This Special Permit was requested by Delta MB LLC c/o Dernoulas Supermarkets, Inc., Tewksbury, MA 01876. The application was filed with the Planning Board on January 17, 2019, The public hearing on the above referenced application was opened on February 19, 2019 and closed by the North Andover Planning Board on March 19, 2019. The applicant submitted a complete application, which was noticed and reviewed in accordance with the Town of North Andover Zoning Bylaw Section 195-8.4, 195-8.8,D(5), 195-8.10 through 8.17,and 195-10.7 and M.O.L. cAoA, Sec. 9. The Planning Board voted unauinaously (by a vote of 5-0) to grant the, Site Plan Review Modification, Common Parking Areas and Multiple Use and Reduction in Parting Special Permits. A special permit issued by the special permit granting authority requires a vote of at least four members of a five-member board. The.Applicant is hereby notified that should the Applicant disagree with this decision,the Applicant has the right, under MGL Chapter 40A, Section 17, to appeal this decision within twenty days (20) after the date this decision has been filed with the Town Clerk, The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Section 195-8.4, 195-8.8.D(5), 195-8.10 through 8.17, and 195-10.7 and M.G.L. 0.40A, Sea 9: FINDINGS OF PACT: 1) On September 2, 1998 the planning Board approved Site Plan Review Special Permit for the construction of a 5,619 square foot addition to the existing 228,678 square foot stropping center. 2) The specific site is an appropriate location for the project as it corrects existing ADA deficiencies within the existing 41.8 acres North Andover Mall shopping center parcel. The project will not detract from the neighborhood, as the use will continue to compliment the surrounding uses and provides for sufficient traffic, curb cuts, parking and circulation improvements as well as sufficient water, sewer and other utilities. 3) The project involves the removal and reconstruction of sections of sidewalk along the shopping center storefronts,regrading of the parking lot area from the access drive along the storefronts to the rear of the ADA compliant parking spaces, installation of curb islands at the beginning of the parking rows along the shopping center storefronts,even distribution and striping of new ADA designated parking spaces with new signage, installation of new cross walks,traffic control signage and striping along the irain drive aisle adjacent to thi storefront sidewalk and planting and maintenance of landscaping within island endcaps to be constructed at the beginning of the parking rows. 4) The site improvements will result in a loss of fourteen(14 parking spaces). Based on the current uses, 1,075 parking spaces are requixed(see letter from Paul Hutebins, dated October 2,2018). 6) The shopping center has been cited for ADA deficiencies, 7) The Applicant has provided a table summarizing parking demand and utilization for the site peals vehicular utilization rates. This table demonstrates a use or establishment need of a lesser number of parking spaces or loading bays than is required by§195-8.4 (please refer to the Table listed in the Decision documents) According to the parking utilization study submitted by RJ O'Connell & Associates,Inc,,there was a 39.4n/a parking space utilization rate during weekday evening peak hours and a 48.1%parking space utilization rate during weekend peak hours. 8) There will be no nuisance or serious hazard to vehicles or pedestrians. The site improvements are designed in accordance with the desiga standards as outlined under 521 CMR of the Massachusetts Architectural Access Board(KAAD)and the 2010 A.DA.standards for accessible design and published by the Department of Justice' The side improvements have been designed to promote safe circulation for both pedestrians and vehicles. 9) The site improvements will result in a 5,000 sq.fr.reduction in the amount of impervious surface area onsite due to the addition of landscaped curb islands at the beginning of the parking rows along the shopping center storefronts and the addition of a"teardrop"landscape island planned at the southerly end of the shopping center. 10)The Existing on-site catch basins will be pumped dry and environmental hoods will be installed on the outfall pipe. No new point source drainage discharge points are planned. 11)An Operation and Maintenance Agreement was submitted to the Conservation Commission dated March 11,2016. ' 12)The use as developed and described within the plan will not adversely affect the neighborhood. 13) There will be no nuisance or serious hazard to vehicles or pedestrians. 14)The North Andover Conservation Department has reviewed the application and determined that the Applicant must file a Request for Determination with the Conservation Commission, (See email from Jennifer Hughes dated Februg�iy 4,2019). 15)The North Andover Fire Department has reviewed the plans and determined that the Fire equipment and apparatus have unimpeded access to the site,the hydrants are not negatively impacted and the fire lanes are maintained throughout the project.(see email from Lieutenant Mike Beitne dated February 4, 2019). 16)The North Andover Police Department has reviewed the project and have no coacer€zs(see email fxom Lieutenant.Daniel Lauon dated February 5,2019). 17)The Building Department has reviewed the plans and determined drat according to the ADA,standards Bk 15820 Pg65 #8394 Delta 1Y1B LLC,350 Winthrop Avei�-te Map'26,Lot 6,8,9&Map 72,Lot 27,30,31,32 j Site PIan Review Special Permit Modification --parking Reduction Page 4 of 7 Chapter 5 section 208, a minimum of 17 standard parking spots and 4 van accessible spaces must be provided. Where parking serves multiple entrances to a facility, accessible spaces must be dispersed among entrances(see email-kom Paul Hutchins dated February 19,2019). 18)The Department of Public 'Works has reviewed the plans and 2016 Operation and Maintenance Plan and determined that the Operation and Maintenance Plan should be updated to include that all catch basins on site shall be inspecited a minimum of 4 times a year and cleaned out a minimum of once a year or when the sump is 50"9 full(see email from John Borgesi dated March 5,2019). 19)Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements 4 listed in Section 195-8.8.D,(5)and Section 8.3.5,butrequires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met; t 3 SPECXA1r.CONDITIONS-. 