I have CC'd Paul Hutchins, the North Andover Building Commissioner, who was present during the inspection. While numerous violations exist, certain ones require a more immediate fix than others. I listed a few below that . have shorter time frames and are more imminent regarding safety concerns for the tenants. • Issues with smoke alarms in the kitchen and living room • Water damage to the ceiling in the living room area, which appears to be from a leak or leaks in the roof above. This is impacting both the ceiling and electrical fixture in the living room. • The bathroom floor has sustained water damage and is in disrepair. • There are concerns of lead paint and children under the age of 6 reside in this unit. No lead paint certificate is on file for this unit, and thus a lead paint determinator will need to investigate the issue. Attached is the Order to Correct and Violation letter from my inspection. Please contact me as soon as you can regarding this issue.Timeframes have been allotted for repairs to be made, and I strongly encourage you to start on these ASAP. The Building commissioner and myself would like to meet you (or, if not feasible, a property manager)onsite at the property as soon as possible as well. I spoke with the tenant regarding allowing work to be performed with adequate notice and about ensuring areas that will require work are easily accessible. As a general note, please ensure that any work requiring a building permit receives one. It may be worth having the plumber or contractor take a look at the other areas that are affected by leaks/water damage while they are on site to save them a trip. Just a thought. Please keep us informed on days when work will be performed or aim to be completed, especially for the immediate items noted in the report/previous email. SIDE Refers to A,B,C,or D side of the building or room.See the diagram on the cover sheet.The"A"side of the building or room is the side facing the street that gives the property its address(usually,it is the front of the building).Keeping your back to this street,from the"A"side move clockwise to the"B"side on your left,the"C" side opposite you,and the"D"side to the right. Numbering is from left to right. LOCATION/ Refers to the building component(s)being tested.Some surfaces may be made up of more than one part.For SURFACE example,"Baseboard"may refer to four separate pieces of wood(one on each wall),but is still considered one surface. LEAD The actual lead result.Each surface tested must have a result recorded in the"Lead"column. • A number shows that the surface was tested with an XRF analyzer.A number equal to or greater than 1.0 mg/cm'- is a dangerous level of lead. • A"pos"or"neg"shows that the surface was tested with sodium sulfide."Pos"means that there is a dangerous level of lead. • "N/A"means that the inspector was not able to test the surface.The inspector must assume the surface contains lead and require it to be deleaded.Speak to the inspector about possible alternative testing options. • "MET"or"MR"means that a metal surface was not tested.Metal handrails,metal window sills,and metal railing caps need.to be deleaded if they test equal to or greater than 1.0 mg/cm2,or are marked"MET"or "N/A".All other metal surfaces must be intact. • For key to abbreviations like"COV","VB","VR"or"MR","NC","Tile","DC",see the cover page. TYPE OF Not all lead paint must be deleaded.This column tells you IF and WHY a surface needs deleading.The deleading HAZARD standards below may not apply for Interim Controls.Speak to your risk assessor for more information. • "M/I"circled means that the surface is a moveable/impacted part of a window and must be deleaded in its entirety. • "SF"circled indicates that there is a storm frame present which requires the blind stop and exterior sill be deleaded as interior moveable/impacted surfaces. • "A/M"circled means that the surface is"accessible mouthable"and must be deleaded to a minimum of five feet high,four inches in from the edge or corner. • "F"circled means that the surface is a"friction"surface and must be deleaded at all points of potential friction. • "L"circled means that the surface is loose and must,at a minimum,be made intact.Loose leaded floors must be sealed with paint or similar coating and pass a dust wipe. • If more than one choice is circled,the rules for deleading may change depending upon what method of deleading you choose.Speak to the inspector for more information. • "N/A"means the inspector was unable to determine if the surface was a lead hazard.The person doing the deleading must check this surface and follow all the rules for deleading.Speak to the inspector for more information. • If nothing is circled in the column,then it is likely the surface does not need deleading.Speak to the inspector for more information. Remember,this does not mean the entire surface is lead free,it just does not require deleading in its current condition. URG HAZ? This column is completed during a risk assessment,which is an evaluation of a home's suitability for Interim Control. Only a licensed risk assessor can do a risk assessment. If"Y"is circled,then this surface is considered an"Urgent Lead Hazard"and deleading is required to qualify for Interim Control. IC DATE The date the licensed risk assessor determines the surface meets the standards for Interim Control. IC METH The deleading method or structural repair done to qualify the surface for Interim Control.Refer to the deleading codes key on the cover page. DELEAD DATE The date that the lead inspector reinspects the surface and finds that it is in compliance. DELEAD METH The method used to bring a surface into full compliance. Refer to codes in the Key on the report's cover page. EXCLUDED The amount of loose paint on a surface as measured by the lead inspector."N/A"means that the inspector was not SURFACES able to measure the loose paint,but has determined it is more than the cut-off for moderate risk making intact. They also noted the pipe leaking in front of the entrance to their unit has occurred again. While I understand obtaining a licensed contractor may take time, it has been nearly a month and a half since I did the inspection and only a few items have been corrected. Next week, you need to have your contractor submit a permit for the bathroom floor and get me an established timeline for the roof work and chimney work