Hi Tim,
We received your comment regarding the existing water line per your review of the site plans for 335 Willow Street. The
original plans included notes for the abandonment of the existing water and existing sewer that noted the services are to
be abandoned, out and capped and coordinated with the North Andover Water and Sewer departments (Utility Plan--
Sheet 5 of 11). 1 am not sure if the water note was just overlooked, but I included a scan of the plan highlighting both the
sewer and water notes in red. The note for the existing water service is more or less the same as the existing sewer
abandonment note. Does this note for the water work for you or is there something else that you would like included?
Please let me know when you have a chance.

Hi Jean,
1 have reviewed the attached site plan for 335 Willow St and have the following comments:
1.All work in Willow Street requires a Street Opening Permit from DPW by the Contractor.
2.The proposed water lines must pass leakage and bacteria tests.
3.Abandonment of water and sewer service lines shall be done at the Town's main line in Willow Street by cutting and
capping.

Concerns on the Police Department end would be noise emissions and parking,
Having lived in the area in the past they have had early pickups with an individual using a steel mailet on a tanker truck to
settle the product, This issue was addressed.
I do believe they have overflow parking onto the street currently. I do not know how many more vehicles will be
displaced with the addition of the building. If the street can handle the additional parking we would have no issue.

The FD response is as follows;
• Project must meet the requirements of MGL 148, 780 CMR and 527 CMR,
• A Building Investigation and Evaluation report, in accordance with 780 CMR Ch 34 104.2.2.1 including the method
of compliance, be submitted in writing to the Building official to provide pertinent info that may assist all depts in
reviewing the proposed project.
• Project-specific site safety plan be implemented upon commencement of construction activities in accordance with
780 CMR Ch 33, 527 CMR Ch. 16 and NFPA 241
• Fire protection systems are installed in accordance with 780 CMR Ch 9, MGL 148 and NFPA 13.
• Documentation relative to any planned modifications or new installation of fire protection systems, be submitted in
accordance with 527 CMR Ch 9 901.2.1
• Request installation of a Bi-directional amplifier/emergency responder communications system installed in
accordance with 780 CMR 916 and North Andover FD BDA spec.
• Fire alarm systems are installed and monitored in accordance with 780 CMR and NFPA 72.
• A secured key access box will need to be installed in accordance with North Andover By-Law ss. 50-12, if not
already in place,
• A swept path analysis be performed of the site and parking areas to ensure FD apparatus has adequate access to
the buildings. All FD access shall be in accordance with 527 CMR Ch 18.

Thanks Jean and their statement is incorrect and a little misleading. They have only shut down one piece of equipment at
a time and there are potentially two pieces of equipment that may be creating a potential noise issue together. We need
them to shut down both pieces of noise generating equipment at the same time so we can get a baseline of
ambient noise to determine if their equipment, while running together, crosses the threshold of 10dB above ambient
background levels... Shutting down one at a time and not both is all we have been able to get them to do. I hope we will
be able to do both pieces together next week. They have to schedule it with their production processes.

Dear Ms. Enright and Board Members:
We are in receipt of a comments for the above-referenced project from various town departments.
This response letter, along with the enclosed revised site plans and documentation, has been
prepared to address the comments raised by each town department.
This response letter is organized in a format to address each department's comments independently
to help simplify the review.
Fire Department
1. Attached is a letter from Dacon/PDA(architects)dated August 11, 2020 addressing comments
from Lt. Michael Beirne.
2. Also attached is a swept path analysis for the site and parking area showing the North
Andover Ladder Truck maneuvering around the site.
Police Department
1. The site complies with the North Andover Zoning Bylaw parking requirements for the proposed use.
The existing street parking issue located at 351 Willow Street is actively being addressed and will
terminate.
2. No new noise issues above allowable limits are anticipated for the project at 335 Willow Street. If
required noise cancelling measures will be implemented. Nick Green, Environmental Health and
Safety Manager at Bake N Joy, has met several times with Stephen Casey, North Andover Health
Inspector, at Kathleen Drive to assess noise from 351 Willow Street with a hand-held sound level
meter. The conclusion was there was no discernable difference in noise levels after shutting down
the equipment at the Bake N Joy facility at 351 Willow Street,
Department of Public Works
1. A street opening permit will be obtained by the contractor prior to the commencement of any work
in Willow Street.
2. The proposed water lines will meet all requirements of the North Andover Water Department
requirements including leakage and bacteria test.
3. The existing water and sewer lines will be cut and capped at the Town's main line and will be
coordinated with the Water and Sewer Department at time of abandonment.

Dacon/PDA is in receipt of the e-mail you provided us from Lt. Michael Beirne of the North Andover Fire
Department to lean Enright and William McCarthy(attached for reference)regarding the proposed work for the
Bake'n Joy facility at 335 Willow Street.
Our response to the bullet points in the e-mail is as follows:
• The proposed work will be designed and built in accordance with all current codes, including those listed
in your e-mail as applicable to this facility.
• A building investigation and evaluation report in accordance with 780 CMR Chapter 34 104,22.1 will be
provided at the time of formal submission of the building permit application.
• A project-specific site safety plan in accordance with the referenced laws and codes will be provided with
the application of the building permit.
• It is the intent to have both the new and existing portions of the referenced building to have a fire
suppression system Installed in accordance with current referenced codes. Full drawings and calculations
will be provided at the time of building permit application.
• As noted above, we will provide full engineered drawings and calculations for the proposed fire
suppression system at the time of the building permit application In conformance with the referenced
code sections.
• At the appropriate time,an analysis of the building will be conducted to confirm the need for a BDA system
and/or aid in the design of said system if the conditions warrant. This will be completed in conformance
with the referenced codes and North Andover BDA specification.
• It Is the intent to have the building fire alarm system upgraded to all current codes and standards
throughout the new and existing portions of the building. Work will be completed in conformance with
the referenced code.

• Dacon or its subcontractor will provide a secured key access with the final master key(s) in accordance
with Town of North Andover Bylaws. The location of the secured key box will be indicated on the drawings

reviewing the proposed project.
• Project-specific site safety plan be implemented upon commencement of construction activities In accordance with
780 CMR Ch 33, 627 CMR Ch. 16 and NFPA 241
• Fire protection systems are Installed in accordance with 780 CMR Ch 9, MGL. 146 and NFPA 13.
• Documentation relative to any planned modifications or new Installation of fire protection systems, be submitted in
