MINUTES
Motion by D Feltovic to accept the minutes of June 7 1995, second
by J Mottola Vote unanimous
242-585, Status Report, North Andover Heights/Estates
Patrick D Seekamp of Wetlands Preservation appeared before the
commission Mr Dan Bernatas of Toll Brothers was present Mr
Seekamp provided she commission with a report dated June 15 1995
Lengthy discussion regarding Detention Ponds, Wetland Replication
Areas, Top of the Hall Loam Pile, Old Access Road Vernal Pool
The coding for wetland replication areas on the plan is designated
as Area #1, Area #2A Area #2B Area 3
J Lynch stated tqe calculations appear accurate Patrick Seekamp
will provide M Howard with outline prior to construction
Motion by R Mansour to Issue Minor Modification for Work on
Detention Ponds, second by D Feltovic Vote unanimous
242-650, Certificate of Compliance, Lot 64 Blue Ridge Road
Mr Mark Rae of Belford Construction was present Mr Scott Gales
addressed the commission He presented a plan dated February 25,
1993 The plan does not show the 25 ' no-cut zone nor 50 ' no-build
zone The as-built plan submitted this evening dated May 9 1995
differs from the original plan of February 1993
M Howard stated the site is stable At the time the Order of
Conditions was issued, a wall was required M Howard stated
although the wall was not built as designed, it is stable and he
recommends compl_ance

Motion by R Mansour to Issue a Certificate of Compliance and
release the remainder of the Bond, which is $3 500 second by D
Feltovic Vote unanimous
242-701, Lot 10A Pine Ridge Road, Bond Reduction
Benjamin Osgood, Jr was present before the commission The
request is to reduce the bond The original bond was in the amount
Of $5 000 On December 21, 1994 the Bond was reduced to $3 000
The home is landscaped The as-built survey will be provided
tomorrow M Howard stated the site is not stable and recommends
the bond be reduced to $1,000
Motion by R Mansour to Reduce the Bond from $3 000 to $1 000
second by W Gangl Vote unanimous

Benjamin Osgood, Jr was present before the commission The
commission reviewed the as-built plan M Howard recommends
compliance
Motion by R Mansour to issue a Certificate of Compliance, second

242-720, 149 Lancaster Road, Lot 41, Pool - Certificate of
Compliance
Scott Giles was present before the commission The request is for
a Certificate of Compliance for the construction of an in-ground
swimming pool The commission reviewed the as-built plan The
pool apron is 471 from the limit of Bordering Vegetated Wetlands
(BVW) and encroaches into the 50' "No-build Zone"
Motion by J Mottola to issue a Certificate of Compliance second
by D Feltovic tote 2-3-0, R Mansour opposed J Lynch opposed
W Gangl opposed Request DENIED as the pool encroaches into the
50' no-build zone

Certificate of Compliance
Scott Giles was present before the commission The request is for
a Certificate of Compliance for the construction of a single family
home in the buffer zone The commission reviewed the as-built
plan

Scott Giles was present before the Commission The request is for
a Certificate of Compliance for a single family home located at Lot
44 Lancaster Road The commission reviewed the as-built plan M
Howard recommends compliance
Motion by R Mansour to Issue a Certificate of Compliance second
by W Gangl Vote unanimous
Request for Determination - 111 Campbell Road, Lot 5
The applicant is Mark Buchta The request is to install a
replacement septic system within 78 ' of a resource area M Howard
addressed the commission M Howard recommends Negative
Determination with conditions
Motion by W Gangl to Issue a Negative Determination with the
following conditions Haybales/silt fencing to be established and
inspected by the Natural Resource Land Use Planner prior to
initiating construction and submit plan with revised Wetland
Delineation, second by D Feltovic Vote unanimous
Request for Determination - 167 Duncan Drive, Lot 8
The applicants are John and Debbie Finn The request is to replace
a failing septic system Ben3amin Osgood Jr was present before
the commission The commission reviewed the revised plans The
plan showed erosion control Mr Osgood stated he is a certified
septic system inspector There will be no stockpiling of soil on-
site The trench is 60' from the wetland The well is in the
rear Haybales will be placed The existing system is in the same
location Abutter, Scanlon, reviewed the plans
Motion by W Gangl to Issue Negative Determination with the
following conditions Haybales/silt fencing to be established and
inspected by the Natural Resource Land Use Planner prior to
initiating construction, second by D Feltovic Vote unanimous
Notice of Intent
242-757, Boxford St , east of 279, R Janusz, Cont from 6/7
Request of Robert Janusz to construct a road together with
appurtenances including the construction of retention and detention
ponds to service a 27 lot residential subdivision Thomas E Neve
the engineer lain out plans before the commission A Planned
Residential Development (PRD) is planned J Lynch inquired of the
applicant why he did not come before the commission with the
demonstration plan used to calculate the PRD density The
applicant responded that the density was addressed at the TRC

Meeting The areas shown on the plan in green and orange will be
pledged to open space There is a total of 96 acres Twenty-eight
acres will be developed The remaining acres will be conveyed to
the town The applicant is requesting a waiver of the 25' no-cut
requirement in order to install the retention pond and to install
the roadway side slopes No lots will require waivers They are
proposing 1 5 to 1 rip rap slope Discussion ensued pertaining to
alternative slope treatment Options to be explored include the
use of retaining walls or geo-grid Thomas Neve agrees to prepare
different design alternatives for the next meeting M Howard
stated the A82 flag was relocated Elsie Pouliot was present and
reviewed the plan
Thomas Neve stated he can provide the 250 no-cut but he will have
to build 6 ' to 8 " high 125' long retaining wall He stated he
refuses to lose a lot J Lynch raised the issue that since the
project is a PRD and that the commission never reviewed
demonstration plan the lot never officially existed A double row
of haybales will be installed All land will be stripped out when
the slope is built A 40-ton compactor will be used for roadway
The entrance of the road is the concern of the commission
Alternatives to the entrance will be provided to the commission
R Mansour requested a larger scale plan showing the entrance to
the roadway and Lots 27 & 26 R Mansour suggested the
keystone/keylock system be used rather than concrete M Howard
stated the flood elevation is not shown on the plan
The houses will be separate filings if needed The request before
the commission is for the roadway section as shown on the plan A
detailed plan will be presented to the commission at the July 5,
1995 meeting

242-6270 Modify O=der of Conditions, Lot 15 Carriage Chase
M Howard presented plans to commission The commission reviewed
the plans with the revision date of 5/1/95 The plan details a
proposed yard drain
Motion by D Feltovic to Issue a Modification to the Order of
Conditions, with the following conditions The site is to be
approved by the Natural Resource Land Use Planner Perimeter Drain
Only No Connection to the House or Pool, second by W Gangl Vote
3-0-1, R Mansour opposed

M. Howard presented plans to the commission for review. The plans
were discussed. M. Howard recommended compliance.
Motion by R. Manscur to Issue the Certificate of Compliance, second
by D. Feltovic. Vote: 4-0-0.
242-304, Certificate of Compliance, Lot 11 Salem Street
M. Howard presented plans to the commission for review. The plans
were discussed. M. Howard recommended compliance.
Motion by R. Manscur to Issue the Certificate of Compliance, second
by D. Feltovic. Vote: 4-0-0.
242-158, Certificate of Compliance, Lot 24A Blue Ridge Road
M. Howard addressed the commission. He recommended partial
compliance for Lot 24A Blue Ridge Road only. This lot is part of
the Bear Hill Subdivision.
Motion by R. Mansour to Issue the Certificate of Compliance for Lot
24A Blue Ridge Road, second by D. Feltovic. Vote: 4-0-0.