20) Permit Definitions: • The"Locus"or"Site"refers to the 41.8+/-sore parcel of land,as shown on Assessors Map 26,Lot 6, 8, 9 & Map 27, Loi 27,30,31,32, also known as 350 Winthrop Avenue, North Andover, Massachusetts 01845, • The"Plans"refer to the plans prepared by R3 O'Connell&Associates,Inc., 80 Montvale Avenue, Stoneham,MA 02180,entitled,"Site Plan forADA,Accessibility Improvements forNorth Andover Mall, North Andover, MA," dated January 16, 2019 consisting of a Cover Sheet, Sheet SV-1 through SV-3,OS-1,C-IA fiJarough.C-1 through C-8,L-1,Lr2. • The"Project"refers to the Common Parking Areas and Multiple Use,Facilities and a modification to a September 2,1998 special permit to perform cettain site improvements to correct existing A.DA deficiencies leaving 1.,011.parking spaces when 1075 spaces are required.This project is within the Business-3 (B-3),Business 4(B-4)&Residential 4(R-4)zoning districts. • The"Applicant"refers to Delta MB LLC, 875 East Street,Tewksbury,MA 01876,the applicant for the Special Permit,its successors and assigns. • The"Project Owner"refers to the person or entity holding the fee interest to the title to the Locus from time to time,which,can include but is not limited to the applicant,developer,and owner. i 21) As part of this decision,the Planning Board has found that the Applicant has provided sufficient information as part of its application to address all traffic,fiscal,community,and other impacts. This bond shall be in the form of a check made out to the Town of North Andover. This check will thin be deposited into an interest bearing bond account. 26) Final certification shall be prbvided that the Town of Andover Conservation Commission has approved the project. } 27)A revised Operation and Maintenance Plan shall be submitted to the Planning Department. , 28)In consultation with the Planning Director,the Applicant shall designate an independent construction monitor.The monitor shall read,sign,and return to the Planning Department the Letter of Agreement for Independent Monitors.Upon the start of site work the monitor shall make weekly inspections of the project(any suspension in nionitoring due to inactivity on the site shall be pre-approved by the Town Planner),provide monthly rc ports to the Planning Department,and detail any areas of non-compliance and corrective actions.The 14onitox will also provide reports following heavy rain events.The monitor must also be available upon notice to inspect the site accompanying a Planning Department designated official. 29) All applicable erosion control measures must be in place and reviewed and approved by the Planning Department. 30) Traffic and pedestrian,barriers shall be placed, at the limit of work, as necessary,to prevent access into active construction areas. These barriers shall be relocated during construction to coincide with each of the multiple phases of the proposed work,The Planning Department will be contacted prior to any cutting and or clearing on site.All existing trees that will remain in the landscaped areas are to be marked prior to the pre-construction meeting: 31) A pre-construction meeting'must be hold with the developer, their construction employees, Planning Departments Independent Monitor(and other applicable departments)to discuss scheduling of inspections to be conducted on the proje4 and the construction schedule. DURING CONSTRUMON' 32)Dust mitigation must be pekbrmed weekly, or more frequently as directed by the Director of Planning, throughout the construction process. 33)Any stockpiling ofmaterials dirt;wood,construction material,etc.)must be shown on aplan and reviewed and approved by the Plannin'�Staff. PRIOR TO THE FINAL RELL'ASE OF ALL SECURITY FUNDS 35)The Applicant must submit a letter from the engineer ofthe project stating that the parking,landscaping, and site layout substantially'comply with the plans referenced at the end of this decision as endorsed by the Planning Board. The,Planning Staff shall review the site. Any screening as may be treasonably required by the Planning Staff will be added at the Project Owner's expense. 36)A final as-built plan showing final topography,the location of all on-site utilities,Sidewalks,curb cuts, parking spaces and drainage hoiiities,including invert elevations of all stormwater structures,must be submitted to the planning Department,The as-built roust be provided in paper form as well as in SDl~ (Standard Digital File)format. Alternatively,the Applicant and/or property owner Wray provide a bond, determined by the Planning Board,to cover the full amount of the landscaping materials and installation if weather conditions do not pewit the completion of the landscaping prior to the Use of the parking lot. 37) The Planning Board must b� a majority vote make a finding that the site is in conformance with the approved plan. GENERAL CONDITIONS 38)Any plants,tree,shrubs, or fencing that have been incorporated into the Landscape Plan approved in this decision that die or fall into disrepair must be replaced by the project owner in perpetuity. 39) The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 40) Gas,Telephone,Cable and Electric utilities shall be installed underground as specified by the respective utility companies. ' 41)The hours for construction shall be lirnnited to between 7:00 a.m.and 5,00 p,m,Monday through Friday and between 8:00 a.m.and 5:00 p.m, on Saturday. 42)No open burning shall be do'rie except as is permitted during burning season under the Fire Department regulations. ' 43) The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. 44)Any action by a Town Board Commission,or Department,which requires changes is the plan or design of the building, as presented to the Planning Board, way be subject to modification by the Planning Board. 45)Any revisions shall be subr}.pitted to the Planning Director for review. Inspections will be conducted by a Professional Engineer registered in the Commonwealth of Massachusetts experienced in drainage design, Annual reports will be prepared detailing the status of the stormwater system and the maintenance pefformed. A copy of the annual report will be sent to the Town of North Andover, The owner agrees to comply with a minimum maintenance schedule as follows: 1. Annual inspection of culvert on an annual basis, the culvert will be inspected and the Condition of the abutment, pier, span barrel, headwalls, and wingwalls shall be noted. Any spalling, deterioration, cracking, corrosion, rust, or efflorescence shall be noted and reported on an as needed basis. The inspector shall also take note of the condition of the driveway's pavement, shoulders, and embankments.
