I was asked to pay $5,000 for project review fees and sign the corresponding paper work. In my case,the drainage study was reviewed by an outside consultant, Coler and Colantonio, for the No. Andover Conservation Commission when I filed a Notice of Intent (File# 242-931), 1 paid $5,000.00 in escrow for an outside consultant for reviewing drainage study etc for No. Andover Conservation Commission(see attached). After some revisions, the outside consultant approved the drainage study and the Conservation Commission accepted it and issued an Order of Conditions. We are in the process of a minor modification of the current Order of Condition. I am requesting that the planning board continue to use the services of Coler and Colantonio for the review of drainage study, I am further requesting that VHB, Inc, review everything except drainage study. Therefore,the further escrow monies may be reduced from $5,000,00, I am requesting for such a reduction. If actual fees of VHB come to a higher amount,I will be happy to pay the same in future I thank you for considering reduction of the escrow amount for the outside consultant at this time. This land was rezoned at-the May.2000 Town Meeting.to Business-4. There are.three residential lots which will be deeded to the North Andover Conservation Commission as a condition of the variance granted by the Zoning Board of Appeals. My review is as follows: i. NORTH ARROW/LOCATION MAP: A locus map has not been provided, although a north arrow has. The Sheet Numbers on the Site Plana are confusing and should be labeled clearly ar follows: "Sheet ] of.5, Sheet 2 of 5, etc. " ii. SURVEY OF LOT/PARCEL: This has been provided. iii. NAME/DECRIPTION OF PROJECT: This has been provided. iv. EASEMENTS/LEGAL CONDITIONS: No easements are proposed on the plans. V. TOPQGRAPHY: This has been provided. vi. ZONING INFORMATION: Zoning information has been provided. The applicant received a variance fiom the Zoning Board to allow 188 parking spaces vs. the required 223 parking spaces. The Zoning Board decision requires that the applicant include all rental and lease agreements with a condition that 2.8 parking spaces be provided per 1,000 gross floor area rented by each tenant. vii. BUILDING LOCATION: All of the building locations have been provided, ix. BUILDING ELEVATION: Building elevations have been provided, The Building will contain four stories, excluding the garage. Each floor varies fiom as low as 15,514 SF to 16,838 SF. The building is to be 64' in height, the maximum height allowed in the B4 zone. The elevations should be supplemented by an architectural rendering as it is unclear what materials the building will be comprised of. X. LOCATION OF PARKING/WALKWAYS: Parking spaces are provided along the perimeter of the parking,lot and throughout it. Snow storage is provided on the parking lot near the rear of the building. xi. LOCATION OF WETLANDS/NOTICE OF INTENT: The applicant has a valid Ordey of Conditions which was approved in Aril of 1999. xii. LOCATION OF WALLS/SIGNS: A signage plan needs to be provided for the site as one has not yet been provided. xiii. LOCATION OF ROADWAYS/DRIVES: The roadway within the parking lot is 25' wide, and expands at one point to 31' wide. We will need confirmation fiom the Fire Department that this access is adequate for emergency services to be provided. The access drive is 44' wide. The internal circulation of the,parking lot could be confusing at certain intersections and should be more clearly defined to the Planning Board. xiv. OUTDOOR STORAGE/DISPLAY AREAS: There is no outdoor storage being proposed. xv. LANDSCAPING PLAN: The plan provides for three types of tree species at appropriate intervals in conformance with the Zoning Bylaw comprised of Norway maples, ginkos and American hornbeams. The plans do not clearly denote which trees will be placed in which locations on the site plan and this needs to be clarified on the plans so as to not cause issues in the construction process. xvi. REFUSE AREAS: A gated dumpster is located at the rear of the building and will be enclosed with a 6' high fence. xvii. LIGHTING FACILITIES: There is a mixture of both single and double-headed lighting throughout the site which appears to be adequate for the site, They have provided a detail of the light entitled the "Colonial Decorative Luminaire" which is consistent with the lighting the Planning Board encourages to be utilized. xviii. DRAINAGE SYSTEM: Please refer to the outside consulting engineer's report. xix. TRAFFIC IMPACT STUDY: The traffic study reveals that left and right-turn exiting movements would operate at LOS D or better; left-turn entering movement would operate at LOS B or better. The access drive is to consist of a 24' cross-section with one 12' wide lane for entering traffic and one 12' wide lane for exiting traffic. A traffic plan has been submitted in the plan which reflects this cross-section. Please refer to the outside engineering consultant's remaining comments on traffic. xx. COMMONWEALTH REVIEW: The project will require a sewer extension.permit from DEP and a modification was applied for on 5/16/01; A Highway Access Permit is required and was applied for on 5/18/01. xx. UTILITIES: A utility,plan has been submitted, and of.particular importance is the sewer extension plans. I would like recommendations fi•om DPW on this issue and if they are obtained prior to the meeting I will include them in the packet. xxi. FISCAL IMPACT: A fiscal impact report has not been provided to me for this project and a waiver needs to be requested. xxii. The Zoning Board Of Appeals(ZBA) and the applicant agreed that that lots 1N, 2N, and 3N were not to be built upon. An application must be made to the building department for a sign permit for temporary or permanent signs. All signage must be in accordance with Section 6 of the Zoning By- law. Prior to the issuance of building permit the building department will require evidence that a Mass. State Highway curb cut and a sewer entry permit have been issued. At that meeting, the following items and/or revised plans were to be presented to the Planning Board at their August21, 2001 Meeting: l. A proposed covenant restricting the uses of the building to "retail" or to a use t that will not generate more than 223 parking spaces in compliance with the Town of North Andover Zoning Bylaw dated May 2001. 2. Yqu must meet with the Fire Chief and have him provide to the Planning Department, in writing, that he can adequately serve a 64' tall building, in light of the potential elimination of the ladder fire truck. I will contact the Fire Chief and ask him if the 25' paved drive around the building is absolutely necessary or'if it can be reduced in width. 3. A baseline determination of the noise level in decibals, from the mechanical equipment (currently proposed on the roof of the building); accompanied by an alternative analysis that the mechanical equipment cannot be placed anywhere but the roof of the building shalt be provided to the Planning Board. 4. Photographs or other commercial buildings permitted and constructed by your company must'be provided to the Planning Board. 5. Samples of building materials shall be brought to the Planning Board meeting of 8/21/01 (i.e. the brick, siding, clapboard, etc.) l' 6. Crpss-sections of the building and the area of land between the nearest residential abutter on Berry Street to the proposed building must be provided to tfie'Planning Board. 7. A locus map must be placed on the revised plans. 8. Revised landscaping plans depicting additional buffering between the rear lot line of the building and specific types of plantings on the landscaping plans. 9, Revised Plans r6flecting additional snow storage. 10. Revised plans depicting a fence or a gate in front of the proposed building to prevent access/egress at an undesirable location. 11. The materials to be utilized for the construction of the building must be placed on the architectural plans. 12. The manufacturer and style of the parking lamps must be provided to the Planning Board. Specifications as to whether or not the bulbs will be shielded and their height shall be provided, along with the range of the illuMination. 13. Average height of the trees and the difference in topography from the proposedbuilding to the nearest residential abutter on Berry Street. All of this information trust be submitted to myself by Tuesday, August 14, 2001 in order to provide adequate time for stag to review the materials and mare recommendations to the Planning Board for the August 21, 2001 meeting. Eight copies of the plans and information must be submitted to the Planning Department in order for the materials to be placed in the packets for the Planning Board to review.
