NEGATIVE #3 DETERMINATION OF APPLICABILITY
FINDINGS & SPECIAL CONDITIONS
40 Duncan Drive,North Andover
At the December 13,2023 public hearing, the North Andover Conservation Commission(NACC) voted
to issue a Negative #3 Determination of Applicability approving the project at 40 Duncan Drive based on
its findings below and subject to conditions listed below. The work includes the installation of a new
1,500-gallon septic tank, 1,000-gallon pump chamber and 20' x 30' leaching field. All work will be
conducted greater than 50' from the BVW associated with Lost Pond.The leaching field is proposed
outside of the 100' buffer zone to BVW. Given the existing plumbing exits the house
within the buffer zone,the connection to the septic tank and pump chamber are proposed
approximately 60'from the edge of BVW within existing lawn areas. All work is proposed within areas
that are currently maintained as lawn and/or landscaped areas.
The RDA application,filed by Williams &Sparages, on behalf of the homeowners Karen L&Shelly Mello
was filed in response to an Enforcement Order (EO). The EO was issued due to extenuating
circumstances that when the Board of Health permit was applied for by the design engineer, the septic
system installation season was soon closing and upgrade was required as the property was under
transaction and the current owner needed to vacate the property by the end November. The existing
septic system was experiencing failure, and is in close proximity to Lost Pond and surrounding
Bordering Vegetated Wetlands. With the Conservation Corm-nission Chairman's authorization an EO
was issued to allow Breen Excavating to begin work pending the submittal of a Request for
Determination of Applicability. Erosion controls (12" mulch sock) were installed per the plan and
monitoring has been on-going with no issues reported to date. The system was installed within a week's
time and received a CofC from the Board of Health. A the December 13, 2023 meeting the NACC voted
to lift the Enforcement Order and issue this Determination of Applicability which will now govern the
project per the required conditions below.

The following special conditions are mandated;
1. Existing erosion controls shall be maintained and NOT removed until the
Conservation Department provides its approval upon
satisfactory stabilized conditions.
2. Erosion control monitoring shall continue after rain events of 1." or greater until
such time that the Conservation Department approves cessation.
**The applicant,owner,and their contractors are advised that NO other work on the property is allowed
under this permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot buffer
zones on site and any work that involves ground disturbance or changing the current conditions in these
areas will require permitting with the NACC. This includes,but are not limited to,house additions,
pools,patios, decks,sheds,fences, garden beds, landscaping and bridge installation,t ee or
vegetation cutting,/prutaing. These activities shall be held_to the.current standards under the Bylaw and
WPA.

The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land �
upon which the proposed work is to be done, or any ten residents of the city or town in which such land |
is located, are hereby notified of their right to request the appropriate Department of Environmental '
Protection Regional Offi ( �

certified mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal
Form (see Request for Departmental Action Fee Transmittal Form) as provided in 310 CMR 10.03(7) '
