MEETING MINUTES

1. Call to Order called at 7:30 p.m.

2. Acceptance of Minutes
Motion made by M. Lis to accept the November 14, 2023 meeting minutes. Seconded by R. Faigen. The
vote to approve is unanimous.
3. Continued Public Hearing of 315 Turnpike Street(Findin2l
The petition of Merrimack College (Owner) & Greystar Development East,LLC (Developer). The
Applicants are requesting a Finding pursuant to Town of North Andover Zoning Bylaws Section 195-
10.8(B)Building Inspector Appeal in the R-3 Zoning District for the purpose of overturning the Building
Commissioner's Denial dated August 30,2023; specifically, Applicants seek a Finding from Town of
North Andover Zoning Bylaws from the requirements of Section 195-7.4 Building Height,Attachment 3,
Table 2: Summary of Dimensional Requirements for the purpose of allowing the construction of two
buildings to be used as academic space and residential dormitories on an undeveloped portion of the
Property.
Applicant requests a continuance of the finding to the next meeting as the twenty-day appeal period for the
variance decision has not expired.
Motion made by M. Lis to continue the finding to January 9, 2024. Seconded by R. Faigen. A. Jacobs
voted yes. R.Faigen voted yes. M. Lis voted yes. F. Killilea voted yes. S. Seide voted yes. The vote to
continue is unanimous 5-0.
Notices and agendas are to be posted 48 hours in advance of a meeting excluding Saturdays,Sundays,and legal holidays.Please keep in mind the
Town Clerk's hours of operation and make necessary arrangements to be sure that posting is made in an adequate amount of time.A listing of topics

4. New Public Hearing of 38 Putnam Road
The petition of Karen Davis for property at 38 Putnam Road (Map 021.0, Parcel 0006), North
Andover, MA 01845 in the R-4 Zoning District. The Applicant is requesting a Variance pursuant
to Town of North Andover Zoning Bylaws Section 195-7.3 Yards (setbacks) Table 2: Summary of
Dimensional Requirements for one side setback in the R-4 Zoning District for the purpose of
replacing the existing breezeway/garage/storage area structure with an 838 square ft.
breezeway/garage structure; specifically, Applicant has requested a side setback needing a relief
variance of 7 ft. 5 in. (side setback proposed is 7 ft. 7 in., side setback required per Table 2 is 15
ft.).
Applicant is at the table and requests a variance in order to replace the existing garage structure
with an 838 square ft. structure. The current structure is unsafe and the breezeway is unusable.
Two letters received from abutters in support of the project.
Motion made by R. Faigen to close public comment. Seconded by M. Lis. The vote to close is
unanimous.
The board deliberates.
Motion made by F. Killilea to grant the variance. Seconded by R. Faigen. A. Jacobs voted yes. M.
Lis voted yes. F. Killilea voted yes. R. Faigen voted yes. S. Seide voted yes. The vote to approve
is unanimous 5-0. The following plans were referenced:
(1) Plot Plan of Land prepared by Sullivan Engineering Group, LLC dated November 9, 2023,
containing one (1)page; and
(2) Existing and Proposed Elevation and Floor Plans dated October 29, 2023, containing seven
(7)pages.
5. Continued Discussion and Acceptance of the 2024 Meeting Schedule
Motion made by M. Lis to accept the 2024 Zoning Board of Appeals calendar. Seconded by R. Faigen. The
vote to approve is unanimous.
6. Discussion Regarding Annual Election of Board Officers
The annual election of board officers will take place at the January 9, 2024 meeting. New associate member
will be joining in January.

8. Adiournment: 8:05 p.m.
Motion made by M. Lis to adjourn the meeting. Seconded by R. Faigen. The vote to adjourn is unanimous.
