Dear Ms. Griffin:
Concerning the above captioned matter, I have enclosed herewith a revised last page of
Mr. Napoli's lease with the Lawrence Airport Commission. The Airport Commission agreed to
include Paragraph 28 regarding the prohibition of pesticides, fertilizers and chemicals used in
lawn care or maintenance, in this Lease. Kindly substitute this page for the signature page on the
Lease I previously provided to your office.
As discussed, Mr. Napoli cannot provide the Town with a deed restriction since this is
leased and not deeded laird. Accordingly, the prohibition in Mr. Napoli's Lease should provide
the same protection to the Town,
Kindly contact me at your earliest convenience in order that we may obtain the
Foundation Permit from the Building Department.

Dear Gentlemen:
By way of this letter, I hope to summarize the outcome of today's meeting attended by
each of you with your respective engineers, and me representing the Airport, I called for
the meeting to resolve any overlapping land use issues that may exist given the nature of
the two contiguous projects.
From the information exchanged, it is clear that as currently proposed, the Napoli
Trucking project encroaches on the Lighthouse project, It is agreed that the Napoli
Trucking project's design will be elongated along Clark Street, thereby removing any
overlap onto the Lighthouse project, It is my understanding that Napoli Trucking's
engineering firm of Christiansen & Sergi, will provide me with a revised site plan
incorporating the agreed upon changes,
I want to thank both of you for attending the meeting with your engineers so that we
could resolve any conflict(s). I am sure you both will agree that all parties will benefit
fi•om a smooth and efficient permitting process.

VUB sent out detailed comments to the Applicant's Engineer on March 4, 2003.
On March we received the Applicant's responses to VHB's comments.
The following drainage issues remain outstanding:
1) Drainage
- The Applicant must revise the HydroCAD model to reflect the site conditions and make any
necessary plan revisions based upon the new model.
- The Applicant must revise the grading area surrounding the detention pond to insure that any flow
overtopping the berm will be directed into the detention basin on site and will not impose on the
adjacent properties.
- The applicant must submit test pit data and show that the infiltration system maintains a minimum
2-foot separation between the bottom of an infiltration structure and the seasonal high groundwater
table.

1) On March 25, 2003, the Planning Board requested the Applicant to:
A) Clarify the 325 foot non-discharge line;
13) Address VHB's concerns regarding drainage; AND
C) Improve the landscaping and lighting plan.
The Applicant has submitted revised plans adjusting the 325 foot non-discharge line utilizing the same
information as the North Andover Business Park, added a landscaping berm,removed the 8ft fence,
and including a landscaping plan consisting of Austrian and Dark American Austrian Pines all around
the site.
2) Drainage
A) The Applicant revised the HydroCAD model reflect the site conditions and revise the,grading area
surrounding the detention pond to insure that any flow overtopping the berm will be directed into the
detention basin on site and will not impose on tho adjacent properties. The applicant also submitted
test pit data showing that the infiltration system maintains a minimum 2-foot separation between the
bottom of an infiltration structure and the seasonal high groundwater table. No further engineering
review is required at this time.
3) Provided that is satisfied with the landscaping plan submitted, staff recommends closing the public
hearing on April 8 and drafting a decision for review on April 22.

These plans are being filed under the requirements for Site Plan Review Section
8.3 of the North Andover Zoning Regulations and Section 4.136,4 Special Permit
Requirements for construction in the Watershed Protection District.
It is the intent of Louis Napoli,the applicant to build a contractors garage on a
leased parcel of land on the property of the Lawrence Airport. The plan has been
developed to show two proposed buildings, each with a floor area of 6000 square feet.
However, it is Mr. Napoli's intent to build only one building in the near term and to build
the second building at an undetermined future date.
This project has been proposed as a direct result of the enforcement of Zoning
regulations by the Building Inspector at the present site of Mr. Napoli's business at 52
Inglewood Street. The existing site is in a residential district and is not an allowed use.
When the construction at the Airport is finished it will be in conformance with zoning
and will allow Mr. Napoli to discontinue the present operation and eliminate the existing
zoning violation.

As a followup to your review letter, we dug soil test pits at the site
today. The parent material is a stoney sand. A substantially different soil
than that in the soils maps.
I will send you the results and add the location to the plan and give you an
infiltration rate based upon the soil type.
