NEGATIVE #3 DETERMINATION OF APPLICABILITY
FINDINGS &SPECIAL CONDITIONS
1.405 Basswood. Circle, North Andover
At the March 8, 2023 public hearing,the North Andover Conservation Commission (NACC)voted to issue a
Negative#3 Determination of Applicability approving the project subject to compliatice with below-listed
conditions for work at 1.405 Basswood Circle. The following is a description of site observations, and proposed
project overview:
The project involves the in-kind replacement of an existing 8'x 10'rear deck. In consultation with the project
engineer and the Building Commissioner, it was determined that the concrete footings would need to
be replaced for safety reasons.New footings will consist of helical anchors,which will be installed with a
sinall Piertecl Auger inachine, and old concrete footings will be abandoned in place to avoid ground
disturbance. This condo coniplex was part of a 40B subdivision,which put this deck outside of the 25'No-
Disturbance Zone(NDZ), but within the 50'No-Build Gone(NBZ). Based on Conservation Department
staffs measurements,the existing deck is located approximately 35-feet from the BVW at its closest point,
the wetland is at the bottom of riprap slope on one side and at the bottom of a vegetated slope oil the other
side.
*Note: Due to their close proximity to the deck and failing health,the NACC also voted to approve the
removal of two(2)Oak tree/Quercus spp. saplings (one a double stenuned tree and the other a single stem).
No stump grinding shall take place, and the root system shall be left in tact. Both trees are located within.
the 50-foot No-Build Gone(NBC). See attached photos of the trees approved for removal below.

1. Pre-construction ineeting with the Conservation Department and contractor shall be scheduled
to review conditions of this permit,means and methods of work to be perforined & inspection of installed
erosion controls(8" mulch socks-staked & overlapped).
2. Dunipster for demo materials shall be placed oil the paved driveway.

The applicant,and their contractors are advised that NO other work on the property is allowed under
this permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot buffer zones on site
and any work that involves f!round disturbance or than ginLy the current conditions in these areas will
requil-e vermittinu with the NACC. This includes, but are not limited to, house additions, pools,patios,
decks,sheds, fences arden beds,landsca pin L,and brill e installation,tree or vegetation cutfing/pruning.
These activities shall be held to the current standards under the Bylaw and WPA.

Pursuant tothe authority ofK0.G.Lu 131, § 4O. the Conservation Commission considered Your
Request for Determination of Applicability, with its supporting docurnentation, and made the following
Determination.
Project Description (if applicable):

Note: No further action under the Wetlands Protection Act is required by the applicant. However, if the
Department is requested to issue a Superseding Determination of Applicability, work may not proceed

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see https://www.mass.gov/service-detaiIs/massdep-reqionaI-offices-by-
community)to issue a Superseding Determination of Applicability. The request Must be made by certified
mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal Form (see
Request for Departmental Action Fee Transmittal Form) as provided in 310 CMR 10.03(7)within ten
business days from the date of issuance of this Determination. A copy of the request shall at the same
time be sent by certified mail or hand delivery to the Conservation Commission and to the applicant if
he/she is not the appellant. The request shall state clearly and concisely the objections to the
Determination which is being appealed. To the extent that the Determination is based on a municipal
ordinance or bylaw and not on the Massachusetts Wetlands Protection Act or regulations, the Department
of Environmental Protection has no appellate jurisdiction.
