NOTICE OF DECISION (INSUBSTANTIAL CHANGE)

HISTORY AND BACKGROUND
On February 17, 2015 the Planning Board approved a Site Plan Review Special Permit to allow for the
construction of an 11,168 SF building addition, construction of a new parking area, construction of a new
stormwater management system, partial removal of an existing berm at the rear of the building, and to
allow for a 35% reduction in the required parking spaces for the facility. Since the permit was issued,
Muffin Realty Trust had an opportunity to purchase 160 Flagship Drive, North Andover. Based on the
purchase of this building the Applicant evaluated the potential use of the proposed building addition and
proposed some minor modifications to the building layout. The Applicant was granted an Insubstantial
Change on July 26, 2016.
During the construction of the drainage pond it was determined that the existing electrical conduit that
enters the property from Route 125 is not located where it was believed to be and it is actually located
along the southerly edge of the proposed drainage pond. This conduit is encased in concrete and based on
the elevation of the concrete encasement it interferes with the proposed drainage pond and the proposed
drain line to the pond. The Applicant has re-designed the drainage pond and drain line location
accordingly. The new proposed pond and forebay provide the same storage as the original design. In
order to make up for the loss in volume in the pond and forebay the Applicant has extended the westerly
end of the pond.
FINDINGS OF FACT
The Town's Stormwater Review Consultant reviewed the changes and confirmed that the proposed
modifications are minor in nature and will not impact the functioning of the stormwater system.
The proposed changes are deemed to be Insubstantial and do not alter either the intent or the conditions of
the original Special Permit. The changes do not require a vote of the Planning Board,

All plan revisions will be reflected on the final as-built drawings.
