Premises Affected: 115 Dale Street, North Andover, MA 01845, Map 37.13, Parcel 15,
within the R-1 zoning district.'
HISTORY AND BACKGROUND
On April 17, 2023 the applicant requested a waiver of the Watershed Protection District Special
Permit, in accordance with the North Andover Zoning Bylaw Article 4 Section 195-4,24. Waiver
of Special Permit, so as to allow construction of a new 22' x 17' deck within the Non-Discharge'
Buffer Zone. Wetlands are located approximately 130' away from the proposed land disturbance.
The project proposes eight 12" concrete footings to be installed 4' deep and does not require any
vegetation removal or regrading..
FINDING OF FACT
The Planning Board has made its decision based on the following findings:
• The scope consists of installation of eight concrete footings,
• No vegetation removal or regrading is required,
• A waiver of the Watershed Protection District special permit is requested, due to the
absence of an entirely impervious structure or expansion thereof and the limited land
disturbance (as indicated in Section 195-4.24 of the North Andover Zoning Bylaw),
CONDITIONS
• A 12' mulch sock, staked at 4' intervals, will be installed at the limit of work prior to
building permit issuance.
• As required per §195-4,24 Waiver of special permit on the Zoning Bylaw,the applicant
must schedule and agree in writing for the Town Planner to perform a minimum of two
inspections during the construction process to ensure proper erosion control is
established during construction,
• A copy of the recorded Notice of Decision shall be delivered to the Planning
Department prior to building permit issuance.
• The Applicant shall incorporate the following conditions as a,deed restriction and a
copy of the recorded deed restriction shall be submitted to the Town Planner and
included in the file.

DECISION
After a Planning Board meeting on the above date, and upon a motion by J. Simons and 2nd by P.
Boynton a vote was taken with regard to a waiver of the Watershed Special Permit. The.vote was
4-0, unanimous in favor of the waiver.

This Declaration of Restriction is made and entered into as of this 27'h day of April, 2023, by Nicholas
DeSantis and Amy DeSantis(hereinafter"the owners")of 115 Dale Street, North Andover, MA 01845,
the owners of a certain parcel of land located at 115 Dale Street, North Andover, MA 01845 with the
deed referenced in Book 17013 Page ZQ4.
WHEREAS,the owners have applied to the Planning Board of the Town of North Andover for a
Watershed Special permit;
VVHERAS,the owners agree,for themselves,their successors and assigns,that:

Hello,
I am writing on behalf of the contractor,Valley Construction Services LLC, to obtain a waiver of special
permit for watershed and wetland requirements.The proposed construction involves renovations to an
existing porch, and construction of a new deck.The deck is 130' away from the nearest wetlands. See
attached plans for more information.
Considering that the property is located within the Watershed Protection District, there is possibility to
obtain a waiver request for these special permits.
We request a waiver. In addition,we grant the town planner the right to perform a minimum of(2)
inspections during the construction progress to ensure proper erosion control is established during
construction.The Town Planner can stop construction if the proper erosion control is not in place.
