Andover, MA 01845 Re: Site Plan Review/Lawrence Airport Hangers Dear Ms . Bradshaw, The North Andover Planning Board held a public hearing on Tuesday evening, August 20, 1996 at 7 : 30 p.m. in the Senior Center behind the Town Building, upon the application of Kingsberry Building Technologies, Inc. , 10 Winship Drive, Wakefield, MA requesting a special permit under Section 8 . 3 (Site Plan Review) of the North Andover Zoning Bylaw. The legal notice was properly advertised in the North Andover Citizen on July 31 and August 7, 1996 and all parties of interest were duly notified. The following members were present : Joseph V. Mahoney, Chairman, Alison Lescarbeau, Clerk, Alberto Angles, Associate Member, Richard Nardella and John Simons . The petitioner was requesting a special permit to construct four, 16' 7" 25, 800 sq ft steel aircraft hangars located on Sutton Street in Zoning District Industrial - 2 (1-2) . Ms . Lescarbeau read the legal notice to open the public hearing. Steve Stapinski was representing the applicant and he stated that the proposed plan calls for four new hangers to be built on the Sutton Street side of the airport across from the Knights of Columbus . One hanger will be 4800 sq ft and the other three will be 7000 sq ft. The intent is to build the structures of the same quality and style as in the past . The area will be serviced with water and sewer from Sutton Street . Wall pack lighting will be mounted on the building and heat and smoke detectors will be installed. There will be no dumpster present. There will be 15' between the buildings and the fence for fire trucks in case of an emergency. Mr. Nardella asked what the height of the structures will be and was told 17' 8" . The hangers will be made of insulated steel and no repairs to the aircraft will be done inside the hangers . Mr. Stapinski replied that all drainage is channeled into the street drainage system. Ms . Colwell stated that she is waiting for comments from John Chessia and should have them for the next meeting. Mr. Nardella and Ms . Lescarbeau would like to see more landscaping done on the Sutton Street side of the airport. Ms . Colwell stated that the parking requirements must be reviewed by the building inspector as no parking spaces are currently shown. Joe Martin, an abutter who lives across the street, was present and stated that 2 years ago he came to a public hearing for other hangers and was told there would be no noise . Mr. Martin stated there is so much noise that he cannot keep tenants . Also, the proposed hangers are not really across from the Knights of Columbus, they are across from his property! Mr. Martin was told by the applicant that the noise isn' t coming from his hangers, but from the commercial area and if Mr. Martin would call the Airport Commission they will put a stop to it . Mr. Martin further stated that the last time Sutton Street was dug up it was never repaired properly. Mr. Mahoney suggested the Board members take a site walk on their own and the discussion was continued until September 3, 1996. The North Andover Planning Board held a regular meeting on September 3, 1996 . The following members were present : Joseph V. Mahoney, Chairman, Richard Rowen, Vice Chairman, Alison Lescarbeau, Clerk and John Simons . Continuation of the public hearing. Ms . Colwell stated that the drainage information was just submitted on Thursday. A detention pond and planting berm have been added to the plan. The abutters issue of the noise has been addressed by the airport, the hold/run-up area for Eagle East will be moved away from Sutton Street, thereby eliminating/reducing the noise. Steve Stapinski was present and stated that the buffering and planting will be taken care of with a planting berm 6' high. There will be white pines on the berm, therefore, the effect will be 12' high trees . Ms . Colwell stated that parking was still an issue . Mr. Stapinski replied that people use the hangers for parking once the planes are out of them. He asked the Board if they want to grant a waiver for a paved area for parking, o otherwise parking will be in the hangers . Mr. Mahoney pointed out that he is quite frequently at the airport and there is ample parking near the tower. The Board agreed that there was sufficient parking available on the site . Ms . Lescarbeau asked how many planes will be housed in the hangers and was told 14 2 0 t • 1 planes . Mr. Simons stated that since there are 300 acres at the airport, why did you have to pick this location for the hangers? Mr. Stapinski replied that is the only area with services : water, sewer, available master box for a fire alarm, and the airport wants to see this area developed. Mr. Rowen asked how high the hangers are and was told 17 feet. Ms . Lescarbeau wants to see the planting enhanced for the next meeting. Continued until September 17, 1996. The North Andover Planning Board held a regular meeting on September 17, 1996 . The following members were present : Joseph V. Mahoney, Chairman, Richard Rowen, Vice Chairman, Alberto Angles, Associate Member, Richard Nardella and John Simons . Continuation of the public hearing. Ms . Colwell stated that she asked Mr. Stapinski to redesign the drainage because as it stands now, the water will ultimately drain into the lake . Mr. Stapinski stated that the majority of the site slopes down to the Merrimack River therefore no drainage will enter the lake. There is a swale behind Four Star Aviation and Mr. Stapinski stated he will raise the elevation about one foot. Sewer and water to remain the same. On a motion by Mr. Rowen, seconded by Mr. Nardella, the Board voted unanimously to close the public hearing. Ms . Colwell to review the drainage and have a draft decision ready for the next meeting. The North Andover Planning Board held a regular meeting on October 1, 1996. The following members were present : Joseph V. Mahoney, Chairman, Richard Rowen, Vice Chairman, Alison Lescarbeau, Clerk, Albert Angles, Associate Member, Richard Nardella and John Simons . Steve Stapinski was present with revised drainage plans which the Board reviewed. The question was asked where is the nearest fire protection, and Mr. Stapinski replied there is a fire hydrant very close by. On