At the May 10, 2023 and May 24, 2023 public hearings, the North Andover Conservation Commission
(NACC)reviewed the RDA application, and at the May 24t1r meeting,voted to issue a Negative #3
Determination of Applicability approving the project at 122 Millpond based on its findings set forth
below and subject to conditions listed below. The RDA application, filed by Tomas Zahoruiko of Zendko
I.,I.,C., proposed the following project elements: The project entails demolition of existing tennis courts,
gravel driveway, raised garden beds and construction of two new 2-family townhomes with associated
appurtenances on a—0,81 acre site. The wetland resource consists of a BV W located across Stevens
Street that projects the 100-foot BZ onto the subject site. Work within the BZ(between 50' and 100' from
the wetland) includes demolition of one of the tennis courts, loaming and seeding a majority of that.
footprint, and construction of one of the units that will have a small cornet protruding slightly into the
100' BZ. A construction entrance, dewatering and stockpile area are outside the BZ, and perimeter
erosion controls are proposed. The Storrnwater Report indicates a post construction reduction of
impervious surface by 6,500 s.f. -+-/- and overall reduction of peak flows in the 2, 10 and 100-year storm
events. A rain garden (out of BZ) is proposed between the units, designed to take the first 1" of roof
runoff. `The Planning Board endorsed and ANR in January 2023 and the ZBA issued an approval for a
Special Permit to construct multi-family housing in this zone in May of 2023.

The folluvvinf4 sl)ecial conditions are mandated:
1. A pre-MlStl'LlCti011 meeting with the applicant,contractor, engineer and wetland consultant (erosion control
monitor) shall be held with the Conservation Department to inspect installed erosion controls,construction
entrance and other site control BMPs, as well as review the proposed plan.
2. Erosion Control monitoring by a qualified wetland consultant or engineer shall be conducted after 1/2" rain
events to ensure all erosion control BMP's are functioning and being maintained properly. The EC
Monitor shall provide a report to the Conservation Department within 48 hours of said rain and monitoring
events.
3. Upon completion of all requirements,the Conservation Department shall be contacted to conduct a filial
site inspection.The conservation department will determine site stability and give permission for erosion
controls to be removed.

permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot buffer zones on site and any
work that involves ground disturbance or changing the current conditions in these areas will rec�ui_re,PeriYlitting with.
the NACC.This includes but are not limited to,house additions, pools, patios,decks, sheds, fences, gar(.ienbeds
landscapjng,jild brLdj;e installation, tree or vegetation Cllttillg/L)ftltling. These activities shall be held to the current
standards under the Bylaw and WPA.

Note: No work within the jurisdiction of the Wetlands Protection Act may proceed until a final Order of
Conditions (issued following submittal of a Notice of Intent or Abbreviated Notice of Intent) has been
received from the issuing authority(i.e., Conservation Commission or the Department of Environmental
Protection).

Note: No further action under the Wetlands Protection Act is required by the applicant. However, if

proceed on this project unless the Department fails to act on such request within 35 days of the
date the request|e post-marked for certified mail or hand delivered tothe Department. Work may
then proceed at the owner's risk only upon notice to the Department and to the Conservation
Commission. Requirements for requests for Superseding Determinations are listed at the end of
this document.

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work ka(obe done, or any ten residents of the city or town |n which such land
is located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see

1)to issue a Superseding Determination of Applicability. The request must be made by
certified mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal
Form (see Request for Departmental Action Fee Transmittal Form)as provided in 310 CMR 10.03(7)
within ten business days from the date of issuance of this Determination. A copy of the request shall at
the same time be sent by certified rnail or hand delivery to the Conservation Commission and to the |
