Brentwood Circle, Louise I Borke - Gerald Brecher Mr Dan O'Connell 5f Christiansen & Sergi appeared before the North Andover Conservation Commission Page 3 August 2 1995 commission G Reich requested the proof of mailings to the abutters Mr O Connell explained that he does not have the certified receipts, but the applicant's representative Gerald Brecher, will be arriving shortly and may have the receipts Motion by R Mansour to table this request to later in the evening second by A Manzi Vote 6-0-0 242-760, Lot 13 Holly Ridge Road, (Deerfield Subdivision) Daniel O'Connell of Christiansen & Sergi was present before the commission Revised plans were submitted M Howard stated that he met with Wetlands Preservation Inc on July 31, 1995 to review the delineation M Howard stated that the plans submitted depict the on-site wetlands accurately Motion by J Lynch to Issue the Order of Conditions within 21 days second by D Feltorvic Vote 6-0-0 242-759 , Lot 94 Flagship Drive, Development Associates Chuck Caron of Ross Associates was present before the commission Revised colored p-an was displayed The wetland alteration has been eliminated The entrance has been re-configured, the light green area on the olan is the resource area The applicant is now proposing to expand an existing parking area for a commercial building within the 25 ' No-cut Zone of a BVW However no BVW will be disturbed Motion by J Lynch to Issue the Order of Conditions within 21 days, second by D Feltcvic Vote 6-0-0 Request for Determination, Lot 2 Brentwood Circle Mr Gerald Brecher addressed the commission with respect to the Notices to Abutters Mr Brecher informed the commission that he hand delivered the notice to each abutter listed on the certified list G Reich informed Mr Brecher that the local Bylaw requires that the applican': must mail a copy of the legal notice to the abutters via certified mail at least 7 days prior to the public hearing and proof of mailing must be provided to the commission Mr Brecher requested continuance of this hearing to August 16 1995 to allow him to notify the abutter via certified mail Motion by J Lynch to continue the request to August 16 1995 Boxford Street, east of 279, (Jerad IV) R Janusz The applicant's engineer, Thomas Neve Associates requested in their letter dated July 19 1995 to continue this hearing to August 2 1995 Neither the applicant nor the engineer are present at this time 242- , 443 Boston Street, Paul and Roberta Davis Mr Ben Osgood ,:r addressed the commission This Notice of Intent is for the replacement of a subsurface sewage disposal system The exis=ing leach field is in the water table and the applicant is proposing to raise it 4 ' above and meet the maximum feasible distance available from the edge of the wetlands which is 19 , The existing system is 23 ' from the wetlands The Board of Health will not allow the system to exist under a driveway therefore the homeowner is conceding a portion of the driveway and creating a turnaround area approximately 60' from the edge of the BVW The septic inspection was done according Title V rules The inspection on May 6, 1995 showed failure The well is located at the rear of the lot The septic system must be 100 ' from the well The shaded area on the plan is the new driveway The slope requirements are 15 ' from the edge of the system M Howard read a letter from the Board of Health Administrator dated August 2 1995 The letter states the site of the proposed septic system as shown on plan #030 by New England Engineering dated July 25 1995 is the best if not only location available Abutter, Irene Golden questioned the ground water elevation Mr Osgood stated the water elevation was done by the Board of Health Agent Mrs Golden asked about the flow of water G Reich stated the water was flowing back to the wetlands The water will flow to the left into a ditch Several abutters reviewed the plan with the commission Motion by J Lynch to Close the Public Hearing and Issue and Order of Conditions within 21 days of receipt of the DEP No , second by D Feltovic Vote 4-0-1 R Mansour abstained A Manzi not present 242-757 , Boxford Street, east of 279 , (Jerad IV) , R Janusz Neither the applicant nor the engineer are present M Howard addressed the commission Mr Howard stated the applicant submitted a letter dated July 19 1995 requesting continuance to this evening The commission instructed M Howard to send a letter North Andover Conservation Commission Page 5 August 2, 1995 to the Engineer to appear before the commission in two weeks
