In accordance with the Zoning By-Law the use Self Storage is not listed as an allowable use in the 12 zoning district. However the use is similar in character to warehousing. Therefore in accordance with section 4.1.1.1 a special permit shall be required for all uses which are similar in character. Please refer to section 10.3 of the Zoning By-law as to the criteria for the special permit, Further the application for Site Plan review shows a use which is NOT antKaccessory use to the airport, While we have allowed the use of airport property generally as a means to accomplish lot areas those uses, such as hangers, have been accessory to the principal use. Therefore you are required to prove that sufficient lot' .area exists for the proposed use and that such lot$ area affords the required setbacks as if the use was on a separate lot. At this time your plan shows non-compliance with setbacks and lot area. To indicate setbacks and lot area in a leased land situation you must indicate a lease line. The line must meet the setbacks on both sides, interior and exterior of the leased area, The applicant must supply a lease indicating that they hold rights to the property. Therefore you are required a Special Permit for Site Plan with the Planning Board, a Special hermit for the use with the Zoning Board (see SPGA term definition) and resolution of the lot area and setbacks. The applicant proposes a total of approximately 55,000 SF of storage space. This is achieved through the proposed construction of 4 buildings, 3 of which are one-story buildings,with a remaining two story building. The applicant requires a variance and special permit for parking and uses allowed in the I- I district and did/ .c4 : '''. The following information must be submitted along with the application: i) NORTH ARROW/LOCATION MAP: A north arrow and a location map showing surrounding roadways and land uses adjacent to the site (1"=1500). Location Map should show at least one intersection of two existing Town roadways. This has been provided ii) SURVEY OF LOT/PARCEL: A boundary survey conforming to the requirements of the Essex County Registry of Deeds Office. The survey shall be dated and include any revision made to the survey or site plan. Any change in the survey shall be recorded before site plan approval may be granted. This has been provided. iii) NAME/DESCRIPTION OF PROJECT: The name of the development and the navies, addresses and telephone numbers of the project listing tenants, land uses, development phases, or other pertinent information necessary to evaluate the proposed development plan. This has been provided. i i I j I i iv) EASEMENTS/LEGAL CONDITIONS: Identification of easement(s) or legal encumbrances(s)that are related to the sites physical development, and a listing of any condition(s) placed upon the site by the Board of Appeals, Planning Board, Conservation Commission, or any public body or agency, with the authority to place conditions on the sites development. A note should be added that a variance and special permit was7► �ol granted for their appropriate sections of the zoning by1mv by the ZBA. v) TOPOGRAPHY: The present and proposed topography of the site, utilizing two-foot (2) contour intervals. The contours shall extend at least fifty (50) feet beyond the site boundaries by estimation of the professional submitting the plan. This has been provided vi) ZONING INFORMATION: All applicable Zoning Bylaw information shall be provided regarding the site's development. This information shalt be placed in a table and list all parking, setbacks, percent of lot coverage, floor-area-ratio, number of dwelling units, total amount of square feet, size of signs and any other applicable zoning information necessary for the proper review of the site plan by the Town Planner and Planning Board. All required zoning information has been provided, however they need to supply a table for the parking spaces vii) STORMWATER DRAINAGE: All storm water drainage control facilities utilized by the site shall be shown on the site plan. Storm water drainage calculations which support the design of the control facilities shown the plan shall be submitted to the Department of Public Works for review and approval. Calculations shall show a mitigation of run-off to zero of the 2, 10,and 100 year storm event. This has been provided. viii) BUILDING LOCATION: Identification of all existing and proposed structure(s) located on the site. The number of stories, overall height in feet and gross floor area in square feet of all structure shall be indicated. This has been provided ix) BUILDING ELEVATION: A drawing of the exterior of the building, as viewed from the fiont (street view) must be submitted. The Planning Board may request side and rear views if relevant to the Board's review. This drawing must be at least 8" x I V in size. A building elevation (8.5 xll) has been provided, along with the colors and styles of the building. However, I feel that a better elevation than what has been presented could be provided, due to the magnitude of this project. (elevation attached). My recommendation would be that a building elevation, as the building will be i viewed from the street and as it will appear on the site, be provided for the Board to review the night of the hearing. x) LOCATION OF PARKING/WALKWAYS: Identification of the location of all existing and proposed parking and walkways areas, including curb cuts h site fi-om adjacent roadways, or access points. that will be used to access the t � y , This has been provided xi) LOCATION OF WETLANDS/NOTICE OF INTENT: All resource areas as defined in M.G.L. Chapter 131, Section 40 and the Town's Wetland Bylaw, shall be shown on the site plan. The applicant shall file a Notice of Intent with NACC