Dear Mr. Osgood: I hereby apply for a variance from Title V, State Environmental Code , Section 15 .03 , Distance of inground swimming pool from leaching area of subsurface r l T to my u fa e oewc.rage disposal system. 1 want place the pool 10 feet instead of the required 20 feet . My property has a large rise in the land between my land and that of the lot on the road in the rear. This compromises the installation of the pool at 20 feet and would necessitate the removal of the hill . I feel the reduction to 10 feet would not have adverse effect on the septic system. Dear Mr. Reming: This Board voted at its meeting of Sep. 9, 1985 to grant your request for a variance from Title V, Section 15 .03, Distance of Inground Pool From Leaching Area of subsurface disposal system. The variance allows construction of the pool within ten feet of the leaching area instead of the usually required twenty feet. As required in Title V, a copy of this variance is being submitted to the DEQE for their consideration. They are allowed thirty days to reply and no construction can be started until this time has expired or they have replied to the notice . Gentlemen: The Metropolitan Boston/Northeast Regional Office, Division of Water Pollution Control, of the Department of Environmental Quality Engineering is in receipt of your letter, dated September 10, 1985, notifying the Department that the North Andover Board of Health had granted a variance to the provisions of 310 CMR 15.03:7 (Title 5) of the State Environmental Code for the subject site. Specifically, the variance granted pertained to a lesser horizontal distance (10 feet) separation between leaching facilities and a proposed in-ground swisnaing pool instead of the 20 foot requirement contained by the provisions of Title 5. Accompanying the notification is a copy of an "As Built" subsurface disposal system and a topographic plan noting the existing active and Reserve Leaching Facilities. Be advised that a plan, noting the exact location of the proposed swimming pool, must be submitted to the Department for review. Until such plan is received, the Department cannot respond to the variance granted by the North Andover Board of Health. If additional information is required, contact torn F. Electric: An electrical permit must be obtained prior to an application for a building permit to install a pool. 2. Zoning: Pools shall be located to the rear of the front building line of the house and no closer than 10 feet to the side or rear lot line. 3. Health: A. Location from subsurface disposal system must be approved by the Board of Health. B. Semi-public and public pools must have plans approved by Board of Health prior to construction and must also have, an annual operating permit from the Board of Health. 4• Safety: Pools must be enclosed by a suitable wall or fence at least 4 feet in height that meets the approval of the Building Inspector. No water allowed in pool until fence is erected. Pool cannot be used until inspected and approved by the Electrical Inspector and Building Inspector. CHARLES H.
