In response to Coler and Colantonio's January 14, 1999 review letter, we offer the
following responses. We have attached a copy of the review letter and assigned a
letter to each issue.
A. Water Protection District:
The reviewer is correct. Only a small portion of the site falls within the Watershed
Protection District. As discussed with Kathleen, all of the stormwater from the
proposed site will flow to the Merrimack River. Stormwater will not flow to Lake
Cochichewick.
B. Landscaping:
The proposed parking area is located adjacent to the existing road right-of-way. We
have assumed that based on the TRC meeting on December 28'", the Planning
Board meeting on January 5", and the January 16' site walk that this is not an
issue.
C. Loading Areas:
The proposed loading areas are shown graphically on the Site Plan. We have
added a note stating the proposed number of loading areas to the plans.

D. Off-Site Contours:
As shown on the pre- and post-development watershed plans included in the
drainage study, we have calculated an area ranging from 00-100 feet wide that
contributes drainage to this site. Based on field observations we feel this is a fair
assumption.
E. Impervious Screen:
It is our interpretation of the ordinance that an impervious screen is meant to be
used when the area abuts a residential district. The parcels to the south are in a
General Business district. These parcels are separated by approximately thirty feet
(30') of existing vegetation and a significant grade difference. An impervious screen
in this area is not warranted.
F. Green Space:
The green space for the entire site (both parcels) has been shown on the Site Plan.
The parcel on the west side of Clark Street is well within the maximum lot coverage
of 35%. The maximum lot coverage percentage deals with primary and accessory
buildings.
G. Wetland Boundaries:
The North Andover Conservation Commission approved a request for a
Determination of Applicability on October 21, 1998.
H. Flagging at "Annex" Building:
We agree that this wetland line may be revised with additional flagging. Since we
were not proposing any work in this area, additional flagging was not performed.
I. Grading:
Grading in this area has been revised to remove grading within the 25' no
disturbance zone.

J. Access Drive Construction:
Portions of the access drive fall within the 50' no-build zone. It is our understanding
that this is allowed. We reviewed the site plan with Mike Howard at our preliminary
site walk on October 1, 1998. The access drive was acceptable as long as the 25'
no disturbance zone was not disturbed.
K. Stormwater Standards:
• Standard 1 -- No comment
• Standard 2 - We have revised the pre- and post-development drainage
calculations to include the TR-55 time of concentration worksheets. We have
also adjusted the conditions of woods from fair to good. We have modeled the
one-year storm event. The stage storage curves have been revised in the post-
development drainage calculations. An additional emergency spillway has been
added to the constructed wetland. This spillway has been designed to pass the
100 year storm assuming the primary outlet structure is plugged. The test pits
performed in the area of the constructed wetland were evaluated by Jaworski
Geotechnical, Inc. (JGI). JGI is a geotechnical engineer licensed in the state of
Massachusetts. Since these test pits were not being used for any Title V
applications a soil evaluator was not contracted.
• Standard 3 — Recharge has not been proposed due to the high groundwater
levels.
• Standard 4 — The site has been designed to meet the 80% TSS removal criteria
set by the DEP. A constructed wetland is credited with an 80% TSS removal
rate. Since we have met the 80% removal criteria, 4' sumps and hoods have not
been proposed.
• Standard 5 —The site will not have a high potential for pollutant loading due to
the expected use of warehousing and light manufacturing.
• Standard 6 — not applicable
• Standard 7 — The project is a re-development project.

