RE: Cleaning of dust and construction debris—Public Health Nuisance
Dear Owner and Property Management Group,
Last week on February 1", 2023 correspondence via a letter and via emails about cleaning the dust and
debris created during repairs made to the ceiling were sent to your representative property management
group. In the letter dated February 1", 2023, 1 ordered your representative property management group
to abate the issue they created while making repairs to address falling portions of the ceiling. Upon re-
inspecting the unit on February 6, 2023, I noted there were multiple areas that were not addressed that
were noted in the initial letter and shown in images attached to the letter. A receipt dated February 4,
2023'noted that there was "vacuuming carpet and dusting" completed, however there are still
outstanding issues that create a public health nuisance present in the apartment. During my reinspection,
I noted there was still debris behind furniture in areas cited from the last letter, as well as white dust
present on walls and furniture including but not limited to the couch, behind the couch,recliner, walls,
and on and behind both dressers by the door.
Because the public health nuisance has failed to be addressed in the timeframe allotted, in accordance
with Massachusetts General Law Chapter 111, Section 122,you are hereby issued a fine of$100
per day starting on the initial date of February 3, 2023, as specified in the first letter. Failure to
address the nuisance will result in additional fines,with each day constituting a new violation,
being issued. The issue must be completely abated by February 8, 2023. Failure to meet this
deadline will result in the accruing fines increasing past$100 per day. Once all dust and debris in
this room is remediated you must contact the Health Department for a reinspection. When the
reinspection occurs and notes all dust and debris has been remediated, the total amount of fines
accumulated will be gathered and another letter will be sent to you.
You have the right to request a hearing before the Board of Health if you feel these fines should be
modified or withdrawn. A request for said hearing must be made in writing and received by the Health
Department within seven(7) days from receipt of this Order. At said hearing you will be given an
opportunity to be heard and to present witnesses and documentary evidence as to why this Order should
be modified or withdrawn. All affected parties will be informed of the date,time and place of the
hearing and of their right to inspect and copy all records concerning the matter to be heard. You may be
represented by an attorney. You have a right to inspect and obtain copies of all relevant records
concerning the matter to be heard.

Once ail dust and debris from the repairs created has been remediated, contact the North Andover Health
Department at 978 688 9540 or via email so we may schedule an inspection with the tenant.
