N.Andover,James Cyrier,Trustee 002 ADDRESS: for premises at: 500 Sutton Street PETITION: 2002-045 North Andover,MA 01845 -TYPING DATE: 11/14/02 The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,November 12,2002 at 7:30 PM upon the application of Lighthouse Realty Trust, 109 Blue Ridge Road,North Andover,James Cyrier, Trustee, for premises at 500 Sutton Street,North Andover requesting a Special Permit'from Section 9,Paragraph 9.1 to allow for the construction of a proposed mixed commercial/office building on a non-conforming lot (Lawrence Municipal Airport),with frontage on the North side of Sutton Street within the Industrial 2(1-2)zoning district, The following members were present: William J. Sullivan,Walter F. Soule,Robert P.Ford,Scott A. KarpinskL Ellen P,McIntyre,George M.-Earley,and Joseph D,LaGrasse. Upon a motion by Waiter F.Soule and 2°4 by Scott A.Karpkwki,the Board voted to GRANT the Special Permit from Section 9,-,Paragraph 9.1 allowing the construction of a mixed commercial/office building on a non-eonformrng lot(Lawrence Municipal Airport)per Special Permit Site Plan for North Andover Business Center,$00 Sutton Street,North.Aldover,.Mmachus"Ql845,prepared for:Lighthouse Realty Trgst,,1.09,.131ue Ridge Road,North. . Andover,.Massachusetts 01845 by UW Design Consultants,Inc., 103 Stiles Road,Suite One,Salem,New Hampshire 03079,dated September 11,2002;Sheets 1-5 on the condition that the applicant abides by Section 8.1 (Off-Street Parking)regulations regarding parking space requirements according to tenant usage as determined by the Building Commissioner. The Building Commissioner shall not issue a Building Permit for any tenant fit-up if parking as shown on the referred plan is not available. Additionally,there will not be any parking in front of roll-up doors. The.Board accepts the applicant's offer to landscape the median and both sides of the access road,in accordance with Planning Board requirements. Voting in favor: Walter F. Soule,Scott A.Karpinski,Ellen P. McIntyre,George M.Earley,and Joseph D.LaGrasse. William•J.Sullivan abstained. The Board finds that the applicant has satisfied the provisions of Section 9,Paragraphs 9.1 &9.2 of the zoning bylaw and that such addition,change,extension or alteration shall not be substantially more detrimental to the neighborhood, Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the gram,it shall lapse,and may be re-established only after notice,and a new hearing.
