FOR VALUABLE CONSIDERATION, receipt of which Is hereby
acknowledged, do hereby
GRANT TO The Town of North Andover, Essex County ,
Massachusetts and to Its successors and assigns, a pedestrian
and equestrian easement in perpetuity more particularly set
forth below :
A twenty foot wide easement as defined by Subdivision
Plan entitled "Definitive Subdivision Plan of Oakwood, located
In North Andover, Massachusetts, Owned and Applicant : Flintlock
Realty Trust" dated November 12, 1985 , and revised January 24,
1986 and February 28, 1986 , Thomas E. Neve Associates, Inc. ,
Engneer-Surveyors-Land Use Planners, which said plan is
recorded with the Essex North District registry of Deeds as
Plan No. 10252 .
The following activities shall be specifically prohibited
on said easement :
a. Dumping and placing of soil or other substances on
the ground and I andf i I I , or dumping or placing of trash, waste
or unsightly or offensive materials ;
b. Removal or destruction of trees, shrubs or other
vegetation except for proper forestry and landscaping practice
as the same result to pedestrian and equestrian travel ;
C. Use of said land except for outdoor recreational
purposes or purposes permitting said land to remain
predominately In its natural condition ;
Grantee may authorize and allow the general public to
pass and repass over said easement on foot, or horseback, but
not with any motor vehicle. At no time shall the grantee
and/or Its assigns Interfere with the quite enjoyment of the
natural scenery . Grantee and Its assigns assure the protection
and preservation of the conservation values of the easement
area and the privacy and residential values of the adjoining
lots shown on said plan referred to herein. E
Grantee, by accepting and recording this Instrument
hereby agrees to the terms and conditions contained herein and
more specif Ica I I accepts the I iabi I ity relating to the use of
said easement as the same pertains to the grantee and/or its
assigns.
Being the same premises conveyed to grantor by deed of
FI i ntl ock Realty Trust dated May 1 , 1986 and recorded at the
Essex North District Registry of Deeds at Book 2181 , Page 332.
Addition reference is made to subdivision plan referred
to above at Sheet 6 , Item 14 .
