The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,March 12, ►
4/ 2002,at 7:30 PM upon the application of Northeast Storage Corporation for premises at: 492 Sutton
Street,North Andover,MA requesting a Variance from the requirements of Section 8,Off-Street Parking
Paragraph 8.1(1)and Table 2;and a Special Permit from the requirements of Section 4,Paragraph 4.1(1)
N General Provisions,and Paragraph 4.133(21)for parking,indoor storage,and other accessory uses
customarily associated with a self-storage facility in order to construct one(1)two story building and three
(3)single story buildings within the 12 zoning district.
The following Board members were present: Robert P,Ford,John M. Pallone,Ellen P.McIntyre, George
M.Earley, &Joseph D.LaGrasse.
Upon a motion made by George M.Earley,and 2"d by Ellen P. McIntyre,the Board voted to GRANT a
Variance froth the requirements of Section 8,Paragraph 8.1(1)and Table 2 for relief of 102 from the �
required l 10 parking spaces with the condition that the 8 spaces be used to accommodate the self-storage O �
facility exclusively,and that reasonable landscaping be added according to the Site Plan prepared for
Northeast Storage Corporation by Philip G.Christianson,Registered Professional Engineer, #28895,
Christiansen&Sergi, 160 Summer St., Haverhill,MA 01830,dated 1/21/02 and to GRANT a Special
Permit from the requirements of Section 4,Paragraphs 4.1(1)&4.133(21)that it be a self-storage facility
similar in character to the permitted use i.e.warehousing per the above plan and the plan by Neil C. �
Montgomery,Registered Professional Engineer,#24034,Gordon L.Todd,Assoc., Architects&Planners, TL
P.C.,2116 Bustard Road,Lansdale,PA 19446,dated 8/28/98 of 1 two story and 3 single story �p
prefabricated metal buildings by Miller Building Systems on condition that the self-storage facility abides
with all fire suppression systems as required by the North Andover Fire Department fire codes and the Fire
Chief s requirements;that all buildings will contain Fire Sprinkler systems serviced by a 4"water.main to
each building;that the fire hydrant be accessible;that there be 8'surrounding chain link fencing with one
primary sliding gate,with additional gate(s)for Fire Department truck access; 24 hour security cameras;
finally,user access be during the 8 AM to 9 PM on-site manager's hours, only. Voting in favor; Robert P.
Ford,John M.Pallone,Ellen P. McIntyre,George M.Earley,&Joseph D.LaGrasse.

The Board finds that the applicant has satisfied tlae provisions of Section 10,paragraph 10.4 of the Zoning
Bylaw and that the granting of this variance will not adversely affect the neighborhood or derogate from the
intent and purpose of the Zoning Bylaw,and that the applicant has satisfied the provision of Section 4, j
Paragraph 4.133(21)of the Zoning Bylaw providing that the parking,indoor storage and other accessory
uses customarily associated with the above uses,shall not be injurious,noxious, or offensive to the
neighborhood.
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the
grant, it shall lapse,and may be re-established only after notice,and a new hearing. Pu rffie rmore,if a
Special Permit granted under the provisions contained herehi shall be deemed to have lapsed after a two(2)
year period from the date,on which tine Special Permit was granted unless substantial use or construction i
has commeraeod,it shall lapse and may be re-established only after notice,and a new hearing.
