`Fhe North Andover l lealth and Police Departments have received several complaints of loose
goats and sheep on adjacent private properties or public ways owned a.n.d maintained by the 'town of
North Andover or the Coni moriwealt.h. of Massachusetts.
On September a, 2023, Animal Control Officerr/Inspectorr, Brad DiC enzo, cotac:lr.rcted are authorized
inspecti.orrt at the alcove referenced a.dclress in response to the crornpla.ints filed.. The inspection.
revealed the following violations of the North Andover hoard of.health. :rrc°ph,'ig gfrtArr%r ufis Rules and
1�egulations ("Regulations"):
Section.4.3 -All Keeping of Animal Applications must meet all Zoning Requirements set forth in
the North Andover Zoning Bylaw as summarized in Table 1..

letter dated Noverrtaber 20, 2023, the Building Commissioner and Zoning Enforcement Officer
notified the property owner that the nurrr ber of animals housed at this property violates zoning.

A permit to keep one of more animals shall be required for anyone keeping one or
more animals as defined in this regulation.
As of December 20, 2023, this property houses animals without a valid AninialPermit from the
I-lealtil Department. The Animal Permit application.was denied on September 7, 2023, by the
Building Commissioner and Zoning, Enforcement Officer, citing a violation of zoning and lot size
restrictions based on the proposed type and number of animals. As a result, the Health
Department cannot issue the permit. You may re-subruit your application, adhering to the
allowed number and types of animals as Outlined in Section 4.3, Table ] of the Regulations.
Section 6.2 -Animals shall not be allowed to leave the property unattending or enter onto an
abutting property or private lands without written consent of the abutting property owner.
On September 3, 14, and November 5, 2023, the Police Departi-rient responded to calls in regards
to the above-n-iontioned animals roaming outside your property,
You are hereby ORDERED to remove all unpermitted animals from,your property within
thirty (30) days from receipt of this letter. Failure to comply within the specified time period may
result in a fine of up to 'n,iree flundred Dollars ($300) per day in accordance with Section 9.2 of the
Nor 1h A inlover Boa rd(f Health Keeping of A n.inials Rules and Regulations. The fine will continue to accrue
until the property is brought into compliance with this Order to Correct. Each day or portion thereof
during which the violations continue shall constitute a separate offense. If you need assistance with
placement of the animals, please contact the Animal Control Officer/Inspector at 978-242-151.1 for
assistance.
Per Section 1.0.1,you have the right to request a hearing before the Board. of I lealth if you feel this
Order to Correct should be modified or withdrawn. A request for said hearing must be made in
writing and received by the Health Departryient within seven (7) days from receipt of this Order. At
said hearing you will be given an opportunfty to be heard and to present Nvitriesses and dOCUrnentary
evidence as to why this Order to Correct should be modified or withdrawn. All affected parties will
be, informed of the date, tinie and place of the hearing and of their right to inspect and copy all
records concerning the matter to be heard. You, may be represented by an attorney. You have a right
to inspect and obtain copies of all relevant records concerning the rnatter to be heard.
Please call the Aninial Control Officer/Inspector or Health Department once the property is brought
into coinpliance for a re-inspection. A re-inspection by Animal Control Officer/:Inspector or Health
Department is required to verify C0111pliaTICC!.
