Pledge of Allegiance The Administrator states tonight's Conservation Commission meeting is not being televised on North Andover GovCAM due to the Select Board meeting. The North Andover Conservation Commission meeting is being recorded and will be televised on North Andover CAM-ED (Comeast Channel 6 or Verizon Channel 28). Acceptance of Minutes • Mr. Mabon states he reviewed the draft version of the minutes and notes there is missing information on the Violation for 74 Autran Avenue. • The Administrator states the Commission was in agreement to push the matter to the December 13,2023 meeting as requested by the homeowner's attorney. • The Commission agrees the draft should be revised to reflect that no action was taken. • A motion to accept the minutes of November 15, 2023,with the change for the Autran Avenue Enforcement Order to reflect that the NACC took no action is made by Mr. Mabon, seconded by Mr. Lynch. • Vote 3-2, (In Favor:Napoli, Mabon, Lynch,Abstained: Mustain,Manzi). The tanks also need to be 10-feet from where vehicles run or are started/shutoff. An updated alternatives analysis has been provided as requested at the last meeting. Staff agrees that the chosen location is the least invasive since other locations will require more extensive trenching for connections, and locating them off the side of the driveway could pose safety concerns. The proposed location is within the lawn area against the house. Due to extenuating circumstances the work was allowed to start by the Chairman under an Enforcement Order. All pre construction requirements were met prior to the start of work. The leaching field is completely outside of the Buffer Zone with the new tanks located between the 50-foot NBZ and 100-foot Buffer Zone. The tanks are approximately 60-feet from the Resource Area. Erosion controls were installed and monitoring has been on-going. Wetland flags were refreshed in the fall and the delineation reviewed with the wetland consultant. Minor flag adjustments were made, changes did not impact the upland areas in any meaningful way. She requests the NACC keep in mind for future projects that the soils on the eastern hill opposite the campus are very tight, compressed glacial till,which will make the site difficult to manage during the construction phase. She recommends approving the flag adjustments and granting a 1-year extension. They are seeking approval under an Enforcement Order for the removal of the sediment and restoration of the wetland with seed mix at 85 Flagship Drive, as well as performing O&M on the stormwater management BMPs on site. A removal and restoration report and O&M Plan have been provided for review. The restoration report outlines the most heavily sedimented areas of the wetland.All work is proposed to be done by hand removal and restoring the area with wetland seed mix. She believes that the O&M work is allowed under the previous OOC (DEP File#242-1263)for Flagship Drive as long-term maintenance. Due to scheduling conflicts the property owner and consultant were unable to attend tonight's meeting. • The Commission discusses how to proceed with the request. • The Administrator states the restoration work required at 85 Flagship Drive was always intended to be conducted under an Enforcement Order. • Mr. Lynch questions if any storage volume has been lost due to the accumulation of silt and whether the area should be dredge to restore the flood plain and not just seeded. • The Administrator states 360-sf ft of wetland near the headwall and culvert will be restored. The proposed restoration will be performed during dry conditions to adequately remove the sediment to the original top soil. Since the thickness of sediment varies,they are proposing to remove 360-sq ft to prevent scraping up vegetation and native soils unnecessarily. • The Commission agrees that the Enforcement Order does not limit other actions that the Conservation Commission may request that 85 Flagship Drive do as a result of the situation. • A motion to approve the implementation of the O&M Plan and to issue an Enforcement Order to approve the Wetland Restoration Plan with conditions as amended(restoration work to be overseen by a wetland consultant,pre construction meeting, invoice for wetland seed mix to be provided before spreading, 1-year of monitoring with a final report to ensure 75% survivorship, final determination shall be made by the Administrator, the EO does not preclude 85 Flagship from having to do additional work)is made by Mr. Manzi, seconded by Mr. McDonough. • Vote 6-0,Unanimous. A site visit was conducted by staff and Heritage Green Condominiums was granted permission to remove the debris that had accumulated in the stream. The blockage (debris/trash)was not the main source of the flooding issue however it contributed to the issue. • Waddy Lafleur,the homeowner states during the September storm a tree fell onto his property from the abutting property. The fallen tree was never reported to the condo association. Contractors were hired by the homeowner to conduct the tree removal; debris was removed from the site the same day. He believes the photos were taken while the tree removal was in process. He expresses concern with area flooding and dumpster being located less than 8-feet from the Resource Area on the abutting property. • Mr. Mabon questions if the trash has been removed from the stream. • The Administrator states she will have the Field Inspector conduct a follow up site inspection to ensure all debris has been removed. • The Commission discusses the violation and agrees the condo association is responsible for cleaning up the stream. They direct the Administrator to write a follow up letter acknowledging that no additional enforcement action will be taken against the homeowner. • No action is required at this