Senior Citizens Center PRESENT: Joseph W Lynch, Jr Robert L Mansour George L Reich Deborah Feltovic Scott Masse STAFF: Julie A Parrino Donna Mae D'Agata Chairman Lynch called the meeting to Order at 7 03 P M MINUTES: November 6, 1996 No action NEW BUSINESS: Presentation • Ipswich River Watershed Association Ms Karrie Mackin addressed the commission and presented a brochure from the Ipswich River Watershed Association (IRWA) She displayed a map of the watershed She stated the their jurisdiction in North Andover primarily is with Fish Brook The association wants to ensure protection of the brook, and thus enhance the quality and preservation of the Ipswich River The brook hosts native brook trout and it has retained relatively high water quality She is seeking support from the NACC in assisting in carrying out their mission A handbook will be provided to the NACC over next week showing how the Ipswich River watershed is used for water supply The Executive Office of Environmental Affairs (EOEA) is involved through a new grant underwriting policy whereby grant monies will be considered and doled-out on a "watershed impact basis" All assessment work and funding will be coordinated in the future This is a benefit to the Town of North Andover The association is also charged with forming stake holders at the EOEA level North Andover will be included as an IRWA stake holder Stream teams will monitor water in the watershed Last spring the association took a bus tour of the entire watershed Hazardous waste within the watershed is a primary concern at the present time The association would like to hear from the North Andover Conservation Commission to see what assistance IRWA can provide to the NACC Growth management issues can be addressed They are lobbying for a circuit rider position Joseph Lynch asked Ms. Mackin if the commission, and/or the Town stands a better chance to secure state and federal grant funding as a result of the new EOEA Watershed Basis Ms Mackin responded that it does not work against the town It would work more in favor of the Town. The town would have two chances out of five, rather than one (North Andover is located within two of the five watersheds in the North East 1 4 , North Andover Conservation Commission November 20, 1996 DEP Region In the Past North Andover stood by itself as one town against all other cities and towns► The benefit is to two watersheds Mr Lynch cautiously noted that being a very small part of two large watersheds (the Ipswich and Merrimack Rivers) could possibly not bode well for future grant acquisition for the Town The commission thanked Ms Mackin for her work and interest in the watersheds Filing Fee Expenditure, Trails Committee - Osgood Hill Trails Maps Michael Goransky, Chairman of the Trails Committee addressed the commission Mr. Gonansky displayed a North Andover Osgood Hills Trails Map before the commission and the public Mr Gonansky is requesting approval from the commission to appropriate $20O from the filing fee account to fund the trails maps to include services and publishing with art work In addition, the CADD Disk has been forwarded to the Conservation Office for future modifications The maps are to be made available to the public and used by people as trail guidance Motion by George Reich to appropriate $20O from the Filing Fee Account to fund the Osgood Hill Trails Maps, second by Deborah Feltovic Vote 4.0.0 Mr Mansour not present Mr Gonansky stated that last Saturday was a Boy Scout work day at Mazurenko Farm Approximately 40 young men from Cub Scouts Pack 87 participated, along with their parents and family Brush clearing was performed George Reich commended Mr Gonansky for the great lob he does General Announcement: Chairman Lynch informed the public that several requests for continuances from tonight's meeting to later dates are before the commission Lot 108 Chestnut Street, requested by Merrimack Engineering, Lot 33 Innis Street, requested by Stonehill Environmental, Lot 1A Rocky Brook Road, requested by Thomas Neve Associates, and Lot 19 Rocky Brook Road, requested by Thomas Neve Associates Mr Lynch stated that although each applicant has requested continuances, the commission must vote to grant, or not grant, every and all such requests He asked if there were any abutters present for any of these filings There were several abutters present 242-718 Bond Reduction Lots 1-14 Hidden Pond Road Thomas Neve of Neve Associates appeared before the commission The applicant is David Kindred. Mr Neve contends that Mr Howard inspected the site and it is in compliance Mr Neve stated that there was an issue because of the severe rain storm that occurred in October Mr William P Martineau of 577 Foster Street sent a letter to the commission claiming the crossing was altered and because of the altering he now gets more water upon his property Mr Lynch noted that Mr Martineau's property and the neighboring vacant land owned by his sister Karen 2 1 North Andover Conservation Commission November 20, 1996 Martineau, was itself the subject of debate not more than two years ago when the Martmeaus sought permission of the NACC to construct a home upon the Karen Martineau land At that time permission was denied the Martineaus because of the well documented repeated flooding upon their