• Standard 8 --The Grading, Drainage and Erosion Control plans indicate the
location of all erosion control measures.
• Standard 9 —An operation and maintenance plan has been submitted.
Excavated materials from the constructed wetland will be used under the
proposed building pad, if possible. It unsuitable material is excavated, the
material will be legally disposed of off-site.
L. Existing and Proposed 100-Year Flood Models:
Ponds and wetlands will not be impacted by the proposed construction. Aas shown
in the Drainage Study, the post-development peak rate of runoff from the site will be
lower than what currently exists.
M. Side Slopes:
A 2:1 side slope in the constructed wetland was previously approved by Mike
Howard with the condition that jute matting be used on the slopes. A note regarding
the construction of bar racks has been added to the Grading, Drainage and Erosion
Control Plan.
N. Storage Capacity:
Ample storage capacity will exist in the constructed wetland. The outlet structure
has been set at elevation 107.0. This outlet structure will maintain a water elevation
at 107.0 during normal conditions. The maximum flood elevation for the 100-year
storm is approximately 110.0. The emergency spilling has been set at Elevation
116.0.

P. Existing Tree Line:
The approximate treeline limit has been shown on the Existing Conditions Plan.
Q. Demolition Items:
Clarification to existing sewer pipes and manholes have been added to the
demolition plan. A note regarding floor drains has been added to the utility plan.

R. No Build Limit:
The 50' no-build line has been added to the Existing Conditions Plan.
S. Drawing Scale:
A waiver will be requested for the scale of the drawings. The plans were prepared
at this scale to eliminate the need for "match lines". This item was previously
discussed with Kathleen.
T. Flows for Easterly Wetland:
Since the easterly wetland and stream will not be affected by the development the
peak flows have not been calculated, The peak flow and volume will remain
unchanged due to this development.
U. Clark Street:
The portion of Clark Street where the flooding problem occurs is not affected by the
proposed development.
V. Environmental Reports:
Environmental reports regarding the site have been submitted to the Conservation
Commission.
W. Clark Street R.O.W:
Due to the existing right-of-way width and existing developments it does not appear
reasonable to expand the width of the existing roadway since this portion of Clark
Street is essentially a dead-end street. The need for a widened pavement section
does not appear to exist,
X. Drainage Connection:
It is assumed that the DPW has reviewed the proposed drainage crossing as part of
the TRC review.

Dear Mr. Scott:
In response to the review letter written by Jim Rand and the Site Plan Review-Special
Permit Order of Conditions we offer the following responses. Both documents were
given to Brad Mezquita of our office just prior to the February 9, 1999 Planning Board
meeting. The below comments were compiled based on a project meeting held on the
morning of February 10, 1999 with the Owner, Architect and Construction Manager.
As you are well aware, the Owner would like to start construction as soon as Planning
Board approval is obtained. The Owner would like to resolve all the open items over the
next couple of days in order to receive final Planning Board approval, with a minimum of
Special Conditions on February 16, 1999.
Jim Rand February 8, 1999 Letter:
1. Sweeping of Clark Street: The Owner agrees to this condition with the clarification
that weekly sweeping begins upon the commencement of earthwork activities and
ends once the binder course of pavement is installed.
The reason for the above clarification is that we believe it unnecessary to have
weekly sweepings during the demolition of the building and during the time of tenant
fit up when there will be no tracking of materials onto the roadways.
2. Width of Travel Way: Clark Street is currently 22 feet wide and has parking and
utility poles located within the right of way. We are proposing to widen Clark Street
from 22 feet to 24 feet and remove the parking and utility poles from the right of way,
which we believe to be a significant improvement over the existing condition.
3. Roadway Cross Section: We are unclear as to how to respond to this issue. We
are not proposing to rebuild Clark Street, therefore the existing cross section (and
profile) will remain.
4. Coordinate Work with Town Water Main Installation: Agreed. We would like to
see a schedule of the Towns' work and plans of the proposed work so we can

