Dear Ms. Griffin,
It has been recently brought to my attention that the Zoning By Laws of the Town of
North Andover do not address the issue of onsite parking relative the development of airplane
hangars at the airport.
The Zoning Board of Appeals must make a determination to parking requirements. To
that end LWM Development will be submitting an application to the Zoning Board of Appeals.
I would respectively request that the LWM petition pending before the Planning Board be
continued.

The applicant proposes four aircraft hangars, each one story and made of steel construction. The
application indicates each hangar will be under 7,500 square feet.
Below please find my review of the project:
i) NORTH ARROW/LOCATION MAP: A north arrow and a location map
showing surrounding roadways and land uses adjacent to the site(I"=I500').
Location Map should show at least one intersection of two existing Town
roadways. The provided location map does not adequately depict exactly
where on the airport site the proposed hangars will he. Specifically, it does
not readily identify any object close by that would help us locate the airport.
SURVEY OF LOT/PARCEL: A boundary survey conforming to the
requirements of the Essex County Registry of Deeds Office. The survey
shall be dated and include any revision made to the survey or site plan. Any
change in the survey shall be recorded before site plan approval may be
granted. The applicant has requested a waiver of the boundary survey due
to the size of the airport in its entirety.
iii) NAMEIDESCRIPTION OF PROJECT: The name of the development and
the names, addresses and telephone numbers of the project listing tenants,
land uses, development phases, or other pertinent information necessary to
evaluate the proposed development plan. This has been provided
iv) EASEMENTS/LEGAL CONDITIONS: Identification of easement(s) or
legal encumbrances(s)that are related to the sites physical development, and
a listing of any condition(s) placed upon the site by the Board of Appeals,
Planning Board, Conservation Commission, or any public body or agency,
with the authority to place conditions on the sites development. There are
no easements needed for this project. However, the applicant has placed
the lease line on the plans.
v) TOPOGRAPHY: The present and proposed topography of the site, utilizing
two foot (2) contour intervals. The contours shall extend at least fifty (50)
feet beyond the site boundaries by estimation of the professional submitting
the plan. The topography has been provided.
vi) ZONING INFORMATION: All applicable Zoning Bylaw information shall
be provided regarding the site's development. This information shall be
placed in a table and list all parking, setbacks, percent of lot coverage,
floor-area-ratio, number of dwelling units, total amount of square feet, size
of signs and any other applicable zoning information necessary for the
proper review of the site plan by the Town Planner and Planning Board, A
zoning table has not been provided and needs to be depicted on the plans.
vii) STORMWATER DRAINAGE: All storm water drainage control facilities
utilized by the site shall be shown on the site plan. Storm water drainage
calculations which support the design of the control facilities shown the plan
shall be submitted to the Department of Public Works for review and
approval. Calculations shall show a mitigation of run-off to zero of the 2,
10,and 100 year storm event.
•viii) BUILDING LOCATION: Identification of all existing and proposed
structure(s) located on the site. The number of stories, overall height in feet
and gross floor area in square feet of all structure shall be indicated. The
location of the proposed structure is identifiable on the plans, However, the
proposed stories, overall height in feet and gross floor area in square feet
are not and need to be.
ix) BUILDING ELEVATION: A drawing of the exterior of the building, as
viewed from the front (street view) must be submitted. The Planning Board
may request side and rear views if relevant to the Board's review, This
drawing must be at least 8" x 1��1,�" in size. The Building Elevations have
been provide, however they are;�'tamped by a certified architect registered in
the Commonwealth ofMassachusetts pursuant to Section 8.3.5(c)

