COUNSEL May 26 , 1976 Mr. Joseph Montero Planning Board North Andover Town Hall North Andover , Massachusetts 01845 Dear Mr. Montero: I appeared before your regularly scheduled meeting in March, 1976 to discuss certain problems I have had as the owner of 30 Oakes Drive with the layout of the existing Oakes Drive. I mentioned to you that part of my property was, to a great extent, below the level of the street and, therefore , much of the street surface water was draining onto my property and eroding part of the frontage, I was also getting excessive surface water at the back of my driveway. I further noted that the catch basins do not appear to be doing much for the surface water and there appears to me to be an open swamp between two other lots on the street which is not only a health hazard but offensive during hot weather. Barco Corporation, as represented by Joe Barbagallo, President, agreed at the meeting to landscape my frontage properly to cure the problem of excessive water running onto my property. Some landscaping has been done but it is not completed yet. Further,, the swamp water problem appears to be getting worse. I do not .feel that the Planning Board should consider releasing the bond and accepting the street until a careful review of some of these problems has been made. Very truly yours , Paul A. The road work i•rithin this subdi•vision has been well done and T am sure that Mr. Barbagallo would comply irith any requests for corrections that might a.r:i.se. She has always been very cooperative and T would. be taill..:i.ng to accept a letter, of aggreemen.t From hint that he would per- form, if it were necessary, further corrective work. T will be at the meeting this evening to answer any further, questions . As for Woodbury bane, everything is going along well.. Drainage has been completed at sub grade and gravel has been applied. Several of the property owners of Oakes Drive have already contacted you regarding this breach of the promise made by the developer to you at the hearing on the subdivision . As an attorney and property owner on Oakes Drive, I am disturbed about what appears to be a lack of concern shown by developers toward -down boards . I therefore request that this matter be placed on the agenda for the next available meeting of the Planning Board and that you notify the undersigned and other interested parties when it is so scheduled.
