site plan for a proposed hangar for Falcon Air Inc. This
hangar will be built adjacent to their current Falcon Air hangar.
Under the provisions of section 8.3.2.c of the North Andover Zoning By-Law,
we are requesting The Planning Board waive the requirement for a site plan
review. It is our opinion that we meet the criteria for waiving of the site plan
review.
Impact within the site and in relation to adiacent_properties and streets.
• The proposed hangar will be a metal building consistent with other
hangars at the airport. It will be blue to match the existing Falcon hangar.
• The site of the proposed hangar is currently paved, therefore, there will be
no increase in the rate or volume of runoff.
• The proposed hangar will not be visible from adjacent streets or
residences,
Impact on pedestrian and vehicular traffic:
• The proposed hangar will not generate any new vehicular or
pedestrian traffic.

Impact on public services and infrastructure.
• The proposed hangar will not be connected to any existing town
systems (sewer, water or drainage).
• The proposed hangar will house aircraft currently parked on the
pavement at the site. There will be no increase in the use of the site
and, therefore, no increase in traffic or trip-ends.
Impact on environment and unique and historic resources.
• No wetlands exist within 200 ft. of proposed construction.
• The site is not in the watershed protection district.
• There are no unique or historic recourses at this location.
Impact on abutting properties._
• The closest property line is approximately 400' from the proposed
hangar where the adjacent us is commercial.
• The nearest residence is approximately 1300' from the proposed
hangar on the opposite side of Sutton Street.
Impact on community needs:
• The proposed hangar is consistent with the uses at the airport and will
not hinder or obstruct other community needs.

This hangar has been reviewed by the Federal Aviation Administration. A
copy of their Aeronautical Study is attached.
The Lawrence Airport Commission has voted to allow Falcon Air, Inc. to
proceed with obtaining a building permit.
In summary, this is a very simple project, the construction of a storage
building on an area that is currently paved.
It is my understanding that this project will be on the agenda of the Planning
Board meeting on January 22, 2002. 1 will attend that meeting to answer any
questions you might have.
