Call to Order called at 7:30 p.m. Members Present: Alexandria A. Jacobs, Esq., Michael T. Lis, Frank J. Killilea, Ronn R. Faigen, Steven R. Seide, Laura Craig-Comin, James M. Testa, and Matthew J. Ginsburg Staff Present: Jennifer Battersby Gavel given to: Alexandria A. Jacobs, Esq. Chair reads supplemental legal notice into the record. Chair waived the Pledge of Allegiance due to the fact that no flag was present. 2. Acceptance of Minutes Motion made by R. Faigen to accept the January 9, 2024 meeting minutes. Seconded by M. Lis. A. Jacobs voted yes. M. Lis voted yes. F. Killilea voted yes. R. Faigen voted yes. J. Testa voted yes. M. Ginsburg voted yes. L. Craig-Comin voted yes. The vote to approve is unanimous. 3. New Public Hearing of 94 Lyman Road The petition of Colleene Kiley for property at 94 Lyman Road(Map 020.0, Parcel 0069), North Andover, MA 01845. The Applicant is requesting a Variance pursuant to Town of North Andover Zoning Bylaws Section 195-7.3.0 Yards (setbacks), Table 2: Summary of Dimensional Requirements for one rear setback in the R-4 Zoning District for the purpose of constructing an approximate 3 ft. by 8 ft. addition onto the existing house as part of a kitchen renovation. Specifically, Applicant has requested a rear setback needing a relief variance of 18.6 ft. (rear setback proposed is 11.4 ft., rear setback required per Table 2 is 30 feet). Clerk reads legal notice into the record. Colleene Kiley summarizes her request for a variance and states that the kitchen renovation is much needed and there is nowhere else to place the addition. Applicant has eighteen (18) letters in support of the project. Notices and agendas are to be posted 48 hours in advance of a meeting excluding Saturdays,Sundays,and legal holidays.Please keep in mind the Town Clerk's hours of operation and make necessary arrangements to be sure that posting is made in an adequate amount of time.A listing of topics the Chair reasonably anticipates will be discussed at a meeting are to be listed on the Agenda.Note:Matters may be called out of order and not as they appear in the Agenda. Faigen voted yes. S. Seide voted yes. The vote to close is unanimous 5-0. The board deliberates. Motion made by F. Killilea to grant the variance pursuant to Town of North Andover Zoning Bylaws Section 195-7.3.0 Yards (setbacks), Table 2: Summary of Dimensional Requirements for one rear setback relief variance of 18.6 ft. The following documents/plans were submitted with the application or referenced at the public hearing: (1) Plot Plan prepared by John Abagis &Associates, Professional Land Surveyors dated August 30, 2023, containing one (1) page; (2) Plot Plan showing proposed kitchen addition prepared by John Abagis &Associates, Professional Land Surveyors dated August 25, 2023, containing one (1)page; (3) Proposed Elevation & Floor Plans prepared by Blackdog Builders dated November 28, 2023, containing one (1) page (Sheet 2); and (4) Proposed Renderings prepared by Blackdog Builders dated December 8, 2023, containing three (3) pages (Sheets 1 through 3). 4. Miscellaneous a. Community Housing Inc. 2023 Report for Merrimac Condo dated January 29, 2024 b. Community Housing Inc. 2023 Report for Orchard Village dated January 29, 2024 Chair states that CHI serves as the monitoring agency and has reported no sales/resales of 40B units for the year 2023. 5. Adiournment: 8:00 p.m. Motion made by F. Killilea to adjourn the meeting. Seconded by S. Seide. A. Jacobs voted yes. M. Lis voted yes. F. Killilea voted yes. R. Faigen voted yes. L.
