CONSERVATION DEPARTMENT Community Development Division NEGATIVE., #3 DETERMINATION OF APPLICABILITY FINDINGS & SPECIAL CONDITIONS 754 Boxford Street, North Andover At the January 10, 202:4 public hearing,the North.Andover Conservation Commission (NACC) voted to issue a Negative H3 Determination of Applicability, approving the project at 754 Boxford Street based on its findings below and subject to compliance with the conditions listed below.. The Request for Determination of Applicability application, filed by the homeowners Brian and Amanda Geiger, proposed the following project elements: Installation of 16'x24' above-ground pool with a cartridge style filter system, and associated 6' pool deep cantilevered off the east side of the pool. The work will occur completely within the existing lawn area, and disturbance within the 100' Buffer Zone will involve slight leveling of previously disturbed ground to create a compacted base for the pool. Washed reason sand will be imported to the site and used as fill for this base. At its closest point, the pool deck will be approximately 51.11' from the wetland, measured from Wetland Flag#i8. During the January 10"'NACC meeting, various violations within the 54' No-Build Zane and the 25' Foot No- Disturb Zane were discussed, including a chain-link fence, shed, a small portable screened gazebo structure, and raised garden beds. The NACC determined that the fence and the shed may remain in place, but there shall be no improvements or modifications made to these structures, and they shall not be replaced unless new locations are compliant with the wetland setbacks established in the North Andover Bylaw and Regulations and properly permitted with the NACC. The garden beds and the greenhouse structure are to be relocated to a location outside of the 50' No-Build Zone, and mitigation plantings will be required in their place. Required special conditions associated with this approval are listed below. Prior to any work commencing on the proposed pool, but no later than May 31, 2024, the applicant shall install not less than 5 (five) native shrubs within lawn on the upland side of the fence between Wetland Flags #J6 and 49. The shrubs should be planted at 8-foot intervals. Negative#3 Determination of Applicability with Conditions .754 Boxford Street Page 1 of 2 Attached is a list of approved native shrubs from which to select species appropriate for the growing conditions of this site. This area of planting shall be left to naturalize in perpetuity without being subject to routine residential landscaping maintenance. 2. An on-site pre-construction meeting with Conservation Department staff, the pool contractor, and the homeowner must be held Mom work on the pool,may begin (and before Conservation Department sign off on the building permit) to inspect and verify the following items: a. Erosion Controls in the form of 8"mulch socks are installed and securely staked between the limit of the work and the wetland. b. The limit of the 50' No-Build Zone must be clearly staked out in the field to guide pool and deck installation in order to prevent accidental encroachment of any pool or deck element into the 50' NBZ. Conservation staff will verify this measurement to ensure the off-set stakes are properly positioned in the field. c. The raised garden beds and the gazebo structure have been moved to an area outside of the 50' No-Build Zone. d. Wetland markers shall be mounted on mature trees at the limit of undisturbed 25-Foot No Disturbance Zone between Wetland Flags #9 and #15, at an interval of approximately every 30 feet, for a total of five (5) markers. Three (3) additional wetland markers shall be installed, evenly distributed in front of the required shrub plantings, and mounted on 4x4 pressure treated posts. The bottom of the posts shall be buried at least 24"below ground and the top of the posts shall be at least 30"above ground, and securely tamped down or cemented in for stability. One (1) additional wetland marker shall be mounted on a mature tree in the vicinity of Wetland Flag#2. These wetland markers are available for purchase in the Conservation Department at Town Hall. These markers shall remain posted and be replaced as needed in perpetuity. 3. Conservation Department staff must conduct a post-construction site inspection to, verify that the pool and associated deck are in compliance and to approve removal of the erosion controls. Please contact the Conservation Department for this inspection, The api2licant, and their contractors are advised that NO other work on the property is allowed under this permit. The NACC has jurisdiction over all of the wetlands and associated I 00-Foot buffer zones on site and any work that involves ground disturbance or changing the current conditions in these areas, will require permitting with the NACC. This includes, but are not limited to, house additions, pools, patios, decks, sheds, fences, garden beds, landscaping and bridge installation, tree o vegetation cuttingZpruning. These activities shall be held to the current standards under the Bylaw and WPA.