x) LOCATION OF PARKINGIWALKWAYS: Identification of the location of
all existing and proposed parking and walkways areas, including curb cuts
that will be used to access the site from adjacent roadways, or access points.
A proposed gravel drive approximately 12' wide is indicated on the plan,
There is no parking, proposed or existing depicted on the plans and there
will obviously need to be some parking on the site plan..
xi) LOCATION OF WETLANDS/NOTICE OF INTENT: All resource areas as
defined in M.G.L. Chapter 131, Section 40 and the Town's Wetland Bylaw,
shall be shown on the site plan. The applicant shall file a Notice of Intent
with NACC concurrently with the application to the Planning Board for Site
Plan.Review. The applicant is not required to file a Notice of Intent with
this application.
xii) LOCATION OF WALLS/SIGNS: Identification of the location, height and
materials to be used for all retaining walls and signs located on the site.
Signs will be reviewed using the guidelines set forth in Section 63 (H) of the
Zoning Bylaw. It does not appear the applicant is proposing any additional
signage and/or retaining walls.
xiii) LOCATION OF ROADWAYS/DRIVES: Identification of all right-of-ways
and driveways including the type of curb and gutter to be used, and their
dimensions. Distances to all the nearest roadways and/or curb cuts shall be
shown for both sides of any streets which is adjacent to the site. The plan
conforms to this requirement.
xiv) OUTDOOR STORAGEMISPLAY AREAS: Identification of the location
and type of outdoor storage and display areas on the site. The applicant is
not planning on proposing any type of outdoor storage or display areas
xv) LANDSCAPING PLAN: Identification` of the location and landscape
schedule of all perimeter and interior landscaping, including but not limited
to proposed paving materials for walkways, fences, stonewalls and all
planting materials to be placed on the site. In addition, all existing trees over
12 inches DBH, to be saved or removed shall be shown on the site plan.
Any landscaping required by the Town Bylaws shall be indicated on the site
plan in tabular form showing the amount required and the amount provided.
A landscaping plan has not been provided, although the application
indicates they will be seeding the perimeter of the project and that no other
landscaping is proposed. This is woefully incomplete with Section 8.4 of
the landscaping requirements for industrial districts of the zoning bylaw.

xvi) REFUSE AREAS: Identification of the location of each outdoor refuse
storage area, including the method of storage and screening. All refuse areas
must be fully enclosed. No refuse areas are proposed.
xvii) LIGHTING FACILITIES: Identification of the proposed illumination,
indicating the direction and the degree of illumination offered by the
proposed lighting facilities, including an example of the light fixture to be
used. The proposed plan does not ident fy any lighting facilities, however,
they have provided separate literature relative to the lighting they plan on
proposing.
xviii) DRAINAGE BASIN STUDY: A detailed hydrology study for the site.
Included in this study is the proposed storm water run-off rates into the
existing drainage system and its potential down-stream impact on the
existing drainage system. I have no report on this issue as the applicant just
submitted drainage calculations to the outside engineer's this past Friday.
xix) TRAFFIC IMPACT STUDY: Identification of existing traffic levels, along
with the expected traffic impacts to occur based upon the proposed project.
Projects which access state highways, a traffic impact study shall be filed
with MEPA concurrently with the Planning Board review. A copy of the
MEPA study shall be filed with the application to the Planning Board. A
traffic study has not been provided nor is one required at this time.
xx) COMMONWEALTH REVIEW: Any information required and submitted to
any agency of the Commonwealth, shall be filed with the Planning Board
upon the initial submission of the project for Board review. I have not
received copies of any information required and submitted to the
Commonwealth.
xxi) UTILITIES: All utilities, including water line locations, sewer line locations
and profiles, and storm drainage systems; Some utilities are located on the
plans
xxii) FISCAL IMPACT: Projections of costs rising from increased demand for
public services and infrastructure; provisions of benefits from increased tax
revenues, employment and infrastructure improvements; and impacts on
adjacent property values. I have not received a fiscal impact study nor do I
think one is necessary for this project.

xxiii) CONEWMTY IMPACT; Analysis df the project's impact on the
surrounding neighborhood in terms of architectural consistency, pedestrian
movement and overall character; impacts on nearby historic structures or
site; and an evaluation of the proposed project's consistency and
compatibility with existing local and regional plans. I don't believe a
community impact study is necessary,for this project.

Thank you for the recent release of our bond. PBJ Development Corporation had,
however, posted 2 bonds. The first bond was pasted in 199S in the amount of $5,000.00.
The second bond was posted at a later date and was in the amount of$3,000.00. The check
which you sent me was for the second bond. It would be appreciated if you would also send
me a check for the first bond.