land Mr. Lynch noted that the prior proceedings and prior historic flooding all occurred prior to even the proposal of the Hidden Pond Development Mr Lynch stated the Martineau site clearly did flood in the recent storm event Mr Lynch stated that a number of letters and five telephone messages from other abutters in that area were logged by the Conservation Office during the storm event Mr Neve stated the recent storm is once every 100 years The storm gives them an opportunity to monitor their work Mr Lynch corrected Mr Neve as to the proper definition of a "100 year storm event", as his definition offered is incorrect Mr Lynch did agree with Mr Neve that storms such as the one we recently experienced does allow a rare opportunity for communities to assess stormwater management designs and analysis under actual severe storm conditions Mr Neve asserts that his calculations were pretty accurate as far as actual limits floodplain He stated he is pleased with the development of the design He stated the culverts were designed as close as one can get, within tenths of a foot in calculation The system was calculated for water flow They identified pre- existing flow patterns The culvert was designed to allow water to overtop the crossing, thus mimicking the pre-development water flow. They considered both upstream and downstream property impact in completing their design Mr Neve stated he is pleased with the systems as they functioned as designed during the storm Chairman Lynch read Mr Martineau's letter dated October 26, 1996 Mr Martineau is present this evening Mr Neve contends that during the peak of the storm they observed 1' to 1 5' of water on the new roadway at the low point The elevations ranged from 122 6' to 1241' Mr Neve states that this elevation is exactly equal to that that existed under pre-development conditions Therefore the design is proper Mr Martineau stated that he is present this evening to request the commission to take action to correct the flooding problem He stated there is an 18" concrete berm was built to hold water back Debris clogs the spillway, it backs up and floods people up stream He stated that the storm of 1987 brought water up to his garage This storm brought water into his home, an increase of approximately 1 5'. Mr Neve stated that the storm in 1987 was the last observed 100-year storm event The October storm was 30% more Mr Neve stated that the October storm came close to a 500-year event Mr Lynch cautioned Mr Neve as to his comparison of the 1987 and 1996 storm events. Mr Neve is oversimplifying a very complex hydrological theory for the sake of the public "understanding" Mr Lynch also corrected Mr Neve as to the fact that no statistic are yet available as to whether the recent storm was less than, equal to, or greater than, the 100 year storm event No suggestion as to approximation of a 500 year event has been made by anybody other than Neve this evening 3 North Andover Conservation Commission November 20, 1996 Mr Martineau stated he had water in his basement early into the storm Joseph Lynch of Foster Street (unrelated to the NACC Chairman) stated that in 1987 he did not get water in his basement This time he did He requests the commission to consider the area that is feeding into his area He requested larger pipes be installed in the new roadway to alleviate upstream flooding Mr. Neve stated the drainage conditions after development should mimic pre-construction, not allow it to be greater The drainage reviews are performed by outside drainage consultants hired by Conservation Commission Robert L Mansour arrived at 7 45 P M Mr. Neve stated the issue before the commission is a bond reduction Chairman Lynch stated that before any bond reduction is addressed it must be determined that what was built was called for under the approved OCC Mr Lynch stated until an as-built plan of the crossing is submitted for review the commission is not prepared to discuss a bond reduction Mr Kindred has received one prior bond reduction The original bond was $60,000 reduced by $30,000 in October, 1995 The commission is currently holding $30,000 George Reich agrees that an as-built plan be provided Deborah Feltovic concurs Mr Neve stated he will provide a detailed as-built Mr Martineau requested a compromise He requested removal of the concrete berm and enlargement of the hole Mr Neve stated that they cannot change the size of the culvert He will maintain the brook as long as it is on their property Mr Lynch reiterated, To now alter the roadway crossing culvert would be contrary to laws governing Zero Net Runoff and would completely abandon the diligent analysis reviewed under the original NOI Mr Lynch stated there was no doubt that a bigger, wider culvert would pass water more readily, and therefore mitigate upstream flooding But, Mr. Lynch cautioned, a bigger, wider culvert would only move the pre-existing upstream flood condition to a previously minimally affected downstream location Net Zero Runoff principals exist to prevent exactly that from occurringi Mr Neve requested to withdraw the bond reduction request and he will provide an as-built plan and request the bond reduction at a later date The commission agreed to the withdrawal 242.717, Lot B (#70) Summer Street, Certificate of Compliance Chairman Lynch