to be done. These items need to be corrected as soon as possible. You need to have the leak occurring in the ceiling in front of the unit entrance investigated this weekend. The tenants need to be provided with timely notice in writing, which we interpret as 24-48 hours, before work is completed to gain access to the unit. The landlord had reached out about the repairs being started on Thursday but not today. Whatever date is being provided must be adhered to so that they receive adequate notice to leave the home or make arrangements to allow repairs to be completed. I have CC'd the landlord on this email as well. For remaining items, I attached the list to this email that was initially sent to the landlord. There is a doorbell that has been installed on the back door, however I have not verified whether one on the front door was installed. Once the floor is repaired I'll determine a new set of deadlines for the remaining items, however I will not be giving more time than initially outlined in the violation letter. Despite requesting evidence on repairs that were made to the property's rear room over the living room, I have not received anything. In addition, upon reinspection of the dwelling unit yesterday I noted that above the acoustic ceiling tile the physical ceiling, likely due to the water damage sustained, had areas of concern as a noticeable piece of drywall had fallen off and was resting on the acoustic ceiling tile. Other areas of the ceiling showed cracking and defects. This needs to be addressed immediately as falling-pieces of drywall poses a hazard to the occupants of the unit. I attached an image below showing the issue at hand. I will be on site Friday morning with the building commissioner to inspect this. If this issue is not addressed by Friday, January 13th, l will file against you in Lawrence Housing Court. The other remaining items were as follows, and need to be repaired as soon as possible but no later than Tuesday, January 17th, 2023. • The front common door to the dwelling is not self-locking. This door needs to lock once closed on its own as there are over 3 units in the building. • The window in the main bedroom to the left of the kitchen had a crack that was not present before in the pane. This may have been broken during the repairs made to all windows.All windows must be free of defects and function as intended. • The ceiling in the living room still had evidence of leaking. Upon examining the roof I noted a hole present near the edge of the roof closest to the means of egress (picture attached).Water staining was seen on the ceiling tiles near this side as well.The roof must be repaired so that no leaks or water damage occur to the living room ceiling. The Housing Case for this dwelling has been unresolved for over 4 months. If repairs are not made immediately to bring all areas into compliance I will be filing in housing court. If the repairs are delayed any further I will be going to housing court for this case. It has been over 4 months since the violations were brought to the owners attention and over two since property management took over. Regarding the repairs, if the ceiling needs to be worked on and replaced it must be investigated and remediated for lead paint.This was already found throughout the unit and there are children living there currently. In addition, proper communication needs to occur between you and the tenants. I am aware notification was given for the repairs today, but no one was notified they were moved to monday until I informed them. I will reinspect early next week to verify the issues have been repaired. The remaining items must also be addressed from the prior email as according to property maintenance they will have two technicians will be onsite. We patched the roof per your photo and installed a 2x4 sheet of drywall to secure old loose plaster from falling; above the drop down ceiling however this is not a permanent fix.The Tenant did not allow us to clean up the debris on the drop down ceiling and he was reluctant at first to allow us to put the 2x4 sheet of drywall up over the bad plaster that was pulling away. Considering there is still dust and debris present in the front hallway from the plumbing repair that occurred, I understand his hesitancy. The ceiling needs to be repaired permanently by a licensed contractor in a manner compliant with housing and building codes to prevent additional falling pieces from damaging the acoustic ceiling underneath and posing a threat to the occupants.This issue seems to be present in multiple areas on the ceiling under the acoustic tiling, and I do not want this issue occurring elsewhere.You need to contact the tenant to schedule this ahead of time with him, provide an estimate of how long the ceiling repairs will take (if longer than a day, the tenant may look to stay elsewhere for the night)and provide protection to the unit to ensure it is not contaminated by dust/debris created through work and from movement of ceiling tiles as there is already dust/debris on top of these. I would highly recommend providing coverage to the contents of the unit and creating ventilation to remove dust that is produced during work. I want you to send me, by no later than this Friday the 20th at noon, a date and time confirmed with the tenant to complete the ceiling repairs scheduled for no later than 1/25/23. I reinspected 94 Main Street Unit 1 yesterday, January 9th 2023, and noted there were violations that still remained outstanding. The most critical one is the ceiling in the living room. Despite requesting evidence on repairs that were made to the property's rear room over the living room, I have not received anything. In addition, upon reinspection of the dwelling unit yesterday I noted that above the acoustic ceiling tile the physical ceiling, likely due to the water damage sustained, had areas of concern as a noticeable piece of drywall had fallen off and was resting on the acoustic ceiling tile. Other areas of the ceiling showed cracking and defects. This needs to be addressed immediately as falling_pieces of drywall poses a hazard to the occupants of the unit. I attached an image below showing the issue at hand. I will be on site Friday morning with the building commissioner to inspect this. If this issue is not addressed by Friday, January 13th, I will file against you in Lawrence Housing Court.
