Box 995, 492 Sutton St., North Andover, MA 01845, This application was filed with tite Planning Board on August 5, 2005. The applicant submitted a complete application which was noticed and reviewed in accordance with Sections 8.3, 10.3, and 10.31 of the Town of North Andover Zoning Bylaw and MGL c.40A, sec. 9. A Public hearing was held on September 6,2005, The Planning Board makes the following f lldings as required by the North Andover Zoning Bylaws Section 8.3 and 10.3; FINDINGS OF FACT: I. The specific site is an appropriate location for the structures, as they will be constructed adjacent to existing hangar buildings located on the property of an airport facility. The North Andover Zoning Board of Appeals granted a Special Permit on May 28, 2004 to allow the use. 2. The use as developed will not adversely affect the neighborhood, as the hangars will not be visible from adjacent streets or residents. 3, There will be no nuisance or serious hazard to vehicles or pedestrians. The hangars will not generate any new vehicular or pedestrian traffic and be restricted to the storage of planes only. 4. The project will result in no change in existing iinpeirviotis surface area on site. Thus, there will be no increase in the change or rate of volume of runoff from the site. 5. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8.3 of the Zoning Bylaw, Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.35 but requires conditions in order to be ftilly in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are inet: SPECIAL CONDITIONS: 1) Prior to the endorsement of the plans by the Planning Board,the applicant must comply with the following conditions: a. A bond in the amount of two-thousand ($2;000.00) dollars in the form of a check must be posted for the purpose of insuring that a final as-built plan showing the location of all on-site utilities, structures, Curb cuts, parking spaces, topography, and drainage facilities is submitted. 'File bond is also in place to insure that the site is constructed in accordance with the approved plan. The Iiirm of security must be acceptable to the Planning Board. A construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. b. During construction, the site must be kept clean and swept regularly. 3) Prior to Building Permit Issuance: a. The Planning Board must endorse the final site plan mylars and three (3) copies of the signed plans must be delivered to the Planning Department. b. One certified copy of the recorded decision must be submitted to the Planning Department. c. All permits necessary from the FAA must be, obtained and copies of the approvals must be submitted to the Planning Department. 4) Prior to issuance of the Certificate of Occupancy: a. The applicant must submit a letter from the archihzt and engineer of the project stating that the building, signs, landscaping, lighting and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. b. The aircraft hangars must comply with applicable state fine and building codes. 5) Prior to the final release of security: a. The Planning Staff shall review the site. Any screening as may be reasonably required by the Planning Staff will be added at the applicant's expense. b. A final as-built plan showing final topography, the location of all on- site utilities, structures, curb cuts, parking spaces and drainage facilities must be submitted to and reviewed by the Planning Staff and the Division of Public Works. 6) Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times to minimize any dust problems that may occur with adjacent properties. Any stockpiles to remain for longer than one week must be fenced off and covered. 7) The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 8) Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies, 9) No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 10) No underground fuel storage shall be installed except as may be allowed by Town Regulations. Page 2 of 4 Site Plan Review-Special Permit Map 76,Lot 3 492 Sutton Street—Construction of Two Hangers i 3 11) The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and,assigns in interest or control. 12) Any action by a TmNm Board, Commission, or Department, which requires changes in the plan or design of the building, as presented to the Planning Board, may be subject to modification by the Planning Board, 13) Any revisions shall be submitted to the To,,Am Planner for review. If these revisions are deemed substantial, the applicant must submit revised plans to the Planning Board for approval. 14) The Site Plan Special Permit is contingent upon the approval of the Conservation Commission. The applicant shall submit copies all decisions rendered to the Planning Department by the Conservation Commission related to this project. 1 S) This Special Permit approval shall be deemed to have lapsed September 20, 2007 (two years from the-date permit granted) exclusive of the time required to pursue or await determination of any appeals, unless substantial use or construction has commenced within said two-year period. Substantial use or construction will be determined by a majority vote of the Planning Board, 16) The hangars shall be used for the storage of airplanes and for no other purpose. There will be no storage of items, which shall be in violation of any order or requirement imposed by the Board of Health, Fire Department, and Police Department or other appropriate governmental body or do any act or cause to do any act, which creates a nuisance or presents a danger to the safety and health of any person. 17) No repairs, maintenance or work of any type shall be done or caused to be done in or about the structures. 18) The hangars shall not be used for residential purposes or for any other unlawful purpose. Items which are volatile, flammable or explosive, or which are hazardous, which burn with extreme rapidity, or which when burning or subjected to heat produces toxic fumes or gases in quantities and under conditions dangerous to safety or health of any person, may not be stored, used or kept in or about the structures. These items include, but are not limited to the following: a. Combustible Dust — Fine particles or matter stable to spontaneous ignition or explosion or constituting a dust hazard such as lint, shavings, sawdust, flour, starch,sulphur,metal powders and powdered plastics. b. Explosive Gases — Acetylene, ether, ethyl chloride, ethylene, petroleum gases, methyl chloride gas,oxygen, c. Flammable and Combustible Solids -w- Pyroxylin products, nitrocellulose, asphalt, coal tar, pitch, waste paper and rags, straw,hemp, kapok,oil,grease and fats. d. Flammable Liquids — Ether, carbon, bisulfide, acetone, alcohol, kerosene, turpentine,and flammable paint and varnish. e. Poisonous, Corrosive or Fume Hazard Substance — hydrochloric, nitric, sulphuric, hydrofluoric, and other corrosive acids; corrosive, toxic, or noxious cynanides, ammonia, chlorine, sulphur dioxide, and similar substances providing like hazards.