stated there is no recommendation from Mr Howard regarding this file The applicant, James P Demetri , Evergreen Management, requested the Certificate of Compliance No one is present to appear 4 North Andover Conservation Commission November 20, 1996 before the commission The Order of Conditions clearly state that a letter from a Registered Professional Civil Engineer or Land Surveyor certifying compliance is required No letter has been received Motion by George Reich to DENY the Request for a Certificate of Compliance as no letter from the engineer has been provided to the commission, second by Scott Masse Vote 5-0-0 242-671, Lot E1 (#60) Willow Street, Certificate of Compliance James Bourgeois of Thomas E Neve Associates was present before the commission as was Greg Wiech of Channel Building Jim Bourgeois spoke ever so quietly that no one could hear Donna Mae is aware that there is no proof of recording of the Order of Conditions as required in Item 17 of said Order dated October 27, 1993 (by the way $50 00 shall be charged for each request for a CDC after the first such request is denied) .. James Bourgeois requested continuance of this request to December 4, 1996 in order to obtain recording information Motion by George Reich to accept the request to Continue to December 4, 1996, second by Deborah Feltovic Vote. 5.0-0 242.538, Lot 3A Willow Street, Certificate of Compliance James Bourgeois of Thomas E Neve Associates was present before the commission as was Greg Wiech of Channel Budding Chairman Lynch noted that there is an as-built plan submitted and that the plan has not been reviewed for substantial compliance under the OCC The plan must be reviewed Mr Wiech requested a continuance to December 4, 1996 allowing time for review of the plan Motion by George Reich to accept the request to Continue to December 4, 1996, second by Deborah Feltovic Vote 5-0.0 5 North Andover Conservation Commission November 20, 1996 242.647 Lot A 351 Willow Street James Bourgeois of Thomas E Neve Associates was present before the commission Chairman Lynch stated that an inspection of the site shows that the site is stable, an as-built plan and a P E letter have been received and reviewed The as-built plan shows that the site is substantially in compliance with the OCC and therefore, recommends issuance of the Certificate of Compliance Motion by Robert L Mansour to Issue the Certificate of Compliance, second by George L Reich Vote 5-0.0 242.593, Lot 1, 95 Old Cart Way, Partial Certificate of Compliance Chairman Lynch stated that an inspection of the site shows that the site is stable and he is in receipt of an as-built plan and P E letter Although the site is stable, a retaining wall was constructed within 25' of a bordering vegetated wetland The commission reviewed the as-built plan There is no waiver from the No- disturbance Zone George Reich has a concern with the engineer's stamp on the plan Motion by George L Reich to DENY the request for a Partial Certificate of Compliance for Lot 1, 95 Old Cart Way and Issue an Enforcement Order requiring the owner construct the property in accordance with the plans and requiring that the certifying engineer of record, Jeffrey S Hofmann, to come before the conservation commission at their next scheduled meeting on December 4, second by Robert L Mansour. Reich to DENY the request for a Partial Certificate of Compliance for Lot 2A, 121 Old Cart Way and Issue an Enforcement Order requiring the owner construct the property in accordance with the plans and requiring that the certifying engineer of record, Jeffrey S Hofmann, to come before the conservation commission at their next scheduled meeting on December 4, second by Robert L Mansour Vote 5-0-0 6 North Andover Conservation Commission November 20, 1996 242-634, 1737 Turnpike Street, Woodland Estates, Modification_I Violation Neither the applicant (Aurele Cormier) nor the engineer (Peter Ogren) are present to request a Modification to the Order of Conditions A structure was built between 4 and 7 feet over the 50' no-construction zone. The 25' no-cut and the 50' no-disturbance were both violated Motion by Robert Mansour to Issue a Violation Notice requiring the Engineer and the Applicant to appear at the next conservation commission meeting scheduled for December 4, 1996, Amendment by Scott Masse to also to fine the applicant up to the full extend allowed under the Local Bylaw; That being $300 per day from the date Mr. Howard notified Mr Cormier of the violation, second by Deborah Feltovic Vote- 5.0.0 PUBLIC HEARINGS: 242.832, Lot 108 Chestnut Street/Wesley Street, Continued from 1116196 Chairman Lynch informed the public that the engineer, Merrimack Engineering Services, Inc requested a continuance to December 4, 1996 The public hearing was continued from the November 6, 1996 meeting for revised plans The revised plans were delivered to the meeting this evening The plans have not been reviewed The wetland line has not been confirmed Motion by George L Reich to Continue to December 4, 1996, second by Deborah Feltovic for discussion Scott Masse stated that he is very concerned with the lack of timeliness in an applicants request to continue The request was faxed to the Conservation Office at the close of today's municipal business Mr Masse notes that the