Dear Ms Griffin:
As you may know, the Lawrence Municipal Airport Commission requested that LWM
Development, LLC make changes to the site plan, which was approved by the North Andover Planning
Board on June 27, 2000. These changes were the result of FAA requirements and safety concerns.
refer you to the site plan and make the following notations:
It was determined by the FAA that the area between taxiway E and hangars 1 and 2 required
public use—an object-free area. Further, the distance between the buildings has been changed
to 60 feet, a decrease of 27 feet.
The setback distance on the left and right side of the hangar access ramp has been decreased to
42.5 feet, a decrease of 13.5 feet, The total area has been modified from 119,665.50 square feet
to 99,225.00 square feet. This represents a total reduction of 20,440.50 square feet thereby
eliminating the paved taxi area.
For safety reasons, the parking area has been relocated and is now situated as far away as
possible from the aircraft operating areas. Although the number of parking spaces has not been
changed from the original approved site plan, outside vehicles are now required to park in the
designated approved area only.
The changes made to the site plan have all been positive in nature. At this juncture, I look to you
for direction so that LWM Development may obtain the necessary approvals from the Town of North
Andover to proceed forward with the project.
Please note that Robert Nicetta has received a copy of the site plan and has been made aware of
the aforementioned changes. If you have any questions or need any additional information, please feel

Dear Mr. Arcidi:
I am in receipt of your letter dated January 9, 2001 requesting to revise your site plan,
which was approved by the North Andover Planning Board on May 18, 2000.
Your original site plan depicted a"proposed gravel drive"with parking spaces that are
not depicted on your revised plan. These changes need to be implemented on the
revised plan in order for the plans to be complete.
Furthermore, I will require confirmation from the Building Commissioner that your plan
depicts"a change of location and layout of any parking area(s), signs, storage or
accessory buildings, provided that no Town Bylaws are„violated by the change".
When you receive a determination from the Building Commissioner relative to your plan
complying with this provision, please copy me so I can advise you as to whether or not I
can approve the plan or whether the revisions violate this section of the Zoning Bylaw.
If your revised plan violates this section, you will be required to resubmit the site plan to
the Planning Board. Also, this letter does not exclude you from re-submitting any plans
or permits you may have to obtain from the Zoning Board of Appeals, as that will also be
determined by the Building Commissioner.

I am in receipt of your letter dated January 12, 2001 whereby you have indicated certain
necessary changes to our site plans in order for the plans to be deemed complete. I attach a
copy of the revised plans hereto which depict a "proposed gravel drive" as requested.
I understand that you also require confirmation from the Building Commissioner that the
plan changes concerning parking, signs, storage and accessory buildings will not violate Town
Bylaws. You should realize that I'am working on obtaining said confirmation from Mr. Nicetta
and will advise accordingly.
I continue to stand ready for your direction so that LWM Development may continue
forward in this process and obtain the necessary approvals for the project. If you have any

Dear Senator Jajuga:
Just a short note on the referenced site,than you for calling on the a of the month to inform me,that in
fact,a helicopter would be based at the LWM Development facility. As I stated in our conversation,the
"HelistW'was allowed by a Zoning Board of Appeals Special Plermit in the Industrial--1 and Industrial-2
Districts only. By action of the 1991 Annual Town Meeting(ATM)`NeiistW'use was deleted from the
North Andover Zoning By-law in those districts.
Statues may exist for the Massachusetts Law Enforcement Agencies to preclude the above. N that were
the case then please supply copies of the statue for reference,to this office, Please do not misinterpret this
request to mean that the developer may not have to return to both the zoning board of appeals and the
planning board for modification of prior decisions due to change in plates.
Your reply,as to existing statues,is necessary. Thank you,once again,for your interest. If you require

Accordingly, I hereby request a determination from you as Building Commissioner that
my plan dated January 23, 2001 does not have material changes that would be in violation of
any Town Bylaws. For your reference, I have also attached a copy of my January 91"letter to
Ms Griffin which details the changes we were required to make pursuant to FAA rules and at the
request of the LWM Airport Commission.

