NELSON Al I 120 Main Street 01845 F Town of Director (508) 682-6483 BUILAING NORTH ANDOVER �,ss.:,,.::•��,6 CONSERVATION ACnU9 DIVISION OF HEALTH NIG PLANNING & COMMUNITY DEVELOPMENT September 2 , 1993 Mr. Daniel Long, Town Clerk Town Building 120 Main Street North Andover, MA 01845 Re: Site Plan Review Lawrence Municipal Airport - Two Hangers Dear Mr. Long: The North Andover Planning Board held a public hearing on Thursday evening August 17 , 1993 , in the Senior Center behind the Town Building on the application of Merrimack Group Corp. , 1 Parker Street, Suite 1B, Lawrence, requesting Site Plan Review approval under Section 8. 3 of the North Andover Zoning Bylaw. The legal notice was properly advertised in the North Andover Citizen on July 28 and August 4 , 1993 and all parties of interest were duly notified. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Clerk and Richard Rowen. The petitioner was requesting Site Plan approval for the construction of two aircraft hangers, one containing 5, 928 sq. ft. and one containing 10, 296. The premises affected is located off Sutton Street at the Lawrence Airport in an Industrial-2 (1-2) Zoning District. Mr. Mahoney read the legal notice to open the public hearing. There was no quorum so only a brief discussion of the issues took place. Mr. Steve Stapinski, engineer, gave the Board members a brief overview of the proposed. 1. The hanger will accommodate 8 planes. 2 . The hangers will be made of steel, prefab, similar to what exists. 3 . No water or sewer. 4 . Power will be provided. 5. Scrub vegetation will be removed, but not the woods in between. 6. Drainage - added a pair of catch basins Page 2 : Lawrence Airport 7 . No drains inside, sloping concrete 8 . No lighting added. 9 . Tapered steel roof. The Board should schedule a site visit. Mr. Dan Florence, proponent, gave the Board the following information: 1. No maintenance at hanger, or around hanger. 2 . Provide a copy of lease agreement 3 . Limit of operation 4 . Hanger is used as a garage for planes only, similar to a garage for cars. Limits to hours of operation will be added to the decision. On a motion by Mr. Mahoney, seconded by Mr. Rowen, the Board voted to continue the public hearing to August 31, 1993 . Mr. Nardella also voted. A site visit was held on August 28 , 1993 . On August 31, 1993 the Planning Board held a regular meeting. The following members were present: Richard Nardella, Chairman, John Simons, Vice Chairman, Richard Rowen, John Draper and John Daghlian, Associate Member. Bill Galman, Merrimack Group was present. Airport tower is closed at night. There was a discussion of requirements of the Fire Department. Project cannot install sprinklers because there is no water. No heat is provided to the hanger. No other hangers at the airport have sprinklers systems. The Board was given a draft decision. After reviewing the decision, the Board had the following comments: Mr. Draper - delete 3 (b) (i) (ii) (iii) , keep 3 (b) (iv) Mr. Rowen - delete 3 (b) Mr. Daghlian - alarm system installed Mr. Draper smoke detection - conform to applicable state regulations On a motion by Mr. Draper, seconded by Mr. Simons, the Board voted to close the public hearing. a Page 3 : Lawrence Airport On a motion by Mr. Draper, seconded by Mr. Rowen the board voted to approve the site plan decision as written and modified by deleting specific requirements of the Fire Department and adding that applicable state regulations be met. SITE PLAN REVIEW, SECTION 8.3 OF THE NORTH ANDOVER ZONING BYLAW. The Planning Board makes the following findings regarding this Site Plan Review for the construction of two aircraft hangers; one containing 5,928 feet and one containing 10, 295 sgft. at the Lawrence Municipal Airport as required by Section 8. 31 of the North Andover Zoning Bylaws: FINDINGS OF FACT: 1. This specific site is an appropriate location for an aircraft hanger as it is an airport; 2 . The use as developed will not adversely affect the neighborhood as an airport with hangers currently exists in the neighborhood; 3 . There will be no nuisance or serous hazard to vehicles or pedestrians; 4 . Adequate and appropriate facilities will be provided for the proper operation of the proposed use; 5. The Planning Board makes a specific finding that the use is in harmony with the general purpose and intent of the Bylaw. Finally, the Planning Board finds that the proposed construction generally complies with the Town of North Andover Zoning Bylaw requirements as listed in section 8. 35 but requires conditions in order to be fully in compliance. Therefore, in order to fully comply with the approval necessary to construct the facility as specified in the Site Plan Review application before us, the Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. Prior to any clearing or construction: a. The applicant shall mark in the field the edge of clearing and limit of work area. This area shall follow the grading line as shown on the plan entitled "Site Development Plan of Land in North Andover, Mass; Proposed Aircraft Hangers" dated July 1993 . This limit of work shall be reviewed in the field by the Town Planner and/or the Tree Warden. 1 } b. a bond in the amount of $2000. 00 shall be posted for the purpose of insuring that a final. As-Built plan showing location of all on site utilities, structures, curb cuts, parking spaces and drainage facilities be submitted. This bond shall be in the form of a check made out to the Town Of North Andover. This check will then be deposited into an interest bearing escrow account. C. the North Andover Division of Public Works shall review and approve all plans, including storm water drainage, d. The applicant shall provide a copy of lease agreement between the Merrimack Group Corp and the Lawrence Airport Commission. 2 . Prior to FORM U verification (Building Permit Issuance) : a. This decision shall be recorded at the Essex North Registry of Deeds and a recorded copy delivered to the Planning Staff. 3 . Prier to verification of the Certificate of Occupancy: a. A final as-built showing the location of all on site utilities, structures, curb cuts, parking spaces and drainage facilities must be submitted to and approved by the Division of Public Works. b. Both aircraft hangers must comply with applicable state fire and building codes. 4 . This approval is for the construction of airplane hangers for the storage of airplanes only. No maintenance of airplanes shall take place in and around the hanger area. No engines should be operated in the hanger. 5 . The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 6. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 7 . All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. 8 . No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 9 . No underground fuel storage shall be installed except as may 2 f be allowed by Town Regulations. 10. All signs within the project shall be of wood or stone, with uniform lettering and design. The signs shall in no way be interior illuminated. (Neon or other means) . 11.. Any changes to the plans approved by the Planning Board shall be reviewed by the Town Planner. Any changes which the Town Planner may deem as major must be submitted to the Planning Board for approval . 12 . The provisions of this conditional approval shall apply to and be binding upon the applicant, it' s employees and all successors and assigns in interest or control.