engineer is not present to request the continuance in person and must simply assume that he will be grant a continuance Julie Parrino stated Mr Howard had problems with the wetland line as it has not yet been accpted by the applicant Mr Howard did not agree with what was originally presented on the NOI and has noted that a number of flags must be reloacted to accurately depict the true limits of the resource area Robert Mansour stated that it is wrong for an applicant to request a continuance the day of the hearing and he is in favor of denying the request to continue Vote In favor 0, Opposed 5 Motion failed. Chairman Lynch stated the motion failed The public hearing will continue this evening as posted and with the information filed with the NOI Mr. Lynch called for the applicant or his representative to step forward and be heard in the matter No person stepped forward Mr Lynch again called for the applicant to step forward. Mr. Lynch asked that the record reflect that no person was present to represent the applicant in presenting there case and therefore is unable to provide the necessary information, required by statute. 7 North Andover Conservation Commission November 20, 1996 Abutter Bill Buco of 465 Chestnut Street stated he built his home 10 years ago The parcel before the commission (Lot 108) is below his parcel He contends that he was told 10 years ago the parcel (Lot 108) was unbuddable Mr Lynch asked Mr Buso if such a statement was made by a town official. Mr Buco responded, it was made by a former member of the Conservation Commission. Mr Lynch noted that understanding what Mr Buco was told ten years has no being on this evening's proceedings That the land might well be buildable for something, and that it is up to an applicant to propose what they think is a buildable plan Robert Mansour read the letter from Merrimack Engineering requesting a two-week continuance Mr Mansour stated that Mr Stapinski stated at the November 6, 1996 meeting that he would be prepared for this meeting and he is not present and the revised plans were submitted this evening Joseph Lynch reviewed the plan and compared it to Mr Howard's recommendation Mr Lynch stated the now revised plan still does not reflect Mr. Howard's recommendation location of the resource are line Motion by Robert L Mansour to Close the Public Hearing and Issue a Decision within 21 Days, second by Scott Masse Vote 5.0.0 242.834, Merrimack College Campus, Turnpike Street, Continued from 1116196 The outstanding issue was the confirmation of the wetland line Joseph Cushing, Michael Howard, Richard Kaminski and Joseph Lynch met on site and a number of adjustments to the line were made The revised plans were submitted and they reflect the relocated flags The existing budding is 3,200 s f and the proposed garage budding will add another 2,250 s.f The plan reflects the existing and proposed utility lines There is an additional vegetated wetland resource area (juristictional under the local by-law) located between the condos and the proposed garage The plans have been modified to reflect the new resource area Mr Kaminski stated he reviewed the town consultant's comments and they are reflected in the revised plan Pollution issues have been addressed by bringing the site up in elevation A 2 1 replication will be provided Mr Howard will determine where on site a replication area will work when he returns from vacation Mr Lynch stated that Mr Howard will not design the replication as it is the burden of the applicant to do his own work Mr Howard, will however, review the proposed replication area with Mr Cushing A basin outlet structure plan and an oil separator plan were presented to the commission Discussion continued regarding boring 3A and 3B (See log on the plans) Mr Mansour stated the water table in that area is extremely high Mr Cushing responded that there is a vegetation assessment on the plan Mr Kaminski stated the bottom of the basin is below the water level. Mr Mansour stated the detention basins appear to be below the water table Mr Kaminski stated he will take a boring and shoot the elevation to determine the groundwater table if it is above 239' he will do something else Mr Mansour stated the bottom of the pond is at 237' and the structure is at 239' Mr Mansour feels the structure may be flowing constantly and may be a loss of flood storage capacity 8 North Andover Conservation Commission November 20, 1996 Mr. Cushing will provide a plan showing how gas will be contained in the garage area should there be a leak Chairman Lynch requested de-watering submittal to the commission as part of the public hearing since dewatering will most certainly be required and could pose impacts to resource areas At the lowest point the invert pipe is at 236 32'. Mr Kaminski stated he will check the drainage calculations Chairman Lynch stated an November 11 the water was down 4" below the surface There was no standing water upon the surface of the site given the storm that recently occurred Mr Lynch stated he spoke to the town's consultant regarding that issue Mr Kaminski would like to use a backhoe in the detention pond area rather than boring Chairman Lynch prefers less impact and beleives, based upon his on-site observations, that if he digs down to a shallow depth with a