concurrently with the application to the Planning Board for Site Plan Review. NOI has been filed with ConCorn xii) LOCATION OF WALLS/SIGNS: Identification of the location, height and materials to be used for all retaining walls and signs located on the site. Signs will be reviewed using the guidelines set forth in Section 6.7 (H) of the Zoning Bylaw. The proposed sign meets the signage guidelines sel,forth in Section 6.7 (h) of the ZBL. xiii) LOCATION OF ROADWAYS/DRIVES: Identification of all right-of-ways and driveways including the type of curb and gutter to be used, and their dimensions. Distances to all the nearest roadways and/or curb cuts shall be shown for both sides of any streets, which is adjacent to the site. This has been provided. xiv) OUTDOOR STORAGE/DISPLAY AREAS: Identification of the location and type of outdoor storage and display areas on the site. This has been provided. xv) LANDSCAPING PLAN: Identification of the location and landscape schedule of all perimeter and interior landscaping, including but not limited to proposed paving materials for walkways, fences, stonewalls and all planting materials to be placed on the site. In addition, all existing trees over 12 inches DBH, to be saved or removed shall be shown on the site plan. Any landscaping required by the Town Bylaws shall be indicated on the site plan in tabular form showing the amount required and the amount provided. Existing trees over 12 DBH have not been shown, (if there are any) so I am unable to determine if any are being saved or removed. xvi) REFUSE AREAS: Identification of the location of each outdoor refuse storage area, including the method of storage and screening. All refuse areas must be fully enclosed. A dumpster is located next to the proposed one story building to the right of the entrance. Unfortunately, the method of storage and screening or whether or not the dumpster will be enclosed was not depicted on the plans. no-1 '.0-nCAl xvii) LIGHTING FACILITIES: Identification of the proposed illumination, indicating the direction and the degree of illumination offered by the proposed lighting facilities, including an example of the light fixture to be used. This has been provided(attached). xviii) DRAINAGE BASIN STUDY: A detailed hydrology study for the site. Included in this study is the proposed storm water run-off rates into the existing drainage system and its potential down-stream impact on the existing drainage system. This has been provided. xix) TRAFFIC IMPACT STUDY: Identification of existing traffic levels, along with the expected traffic impacts to occur based upon the proposed project. Projects which access state highways, a traffic impact study shall be filed with MEPA concurrently with the Planning Board review. A copy of the MEPA study shall be filed with the application to the Planning Board. A traffic study has been provided and it conforms to the specifications required by the Trip Generation Manual developed by the Institute of Transportation Engineers. The peak rush hour in the afternoon results in less than 8 vehicles would enter or leave the site in the afternoon, with the peak hour of traffic occurring on a Saturday resulting in I I vehicles entering and leaving the site. xx) COMMONWEALTH REVIEW: Any information required and submitted to any agency of the Commonwealth, shall be filed with the Planning Board upon the initial submission of the project for Board review. N/A xxi) UTILITIES: All utilities, including water line locations, sewer line locations and profiles, and storm drainage systems; This has been provided. xxii) FISCAL IMPACT: Projections of costs rising from increased demand for public services and infrastructure; provisions of benefits from increased tax revenues, employment and infrastructure improvements; and impacts on adjacent property values. Not provided, nor do I believe it is necessary due to the fact that it won't have an impact on the Town relative to schools, and/or maintenance. i xxiii) COMMUNITY IMPACT: Analysis of the project's impact on the surrounding neighborhood in terms of architectural consistency, pedestrian movement and overall character; impacts on nearby historic structures or site; and an evaluation of the proposed project's consistency and compatibility with existing local and regional plans. N/A Screening & Landscaping 1. It would appear more landscaping could be provided around the residential abutters (Albert). Also I would recommend that a 8' stockade fence be placed around the abutting property for additional screening. Section 8.4.1 requires "trees or shrubs, at least four feet high at the time of planting....." The screening proposed along the frontage of Sutton Street, per sheet 3 of the plan, provides 2-3' hews, rhododendrons and aborvitae. The screening needs to be replaced with 4-foot high plantings to meet Section 8.4.1 of the ZBL. As of this date,I have not yet received revised plans for your proposal. if you wish to be placed on the August 3, 1999 agenda,I will need revised plans reflecting the following by Tuesday, July 27,1999: 1. Hours of Operation of Proposed Business 2. Combination of Fence and Landscaping along the frontage of the building on Sutton Street for screening purposes. This was an informal suggestion made by the Planning Board the night of the meeting held on July 6, 1999. 3. Any landscaping proposed on the site should be in conformance with Section 8,4.1. of the Zoning Bylaw or a waiver needs to be requested—specifically, I am referring to the 2-3' hews, rhododendrons and arborvitae on the plans which are not in conformance with Section 8.4.1 which requires"trees or shrubs, at least four feet high at the time of 14anting,..". 