properly coordinate the work. We also need to meet with the Town to discuss the
existing and proposed domestic and fire services to this property.
5. DrainlWater Line Conflict: Please forward us a set of the Towns' water main
construction plans so we coordinate the drainage crossing.
6. Low Point on Clark Street: We are not proposing to reconstruct Clark Street, the
existing conditions will remain.
7. Water Services: At this time a 2" domestic and 6" fire service is required to service
the building. The intent is to utilize the existing services until the town installs the
new water main and taps to service this site.
8. Demolition of Existing Septic System: Agreed.
9. "RD" label: "RD" is for the roof drain.
10.Trees within Clark Street R.O.W.: Enclosed is a revised landscaping plan which
adds "bump out" islands to provide adequate room to plant the trees outside the right
of way.
11.Construction per Town of North Andover Specifications: Please provide us with
a copy of the referenced specification for our review. We believe the plans do meet
the town's requirements.
Planning Board Site Plan,Review_-- Special Permit;
1. Special Conditions
a. Detention basin outlet elevation: This appears to be a comment from another
project as our elevations are significantly different from the 241.5 referenced.
This should be removed as a Special Condition.
b. Drainage Study approval: It is our understanding the drainage study has been
approved by the Town's consultant. This should be removed as a Special
Condition.
c. Performance bond: The Owner will agree to this with the condition that further
clarification is provided on the performance criteria for the as-built survey and the
terms of the release of funds.

2. Prior to the Start of Construction
a, Construction schedule: Agreed. The Town will be invited to the pre
construction meeting with the site work contractor, A detailed project schedule
has been developed. Work will start as soon as the Planning Board approval
appeal period ends.
b. Erosion Control: Agreed.
c. Sound survey: We are unsure how to respond to this issue. Sources of sound
will be from HVAC units or truck deliveries, The renovated facility will comply
with all applicable sound requirements, Modern HVAC units will be quieter than
the existing units and truck traffic will be significantly less than existed when the
Borden facility was fully operational. The Owner is attempting to gather
additional information from the Borden Plant engineer of previous sound studies
that may have been completed.
3. Prior to Form U verification:
a. Plans signed by Planning Board: Agreed,
b. Submit certified copy of recorded decision: Agreed.
4. Prior to verification of the Certificate of Occupancy:
a. Architect/Engineer certification: Agreed.
b. Landscaping installed per approved plans: Agreed.
c. Lighting approval: bighting will be Installed per the approved plans.
Photometrics have been submitted to the town. We request this condition. be
removed.
d, Fire sprinklers per North Andover Fire Department: Agreed,

5. Prior to the final release of security:
a. Landscape screen: We request that this Condition be removed. Landscaping
will be installed per the approved plans.
b. As-built: Agreed. See response to item 1 c. above.
6. Material stockpiles: Agreed.
7. Maintenance of equipment: Agreed.
8. Equipment exceeding noise levels: Agreed.
9. Site lighting: Lighting will be installed per the approved plans. Photometrics have
been submitted to the town. We request this condition be removed.
10.Limiting truck deliveries and snow plowing hours: We request that this
condition be removed as it is not appropriate for the uses allowed by zoning.
11.One year warranty on planting: Agreed.
12.Contact Dig Safe: Agreed,
13.Underground utilities: Telephone, cable and electric service will be above ground
as currently exists.
14.No open burning: Agreed.
15.Underground fuel storage: Agreed
16.Binding provisions: Agreed.
17.Changes to approved plans: Agreed.

20.Summary of Plans and Reports: We have made a number of revisions to the
December 4, 1999 plans and study based on review comments form the Town's
consultants, Conservation Commission and Planning Board. The plans have been
revised through February 9, 1999. The Drainage Study has been revised through
January 20, 1999.
We look forward to meeting with you to discuss our responses to the above comments.

As you are aware the referenced project has started construction. Upon recent review
of the Notice of Decision dated February 17, 1999, we noticed that one of the
stipulations was that all utilities were to be underground. Based on our meeting at your
office with Brian Gagne prior to our approval, we had discussed that this stipulation
should be removed. Previous soil boring data indicates that the groundwater is very
close to the surface and may prohibit the installation of underground utilities. Based on
our discussion and your conceptual approval as well as the approved site plans we
would request that the Notice of Decision be revised to allow all electrical lines to be
overhead.