a motion by Mr. Nardella, seconded by Ms . Lescarbeau, the Board voted unanimously to approve the draft decision as amended to state that the bond money should be $5, 000 . Attached are the conditions . S* ncerely, �`-• oseph V. Mahoney, Chairman North Andover Planning Board 3 492 Sutton Street(Lawrence Municipal Airport) Site Plan Review-Special Permit The Planning Board herein approves the Special Permit/Site Plan Review for the construction of three 7,000 S.F, and one 4,800 S.F. steel hangers located in the Industrial-2 Zoning District. This Special Permit was requested by Kingsberry Building Technologies Inc., 10 Winship Drive, Wakefield, MA. On behalf of the Lawrence Municipal Airport Commission, 492 Sutton Street, North Andover, MA 01845. This application was filed with the Planning Office on July 29, 1996. The Planning Board makes the following findings as required by the Zoning Bylaw Section 8.3 and 10.3; FINDINGS OF FACT: 1. The specific site is an appropriate location for the project as it is located on land developed as an airport. 2. The use, as developed, will not adversely affect the neighborhood as the as sufficient buffer zones have been created to shield the use from adjacent residential properties. 3. There will be no nuisance or serious hazard to vehicles or pedestrians; 4. The landscaping plan approved as a part of this plan meets the requirements of Section 8.4 of the Zoning Bylaw with review by the Planning Board; 5. The site drainage system is designed in accordance with the Town Bylaw requirements subject to the conditions of this decision; 6. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8.3 of the Zoning Bylaw; 7. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.35 but requires conditions in order to be fully in compliance, The Planning Board hereby grants an approval to the applicant provided the following conditions are met; SPECIAL CONDITIONS: 1. Prior.to any work on site, the applicant shall adhere to the following: The final drainage plan must be reviewed and approved by the drainage consultant,DPW and the Town Planner. The applicant must submit the mylars to the Planning Board for endorsement. mac) A final set of site plans must be submitted to the Town Planner for review within ninety days of filing the decision with the Town Clerk.. A bond in the amount of five thousand ($5,000) dollars shall be posted for the purpose of insuring that a final as-built plan showing the location of all on-site utilities, structures, curb cuts, parking spaces and drainage facilities is submitted. The bond is also in place to insure that the site is constructed in accordance with the approved plan. This bond shall be in the form of a check made out to the Town of North Andover, This check will then be deposited into an interest bearing escrow account. e) A construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. 2. Pri rA0 FORM U verification (Building Permit Issuance): The final site plan mylars must be endorsed and three (3) copies of the signed plans must be delivered to the Planning Department. This decision shall be recorded at the Essex North Registry of Deeds and a certified copy delivered to the Planning Staff. c : The applicant shall provide a copy of the lease agreement between.Kingsberry Building Technologies Inc. and the Lawrence Municipal Airport Commission for the Planning Board files. 3. Prior to verification of the Certificate of Occupancy: a) The applicant must a submit a letter from the architect or engineer of the project stating that the building has been constructed in conformance with the following plans as submitted to the Planning Board for review: Plan titled: Elevations&Plan Prepared by: Kinsber y Building Technologies, Inc. All lighting shall have underground wiring and shall be so arranged that all direct rays from such lighting falls entirely within the site and shall be shielded or recessed so as not to shine upon abutting properties or streets. The site shall be reviewed by the Planning Staff. Any changes to the approved lighting plan as may be reasonably required by the Planning Staff shall be made at the owner's expense, d) The"T"Hangers must comply with ail applicable state fir and building codes. e) The applicant must install a fire alarm system connected to the Municipal Fire Alarm System. 4. Prior to the final release of security: a) The site shall be reviewed by the Planning Staff. Any screening as may be reasonably required by the Planning Staff and/or Tree Warden will be added at the applicant's expense. b) A final as-built plan showing the location of all on- site utilities, structures, curb cuts, parking spaces and drainage facilities must be submitted to and reviewed by the Division of Public Works. 5. This approval is for the construction of airplane hangers for the storage of airplanes only. The site shall not be used for the storage of fuels or other flammable material. 6. Any plants, trees or shrubs that have been incorporated into the Landscape Plan approved in this decision that die within one year from the date of planting shall be replaced by the owner. 7. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 8. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 9. All catch basins shall be protected and maintained during construction with hay bales to prevent siltation into the drain lines. 10. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 11. No underground fuel storage shall be installed except as may be allowed by Town Regulations, 12. All signs must be consistent with the signage currently on site and comply with the sign bylaw. 13. The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. 14. Any action by a Town Board, Commission, or Department which requires changes in the plan or design of the building as presented to the Planning Board, may be subject to modification by the Planning Board, 15. Any revisions shall be submitted to the Town Planner for review. If these revisions are deemed substantial, the applicant must submit revised plans to the Planning Board for approval. 16. This Special Permit approval shall be deemed to have lapsed after �� /%JS (two years from the date permit granted) unless substantial use or construction has commenced.