Thank you for your fax of today's date: whereby you have provided me with a copy of
your(rater to Senator Jajuga. With all due respect, I am unclear as to why our request for your
written determination, as it relates to the Site Plan, is being delayed by"what-ifs" involving a
Helistop. Likewise, it is our opinion that Senator's Jajuga's reply concerning any statutes is not
directly related to our request nor do we believe your determination should be delayed based on
tho foregoing. As the Developer of this project, I believe we are the best source to discuss use
and rernain available to your or the Town to discuss same,
As you know from my January 20 letter, it remains our Intent to comply with the
Planning Board's Notice of Decision and clearly, the type of use you are Inquiring about is not in
accordance with said Decision, We are not looking for any modification in the Decision as you
suggest in your letter to Senator Jajuga and accordingly, I again request your written
determination that our Site Plant does not have any material changes that would be in violation

At this time LWM Development is submitting a revision request to a
previously approved Site Plan/Special Permit dated 1/18/00. The Planning
Board approved the Site Plan/Special Permit for the construction of four airplane
hangars located in the Industrial 2 Zoning district at Lawrence Municipal Airport.
LWM Development is requesting changing hangar#1 physical size only.
The approved hangar#1 dimensions is 51' x 140' which include 5 nested sub
unit hangars and four adjacent parking spots. The proposed revision will have a
dimension of 60' x 123' which will include four nested sub unit hangars and no
change in the parking spot allocation. Other than the size change the proposed
revised building will meet all prior requirements of the prior approved Site
Plan/Special Permit dated 1/18/00. 1 have enclosed a Notice of Decision for the

I inspected the site last Tuesday with representatives of the Channel Building Company and Attorney Dom
Scalise. At that time I wrote in site visit log that the trees were planted in accordance with the approved
plans in the approved locations. There were two erosion areas where I asked that they place stone and one
berm on the west side of the site that needed to be fixed, as it was washed out by the heavy rains. After
receiving your email, I reviewed the plans again and questioned whether or not the trees planted were in
accordance with the sizes required by the approved plans. I had a meeting with Attorney Scalise this
afternoon on another matter, after which we went back out to the Northeast Storage site.

Condition 4e of the site pl 4ecial permit states that The landscaping must be planted as shown on Sheet
three of the approved and endorsed plans. Sheet 3 depicts 4ft Cypress and White Pines along the front of
the buildings on the north side of the drainage Swale. It-also shows two 4-6ft Norway Maples and one 8-
10ft White Pine. At 3:30 this afternoon, Attorney Scalise and I measured the trees and they all met the
minimum heights specified on Sheet 3 of the approved plans. Additionally, the grass is taking well and the
site has stabilized. This decision does not have a condition that some others have granting the Planner
authority to require additional screening. I did suggest to Attorney Scalise that his client add some
additional evergreens along the south side of the drainage swale along both the three links of fencing on the
east side and the four links of fencing on the west side on either side of the entrance. This is the area that
seems most in need of additional screening. Heidi suggested mentioning to them that you granted them an
extension of the special permit.

111 1997, porous pavement is an economically and environmentally sound paving alternative which
should be seriously addressed before paving or repaving any Larking lot. Unfortunately, engineers
and planners have heard more about pool- examples of porous paving than about good ones. Thus
they often recommend against its use for wrong reasons.
One good porous pavement installation was installed by the Commonwealth of Massachusetts at
Walden Pond as a demonstration project in 1977. Twenty years later, a long tinie for one Laving
job on that busy parking lot, it still looks good and works well. And, as many of the doubting
engineers will confirm,Walden Pond is in a ivorst climate condition for this material. Obviously, a
warmer climate would create less freezing of rainwater(freezing expands water into ice, the
mechanism which breaks down pavement). But a colder climate wouldn't be as severe either,
because the snow and ice would be less likely to remelt and then refreeze. Eastern Massachusetts
Ions more freeze-thaw cycling during a winter than most other parts of tlee world. But this porous
pavement does work in eastern Massachusetts, and it will work in most climates worldwide.
The good porous pavement installation at Walden Pond in 1977 did not happen by accident. It was
a special Technology Transfer demonstration project. It followed best-practice methodology
generated by a 1972 U.S. Environmental Protection Agency project, it benefitted from an unusual
amount of professional engineering supervision and analysis, and it generated technical
documentation. It also generated a public information sign at the entrance to the Walden Pond
parking areas, and finally in 1989 it generated a matching, public-education brochure. The