time. Drainage will be provided in the form of a swale along the northern property line. Due to a ridge line, it is not possible to run a Swale from the eastern corner along Boston Street to the rear of the property. After reviewing the topography, they believe a rain garden would not be able to be sized to provide any meaningful storm mitigation. • Mr. Lynch expresses concern that the erosion control is not confined in the property. If grading is proposed on Town property permission from the Town will be required. He recommends the consultant speak with the Town Engineer. • Mr.Napoli requests construction access and a stockpile area be shown on the plan. • Mr. Mustain questions how stormwater will flow from one side of the driveway to the other. • Mr. Schomburg states the septic system received approval from the BOH. Per the advice of Town Counsel an email was sent to the Applicant and their Engineers indicating that the hearing would be opened tonight. The email asked if they would like to continue or withdraw, if not the NACC would move forward with the hearing and if abutters or the public were present that the NACC is compelled to hear from them. She proceeds to read the email response from Eric B. Lane of Hayes Engineering delivered on December 13,2023 into the record,which stated no one from the applicant's side planned to attend. The NOI application included an abutter notification form indicating that the December 13,2023 meeting would be the date of the first hearing. A draft legal advertisement was prepared by staff and sent to the Lawrence Eagle Tribune; a proof was provided as well as written confirmation from the newspaper that the paying parties are on account with the newspaper and received a full confirmation. • Mr. Lynch notes the legal notice references both the Wetlands Protection Act and the local Bylaw,that proper notifications were made for this hearing under both statutes. He questions if Mr. Ogren or Mr. Grasso are present for comment,none answer. He expresses concern that the Applicant or Consultant are not present to answer questions regarding the application, of which he has many. • The Commission discusses the request and how to proceed. The Chairman canvasses the Commission members for any discussion/questions. • Mr. Mabon states that he has reviewed the procedural aspects of this application thus far,but has no questions with the applicant absent. • Mr. Manzi states that he will not ask his questions to an applicant that is not present. • The Chairman expresses his surprise at how this application process has unfolded and has not seen this type of situation in his 20 some years on the Commission. • Mr. McDonough states that the NOI documents do not speak for themselves, and he has questions for the applicant and engineer but since they are not present,he will not ask questions at this time. • Mr. Mustain states that he has questions about the site plan layout,but since no one is present to answer,he has nothing further to say. • The Commission recognizes members of the audience who wish to speak about this project. • Scott Hajjar,the owner of 651 Turnpike Street states he is not in favor of the proposal and expresses concern that the Applicant is not present for questions. His property which directly abuts the project location has been owned by his family for 50-years and even with a sump pump they have experienced flooding during heavy rains or heavy snow. In the past they have been told by the Planning Board that they couldn't develop their property due to the wetlands. If the project is approved and the land is allowed to be used then he believes the neighbors should be allowed to use their land equally. He pleads with the Commission not to approve the project. He states the project is like placing a brick on a sponge. • Mr. Manzi presents a copy of the email from Eric B. Lane to the abutter. • The Administrator questions how Mr. Hajjar knew about tonight's hearing. • Mr. Hajjar states he received an abutter notification letter in the mail for this hearing. • The Administrator reviews the proposal and waiver request which she states is very similar to the previous proposal. She states that the filling is not complete,it's missing the discussion and plan set for the replication. 2023-12-13 Conservation Commission Minutes Page 8 of 8 Approved 0112412024 • Mr. Lynch does not believe the alternatives analysis has been met, as it needs to be thorough, comprehensive and discussed for a waiver. He expresses concern that the abutters' concerns were not met by the Applicant at the public hearing. • Melinda Perrone, 65 Meadowood Road is present to advocate the importance of Mosquito Brook and Willow Street wetlands, she is not in favor of the proposal. She expresses concern about abuse (dumping) at the business park and states that she sends weekly reports to the Town regarding dumping. She reads directly from the NOI narrative that asserts that the wetland on site is of no significance. She disagrees with that statement noting there are abundant benefits the wetland provides. • The Administrator states groundwater is very shallow on the site. She is unsure if they will be able to achieve the 2-foot separation for the detention basin. • Mr. Lynch states that the Commission's choices from here would be to continue with this hearing but without an applicant present that is not possible. The other option would be to continue the hearing to another date, but the Commission does not have consent from the applicant to do so,therefore the Commission is forced to close the hearing. Members agree. • A motion to close and issue in 21 days is made by Mr. McDonough, seconded by Mr. Manzi. • Vote 6-0,Unanimous. • The Commission agrees to hold a Special Meeting on December 20, 2023 at 5:OOp.m. to deliberate and render a decision.
