NOTICE OF DECISION (INSUBSTANTIAL CHANGE)

HISTORY AND BACKGROUND
On February 17, 2015 the Planning Board approved a Site Plan Review Special Permit to allow for the
construction of an 11,168 SF building addition, construction of a new parking area, construction of a new
stormwater management system, partial removal of an existing berm at the rear of the building, and to
allow for a 35% reduction in the required parking spaces for the facility.
A part of the approved Notice of Decision a condition required that, "Approximately one year after the
issuance of the Certificate of Occupancy the Applicant must submit evidence that usage of the newly
constructed parking area has not created any hazardous impact on traffic utilizing Route. 125 (i.e.
headlights do not impact drivers on Rt. 125)."
On November 17, 2016 the Applicant stated that after clearing the site they would like to be proactive
against any potential impact to Route 125 and erect a fence now rather thair a year after the Certificate of
Occupancy has been issued. The fence will be 8 feet high. Additionally, the fence that was proposed on
top of the berm at 6 feet will now be 8 feet.
FINDINGS OF FACT
The proposed changes are deemed to be Insubstantial and do not alter either the intent or the conditions of
the original Special Permit. The changes do not require a vote of the Planning Board.
CONDITIONS
All plan revisions will be reflected on the final as-built drawings.

Hi Jen & Rebecca,
Please find enclosed a revised site plan showing the extension of the proposed fence around the parking lot. A
condition exists in the Planning Board approval that one year after the parking lot was constructed an
evaluation would be done to see if the parking tot was having an impact on the traffic on Rte 125 and if there
was an impact the exsiting fence would be extended to encompass the parking lot. Now that the site is cleared
our client would like to move forward with extending the proposed fence now. They would also like to change
the fence from 6 feet to 8 feet; they have already discussed the height change with the Building Inspector and
he does not have a problem with it. The possible need for the extension to the fence was discussed with the
Conservation Commission during the permitting process and I believe the Commission did not feel the need to
add a condition relating to the fence extension as they thought the extension of the fence could be handled by

the Conservation office. We are hoping that the fence extension can be approved by both the Conservation
and Planning offices without having to go before the Planning Board and Conservation Commission. If you
