As shown on the attached Architectural Plans,the Petitioner proposes to construct an elevator hoistway, machine room, access lobby, and then install a hydraulic two-stop elevator into the hoistway (the "Project"). A special permit is required because the Property sits within the Corridor Development District 2 and §195-16.5 (uses in Corridor Development District subject to special permit) requires that "[n]o building or structure in excess of 3,000 gross square feet of building area shall be constructed, reconstructed, erected or altered in the Corridor Development District without the granting of the special permit." §195-16.9 of the Bylaws also says site plan review may be applicable. The building on the Property has 7,539 gross square feet of building area. The new lobby, elevator holstway and elevator machine room, which will be constructed adjacent to the existing building footprint will add collectively 295 gross square feet to the total gross square foot area of building. The following materials are provided in support of this request: 1. Special Permit -Site Plan Review Application (Exhibit 1); 2, Certified Abutter List (Exhibit 2); I IICAo1No6,itC North Andover Planning Board April 29, 2019 Page 2 3. Certificate of Payment of Municipal Taxes, Fees, Assessments, Betterments and Other Municipal Charges (Exhibit 3); 4. Two sets of full sized plans (24x36) and three sets of reduced plan copies (1147) of Site Plan (Exhibit 4); 5. Two sets of full sized plans (2436) and three sets of reduced plan copies (11x17) of Architectural Plans (Exhibit 5); 6, Five copies of Drainage Mitigation Report and Calculations (Exhibit 6); 7. Electronic PDF versions of all submission materials (Exhibit 7); and 8. Two checks in the amounts of$300 (Special Permit) and $441.30 (Site Plan Review Fee) (Exhibit 8), I respectfully request the following waivers to the Bylaws: 1. §195-16.5 A. (1) Uses Subject to Special Permit, and §195-8.14 E. (19)Traffic Impact Study A waiver is requested for the submission of a traffic impact and mitigation plan/study by a professional traffic engineer/consultant. (2) Uses Subject to Special Permit A waiver is requested to requirement to provide evidence that there are no reasonable alternatives to site layout, site design, and parking configuration, The existing conditions of the Property are not being altered by the Project. The location of the Project was driven by the structural limitations in accessing main internal staircase and landings of building. The Project is located on the busy Rte 114 side of Property and makes no changes to current parking configuration. Submission of Special Permit Application and Plan A waiver is requested for eight copies of site plan to be submitted. Petitioner would like to follow Town of North Andover's Special Permit-Site Plan Review Instructions it was provided, which require submittal of two full sets of plans, three sets of reduced plans, and electronic PDF copy of all submission material. 4. §195-8.13 D. Procedures, and §195-16.9 A. Submission of Special Permit Application and Plan A waiver is requested of any requirement of Petitioner "to pay for necessary professional services required to adequately review and analyze the contents of any site plan or impact study requested by the Board" or "outside engineering review escrow fees" Given the limited size and scale of this Project, Petitioner is hoping all such review and analysis can be handled in-house by Town of North Andover personnel. 5. §195-16.9 A. Submission of Special Permit Application and Plan A waiver is requested for the submission of form entitled "Corridor Development District Special Permit Application" to the Board. As there is no such form currently available, The Planning Department has given Petitioner a "Special Permit-Site Plan Review Application" to submit. 6. §195-8.14 B. Information Required A waiver is being requested to prepare the Site Plans at a scale of one (1) inch equals forty (40) feet, The Site Plans are at a scale of one (1) inch equals twenty (20)feet. 7. §195-8.14 E. (7) Drainage Area Map A waiver is requested for submittal of drainage area map. Petitioner finds these duplicative of those found in Article 16 of Bylaws for Corridor Development District, Petitioner desires to abide by all similar provisions and associated standards and requirements of said article.