Conventional Pavement Causes Problems
Our nation has come a long way since early cobblestone streets kept our feet out of the mud.
However,we have been too successful. Not only have we managed to keep our feet dry,we have
succeeded in keeping the rain water from the soil. Modern conventional paving materials are
impervious to the passage of water. And although it is not apparent, this causes Soule serious
problems.
The most obvious problem with conventional pavement is runoff. If rainwater cannot soak into the
ground where it falls, it will run downhill. On a small scale we can see this at home when water
runs off the driveway onto the lawn, maybe Ieaving a small eroded area. Multiply this effect over
the expanse of a shopping center or an entire metropolitan area and you begin to understand the
size of the problem. As water collects downstream, along with everything from soil and fertilizer
to cigarette butts and oil spills, it causes flash flooding and wash-down of debris and pollutants.
How is this runoff handled`: Usually storm.drains are built into paved areas to channel runoff to
some downstream location, such as your favorite river or pond. In New England cities, combined
storm and sanitary sewers are unfortunately common. Because most sewage treatment plants have
inadequate capacity to treat all the water fed into them by „combined sewers" during storms, the
combined runoff and sewage must overflow through bypasses and relief valves to the region's
rivers, ponds, and harbors. This contaminant- and nutrient-loaded water makes our surface
waters unhealthy and accelerates their euh,oplucation (a nutrient enrichment process which grows
green "pea-soup" algae and aquatic weeds). Remember that we must pay not only for the
construction of these storm drains but, where combined sewers exist, also for the cost of greatly
increased treatment-plant capacity to clean the huge volumes of combined sewage and stormwater
which arc produced during storms.
Another consideration is the replenishment of out,grounrlrvater sources. Groundwater provides
much of the drinking water in New England, keeps our trees and plants healthy, and helps to
maintain the flow into our rivers and ponds. Water recharged from land surfaces is naturally
stored in the ground and gradually released to streams. This groundwater discharge sustains base
streamflow between rain storms and is the critical element controlling natural low streamflows
during the growing season. As we have paved over more and more land,we have bypassed the
natural process which lets rainwater soak into the ground where it falls. This prevents our

We Americans now use more water than we really need, and are beginning to recognize the limits
of our water resources. Although New England's annual rainfall is about 40 inches, which
translates to over one million gallons per acre, we in eastern Massachusetts still have water
shortage and pollution problems. When we retain rainwater in the local hydrologic cycle instead
of letting it go "down the drain", we can reduce the need for large, expensive water diversion
projects, sewers and sewage treatment plants.
Porous pavement can reduce some of these negative effects of our urban lifestyle.

