Box 97 North Andover, MA 01845 RE: Release of Final Bond Monies for the Hangar Project Site Plan Dear Sir or Madam: The Planning Office is in the process of assessing special permit files that have not been completed or closed out to determine compliance with the approved plans and the decision. Our goal is to assist you towards completing your project so you may have your bond money returned. In going through our files, we noticed that you have documentation and/or a final as-built plan which needs to be submitted to our department. I may also have to perform a site inspection to ensure compliance with the special permit decision. In the absence of this information, we will be unable to release your final bond monies. I have office hours available by appointment qWon Mondays from 10:00 a.m. to 12:30 p.m, and on Tuesdays fiom 9:00 a.m. to 11.30 a.m. If you would like to schedule an appointment with me for us to review what remaining documentation and/or plans need to be submitted, I would be more than happy to do so. North Andover Town Offices 120 Main Street North Andover, MA 01845 RE: KING AIRCHARTERS, INC. l�r RR Fiw F,N T RELEASE OF BOND Dear Justin: You have asked for advice as to whether an applicant's bond should be released if a special permit expires without any work being commenced thereunder. In this case, a special permit for construction of a hangar was issued on April 21, 1999. The penrrit expired on April 21, 2001. The Town is holding the sum of Five Thousand ($5,000.00) Dollars as security for performance of the conditions included in the special permit. The applicant has represented that work was never started on the project, and that it does not plan to proceed with the construction of the hangar. Under these circumstances, it would be appropriate for the Planning Board to release the bond funds, unless the applicant violated any conditions of the special permit which the Board determines must be corrected. This does not appear to be the case here, as no work was ever begun, and the permit has expired, so the applicant may not commence any work without applying for a new permit.