shovel, he'll hit the water table Mr Richard Garvey of Foxhdl Road, Andover addressed the commission and stated that on the U S Geological Map, there is a buried pond that goes past McLay's, past Osco Drugs into the area where the proposed budding is going. Elm Street (Andover) floods four times per year January 5 to January 15, in July it floods, in December there is more flooding There are several Andover residents present Mr Garvey stated the boys' dorm was flooded during the last storm He stated that three years ago, water rose and destroyed cars He contends the Infirmary was built in the brook and he feels it should not have been built Mr Cushing stated that Mr Garvey is incorrect in sugesting the path of water flows Mr. Cushing maintains that the water flows from this site in North Andover into Rogers Brook in Andover Waters from Will Street and McLay's flows in the oposite direction to Mosquito Brook, thence southerly to the Ipswich River Mr. Cushing stated that Merrimack College and Richard Kaminski plan to meet to correct their drainage problems A flooding condition exists now, they cannot make it worse, they are diverting the water Most of Rogers Brook is underground Outstanding issues Mr Howard is to review the resource area, require 2 1 restoration working with Mr Howard, water table elevation, alternative ways to address pollution Motion by George L Reich to Continue to December 18, 1996, second by Deborah Feltovic Vote- 5.0.0 242.835 Lot 18 Beaver Brook Road Continued from November 6 1996 Phil Christiansen of Christiansen & Sergi revised the plans and presented them to the commission The DEP number was issued Mr Lynch noted there are no outstanding issues and recommends closing the public hearing There are no abutters present Motion by Robert L Mansour to Close the Public Hearing and Issue a Decision within 21 Days, second by Deborah Feltovic. Vote. 5.0-0. 9 4 � North Andover Conservation Commission November 20, 1996 242-836 Lot 5 Pheasant Brook Road Continued from November 6 1996 Phil Christiansen of Christiansen & Sergi stated the site was flagged Steve D'Urso and Leah Basbanes determined the wetland line At issue is the driveway, vernal pools and isolated wetlands It is not determined if it is in the 25' no-cut zone D'Urso's line differs from Basbanes line Clarification from Mr Howard is needed Mr Christiansen requested a continuance so he can discuss the issue with Mr Howard No abutters are present Mr Howard's recommendations are opposed to the modification request and waivers of the 25'150' setbacks Motion by George L Reich to Continue to December 4, 1996, second by Deborah Feltovic Vote 2-3-0 Mr Lynch, Mr Masse and Mr Mansour opposed Motion failed Mr Christiansen stated it is not fair to the applicant as they were not notified of any vernal pool At the last meeting the commission continued the public hearing without any discussion Mr Christiansen feels the applicant has the right to discuss the concerns with Mr Howard Motion by George Reich to Reconsider the Motion to Continue to December 4, 1996, second by Deborah Feltovic Vote 5.0.0 Motion by George Reich to Continue to December 4, 1996, second by Deborah Feltovic Vote 4-1-0 Mr opposed Scott Masse feels Mr Howard will not change his comments Julie Parrino stated the pools were identified two years ago The applicant's edge of vernal pool was the approved edge of the wetland , 25 Gilman Lane, Continued from 1116196 Scott Giles is present before the commission The applicant is requesting to construct an addition within the 100' buffer zone of a bordering vegetated wetland He stated that Steve D'Urso reviewed the wetland line. In Mr Howard's recommendations, he states that the delineation depicted on the plan is accurate and the applicant has agreed to restore a previously disturbed vegetated wetland The plan was reviewed by the Commission A waiver of the 25' No-cut and the 50' No-build zone is requested Mr Carl Milander is the applicant and is present this evening Mr Milander cut trees near the wetland A second wetland was located along the rear corner of the property and in close proximity to recently cut trees Trees were cut near wetland series 101 through 111 The applicant is proposing an addition within 21' of wetland flag 104 The existing house is within 40'. Mr. Milander stated he purchased the home with the idea of adding an addition onto it. He stated is was unaware of any No-cut zone. He contends the trees he cut in the back area were rotted. Chairman Lynch informed Mr Milander of the 25'150' zones. Mr Milander stated he will not cut anymore trees. Chairman Lynch advised Mr Milander to speak with Mr Howard Chairman Lynch reviewed the house location on the plan The septic system is not reflected on the plan The 10 4 . North Andover Conservation Commission November 20, 1996 existing lawn is running along the wetland edge. Deborah Feltovic left the meeting at 10 30 P M Robert L Mansour recommends a site walk be conducted There is no DEP number The waiver is for 29'. Mr Milander stated he will not be present at the December 4, 1996 meeting as he is leaving for Florida on December 3 Scott Giles will be present for the December 4 meeting The commission will conduct a site walk Motion by Robert L Mansour to Continue to December 4, 1996, second by George L.