4. An architectural rendering of the proposed buildings along with proposed building elevation; 5. Note on the plan stating the date of the variance granted;and 6. In addition, they have also presented "viewpoints" of the buildings if they were to face Sutton Street, all of which I am including for your review. It appears to me that the alternative site plan which has been presented is more what the Planning Board has been looking for, and it it were incorporated with the previously presented plans (with the landscaping, etc.) it is a significant improvement. The Decision of the Planning Board was recorded with the Town Clerk's office on October 25, 1999 (see copy attached). Contemporaneous with the Applicant obtaining all necessary town permits, my client pursued obtaining an executed lease for the property from the Lawrence Municipal Airport Commission. The City of Lawrence and the Federal Aeronautics Administration took several years to approve and issue the lease, which my client received in 2001. In the interim period, the Applicant lost its bank funding for the project due to the excessive delay in obtaining the lease. The Applicant has had to pursue new funding sources and is now prepared to proceed with this project in its original permitted condition. Accordingly, request is hereby made on behalf of the Applicant for an extension of the Site Plan Special Permit in order that the project may proceed without the necessity of re-filing the application and re-hearing the same facts. We are proposing that prior to construction of the new sewer elevations be taken at the beginr►ing 4nd end of the new sewer and a slope calculated. This project commenced construction in the fall of 2002. The east side of the project was constructed first then followed to the west side. Paving was installed on the east side at the end of October,and the 2 storage buildings were constructed. It was our Intent to landscape the east side last November. We were not able to accomplish it in early November because the site was too wet and saturated due to rain almost every other day. We hoped that sooner or later it would dry up. In fact, on November 14, 1 spoke with Kathleen McKenna, the previous planner, regarding substituting the Cypress plants for arborvitae because cypress was not available at that time. This was memorialized In a memo to her summarizing our discussion. Our plan was to install the plants upon approval, which was granted. The planting was actually scheduled for the week of November 25, Thanksgiving week, however due to rains on November 22, the site was too wet. We received 7"of snow the day after Thanksgiving, 2 snow storms on Dec 1 to the 5th,and sub teen nights during that time frame, freezing the ground solid, it was not possible. Construction continued on the 2 -story building throughout the difficult winter,and all swales, erosion control,etc was maintained, and remained functional. s Only the week before last was the ground dry enough to re-shape on the east side. This was completed last week. The landscaper was originally scheduled to begin the landscaping on the east side this week. However,the rains have thwarted that effort. Thomkins Landscaping Is scheduled to start on Monday, May 19, 2003. Fine raking and plantings will commence, according to the approved landscaping plan on the east side. Final paving of the east side, and base course paving on the west side is also scheduled for next week. Upon completion of the top coat adjacent to the buildings (Week of 5- 19), the fence and gates perpendicular to Sutton Street will be Installed. CHANNEL RUM PING CO. Only after it is completed, approximately 5 weeks,will the remainder of the top coat of pavement and landscaping on the west side be completed. Please understand that the foundation permits for this project were pulled in late September 2002,with final building permits pulled In October, 2002. We have been on site just only about 6 months or so. Channel Building Company has diligently prosecuted the work of the project,and is scheduled to complete it soon. This project includes 4 buildings totaling roughly 60,000 SF. Channel Building Company has made every effort to complete this project expediently, however,the late fall and winter especially,was not conducive to as smooth a construction process, as we all would prefer. At that time I wrote in site visit log that the trees were planted in accordance with the approved plans in the approved locations. There were two erosion areas where I asked that they place stone and one berm on the west side of the site that needed to be fixed, as it was washed out by the heavy rains. After receiving your email, I reviewed the plans again and questioned whether or not the trees planted were in accordance with the sizes requited by the approved plans. I had a meeting with Attorney Scalise this afternoon on another matter, after which we went back out to the Northeast Storage site. Condition 4c of the site plan special permit states that The landscaping must he planted as shown on Sheet three of the approved and endorsed plans. Sheet 3 depicts Oft Cypress and White Pines along the front of the buildings on the north side of the drainage swale. It also shows two 4-6ft Norway Maples and one 8- 1 Oft White Pine. At 3:30 this afternoon, Attorney Scalise and I measured the trees and they all met the minimum heights specified on Sheet 3 of the approved plans. Additionally,the grass is taking well and the site has stabilized. This decision does not have a condition that some others have granting the Planner authority to require additional screening. I did suggest to Attorney Scalise that his client add some addition tens along the south e-nM"raiages -ale a ong oth the three links of fenc on the east side and_.the four links of fencing on the west side ither side of the entrance.