What Is Porous Pavement?
The form of porous pavement used in the Walden Pond demonstration looks and acts like
conventional asphalt pavement, but it is permeable - it Allows water to leak through. It is made and
applied with conventional Asphalt paving equipment. Only tine recipe is changed: conventional
Asphalt pavement is a mixture of large and small stone particles bonded together with asphalt tar;
for pon•orls paverlreut, file snmller particles are left out and the percentage of tar is reduced. This
provides bonding while leaving spaces through which the water may pass.
Inn laboratory tests, porous pavement was able to pass "rainfalls" over 60 inches per hour, more
than sixty tines greater than our typical "downpour". Of course the Ability to handle writer in
real applications relies on the ability of the underlying soils to absorb the water. For engineers,
this translates to how much additional water-holding sub-base, if any, must be provided under the
pavement to store the water until it can souk in.
Since the early 1970's, porous pavement parking lots have been installed successfully in other
states (Delaware, Pennsylvania and Texas)with encouraging results for road use and local water
retentiorn.,irn England, it was laid over a conventional Airport runway surface; this combination
improved landing safety and withstood the Abuse of commercial Aircraft landings.
The Walden Pond demonstration project uses suitable combinations of pavement thickness and
sub-base depth for the soils and weather of out-New England environment. This installation
proves that properly used and installed porous pavement withstands the ettretrte freez0hary cycling
of New Englanrl:vinters. After more than tell years, no potholes were observed.
For home driveways, loose gravel acts like porous pavement. So will a gnat of concrete slabs cast
into open patterns, with soil and grass filling the holes - a durable driveway which you can mow!
Is Porous Pavement Appropriate For All Applications?
Certainly not all, but it fits many situations. The Walden Pond project has established cost
information and design criteria for parking lot uses in the New England area
Where underlying soils Are sufficiently permeable, it should be Appropriate for all but very snail
applications,where "special mix" costs cannot be absorbed. Other installations may require
nensive. sub-base preparations, yet still be cost effective. Inn some soils (extensive clay and rock
ips), porous pavement will not be advantageous. Finally, as with septic system installations,
Ni lnrust be given to potential harm through ground water pollution (from dripped oil, road
Itiowever, since the usual Alternative is to run vehicle pollutants directly into water
arm drains, the filtration, buffering, and bacterial breakdown processes ill tine soil

Highway Maintenance
Although initial installations have been confined to parking lot surfaces, use of porous pavement
for street and highway surfaces is a future area for investigation which may offer great savings
due to the elimination of expensive storm drain systems.
During our long, cold New England winters, we put salt oil the highways to improve driving
conditions. Its melting action softens the ice for the snowplow and prevents new ice from forming.
But the salt is harmful to our vegetation and drinking water, and it rusts our cars and corrodes
concrete bridge decks. When ice is sanded instead of salted, a thaw and refreeze could leave the
sand useless tinder the ice. Porous pavement reduces this problem; ice thawing on the road drains
through into the ground, providing a safe road while reducing or eliminating the need for salting.
This greatly reduces the cost of winter highway maintenance. Porous pavement will reduce or
eliminate spring potholes,which are caused by the freezing and expansion of water trapped within
road cracks. Under laboratory conditions and at Walden Pond, repeated freeze/thaw testing oil
porous pavement has shown no ill effects. Lane markings are less apt to disappear in headlight
glare oil porous pavement highways, because water doesn't puddle on the road and because the
rougher surface is more visible to the motorist at oblique angles. The pavement even can be
colored, for better traffic flow control and aesthetic appeal.
Ecological Benefits
Restoration of soil moisture is important to support the trees and plants which give us shade,
beauty, and oxygen to breathe. Conventional pavement diverts rain away from large areas; then,
the large expenses of dry soil udder the parking lots and highways "sponge" writer away from the
still-fertile adjacent soils, making it more difficult for our plants to survive.

Is Porous Pavement Expensive?
No, because it is made from the usual paving materials by the existing equipment; and, tlhe
benefits could make it a real bargain. Considering only installation costs, porous pavement is
expected to cost no more than conventional pavement on low-traffic applications such as parking
lots (although a premitlnt of up to 20% might be charged for the first few "special" installations).
For large highways oil sufficiently permeable subsoils, porous pavement, if applicable, should be
less expensive than conventional surfaces since it can greatly reduce the need for storin drains.
Curbing and gutters would be needed only where safety is a consideration, or to prevent silty
areas from washing onto the pavement and clogging its pores.
pus pavement also promises many secondary benefits: its use can benefit local waiter supplies

At this time LWM Development Company is submitting a request to
previously approved modification dated 11/19/2002. The Planning Director
"Kathy McKenna" approved the modification for the change in the hangars
physical size located in the Industrial 2 Zoning District at Lawrence Municipal
Airport,
LWM Development Company is requesting to add a private water supply
well, three bathroom facilities to hangar#1, two bathroom facilities to hangar #3
and a sewage disposal system as depicted on the plan dated 7/8/2004. Other
than the addition of the water supply well, bathrooms and sewage system the
requested modification will meet all requirements of the prior approved site
plan/special permit dated 1/18/2000 and approved modification dated
11/19/2002. Also included is proposed revised site plan by Bradford Engineering
