by providing and establishing adequate protection of the approaches to
the Lawrence Municipal Airport,a publicly owned airport located in the
Town of Borth Andover,County of Essex,Commonwealth of Massachusetts, Be pl n 152
said airport being owned by the City of Lawrence,a Municipal corporati n
located in the County of Essex,Comgonwealth of Massaohusetts;and aotin
under the authority to acquire lend for said purpose conferred upon
said City by Section 5 of Chapter 537,Massaohusetts Ants of 1941, said
Act being an amendment of Chapter 90 of the Massachusetts General Laws
-and more specifically referred to herein as Sections 400, 40H and 401
of said Chapter 90,hfassaebusetts General Laws;an appropriation for ac-
quisition of said lend having been made under the authority of Chapter
40, Seotion 5, Clause 35 of Massachusetts General Laws; and all other
requirements of law having been complied with, The City of Lawrence,
Massachusetts, as owner of a publicly owned Municipal airport located
in the Town of North Andover, County of Essex, Commonwealth of Massa-
ohusetts, Acting by its City Council and exercising the power and au-
thority conferred by Section 400 of Chapter 90 of the Massachusetts
General Laws, Does Hereby Take In Fee Simple By Right of Eminent Domai
in accordance with the provisions of Chapter 79 of Massachusetts Gen-
eral Laws, the following described land with buildings situated there-
on, including in the taking all, trees and any and all other structures
located thereon,said land being situated in the Town of North Andover,
3assaehusetts and located adjacent to the Lawrence Municipal Airport,
for the purpose of establishing protection to the approaches of said
publicly owned airport, as shown on accompanying plan, said land being
BOUNDED and described as follows: Description Of A Parcel Of Land In
North Andover, Massachusetts Owned by Agnes M. Finegan; Eileen J. Fine
gan And Frances T. Finegan, Beginning at a point in the westerly side-
line of Clark Street, said point being distant southerly 130.70 feet
from a stone bound set is the sideline of said street by the County of
Essex, and said point being also the southeasterly corner of a parcel
of land now owned by Charles H. and Mildred H. Davis and being the di-
viding line between the property of the said Davis and the property of ' I

running South 14 degrees 04 minutes West by the westerly sideline of
lark Btreet, a distance of 509.89 feet to a stone bound. Thence turn-

of a circle having a radius of 200 feet, a distance of 251.59 feet to
a stone bound set in the northerly sideline of Sutton Street. Thence
turning and running South 86 degrees 08 minuted 30 seconds West by the
northerly sideline of Sutton Street, a distance of 498.39 feet to a
stone bound. Thence turning and running in a southwesterly direction
by Sutton Street and by a curved line on an are of a circle having a
radius of 464 feet, a distance of 158.90 feet more or less to a atone
wall defining the boundary line of land now owned by the City of Law-
renee. Thence turning and running North 4 degrees 12 minutes 30 seo-
onds East by land of said .City of Lawrence, a distance of 595.00 feet
more or less. Thence turning and running North 8 degrees 30 minutia 30
seconds East by land of City of Lawrence, a distance of 316.56 feet.
Thence turning and running South 88 degrees 46.minutes 30 seconds East
by land of City of Lawrence, s distance of 624.30 feet. Thenoe turns
and running South 1 degree 13 minutes 30 seconds West by land of Charles
H. and Mildred H. Davis, a distance of 170,40 feet, Thence turning and
running South 88 degrees 46 minutes 30 seconds East by land of said
Charles H, and Mildred H. Davis, a distance of 250.00 feet to the point
of beginning. Containing an area. of 15.57 acres, more or less. Being
in greater part the some parcel of land conveyed to James J. Finegan b
Bradford H. Barden on July 1'6, 1892, and recorded on the same date in
North Essex Registry of Deeds, book 119, page 438, and by deed of Rapp
V, Sawyer at al to James J. Finegan dated August 4th,- 1924, and record
ad on September 18, 2924, in North Essex Registry of Deeds, book 504,
page 468, and subsequently conveyed by the aforesaid James J. Finegan
to Aguee M. Finegan, Eileen J. Finegan and Frances T. Finegan by a dee
dated November 14,1928, and recorded on November 17, 1928, in North Es
sex Registry of Deeds, book 543, page 548, and as shown on plans num-
bered 566 and 1103 also filed in said North Essex Registry of Deeds.
The amount of damages for the said taking of land Including the value
of all buildings, trees and any and all other structures situated on
said land is hereby established at Twenty Thousand ($20,000.00)Dollars
and the aforesaid amount is hereby awarded as damages for said taking
to Agnes M. Finegan, Eileen J. Finegan and Frances T. Finegan,the own-
ere of'reaord of said parcel of land. And His Honor, the Mayor of said
City, in behalf of the said City of Lawrence, Massachusetts, is hereb
authorized and instructed to sign this order of taking and cause the
City Beal of said City to be affixed thereto and to cause the said or
der of taking and the accompanying plan to be filed forthwith in the
Northern District of the Essex Registry of Deeds. This order of taki g
is adopted subjeat to the approval of the Massachusetts Aeronautics 0 m-

mission as required by the provisions of Chapter 90, Section 401, of
Massachusetts General haws and shall not be valid unless the approval
of said Commission is noted thereon or until the expiration of thirty
days from and after the date of submission of this order of taking to
the said Commission without action thereon by said Commission. I ap-
prove the above order of taking on )behalf of the said City of Lawrence

ss. Then personally appeared before me the said James P. Meehan, Mayo
of Lawrence and acknowledged the above instrument to be the free act
and deed of said City of Lawrence on this 1st day of May, 1945. Alfre
Courtemanohe, Notary Public. My commission expires Nov. 15, 1946. (No
iarial Seal). In City Council April 16, 1945. On motion of Alderman vote
McCarthy seconded by Alderman ,Scanlon, voted unanimously to order hear
ng held on question of adoption or order of taking and award of damages
at meeting of the City Council on April 50, 1945. I certify that no-
tioe of hearing was sent to owners of record by registered mail on April
18, 1945. Gordon E. Gaffney, City Clerk. In City Council April 30, vgte
1945. Hearing held as ordered. Atty. Irving W. Sargent present rep-
resenting the owners of the property. He stated that the owners,Agues
M. Finegan, Eileen J. Finegan and Frances T. Finegan do not object to
the taking as agreed upon provided that damages are awarded in accord-
anoe with agreement. On motion of Alderman Scanlon, seconded by Alder-
man McCarthy, it was voted unanimously to adopt the order of taking an
award damages to the owners of record in the sum of Twenty Thousand
($20,000.00) Dollars. Gordon E, Gaffney, City Clerk. I certify that
the above is a true and compared copy of the original order of taking
on file at the Office of the City Clerk of Lawrence and a true exoerpt
of aforesaid meetings of the City Council of Lawrence. Attest. Gordon

ing adopted by the City Council of Lawrenos at a meeting on the 30th
day of April, 1945, taking in fee simple by Eminent Domain a certain
parcel of land located on Button Street in the Town of North Andover,
adjacent to the Lawrence Municipal Airport, is hereby approved in ao-
oordenoe with Chapter 90, Section 40I of the General Taws of Massachu-
setts. Dated at Boston, Massachusetts, this Sth day of May, 1945. M&S
