Dear Ms. Gregoire:
On behalf of the Town of North Andover, TEC, Inc. conducted a technical review of the
April 4, 2019 Site Plans for the proposed project to be located at 701 Salem Street.
Virginia Inc. ("Applicant") submitted the following documents, which TEC reviewed for
conformance with the Town of the North Andover Zoning Bylaws and generally accepted
industry standards:
• Site Plan Set, 701 Salem Street, North Andover, MA, prepared by Civil Design Group, LLC.
dated April 4, 2019;
Under review of the document and plans, TEC has compiled the following comments for the Board's
consideration:
1. It is noted that the applicant is to apply for a special permit waiving the minimum parking space
requirement, as the proposed number does not meet the required.

2, Section 8.5,C(3)—The Applicant should provide a driveway connection to Abbott Street with a
15-foot radius (minimum).
3. Section 8.5.C(3)—The Applicant should adjust the 35.5-foot width on the Abbott Street entrance
to be 25-feet(maximum).
4. The driveway connection to Abbott Street does not appear to adequately meet the existing
granite curb at the roadway gutter line. The Applicant should provide a new driveway apron,
adjust curbing as needed, and provide new ADA compliant ramps at this driveway connection.
5. Section 8.5.A—The Applicant should adjust parking spaces 9 through 32 to be within the 3-foot
parking setback, or request a waiver from the setback requirement.
6. The Applicant should explore the possibility of retaining the existing 48" diameter tree along
Salem Street.

7. The Applicant should label the location of the one loading space on the Site Plan that meets the
requirement of Section 8.5 of the Zoning Bylaw.
8. The Applicant should include the limit of work on all sheets.
9. The Applicant should confirm the locations of the lights on the photometric plan align with the
photometric calculations. The calculations show an Fc of 3.7 in parking space#14 but a light is
not shown in the area.
10. Snow storage west of the proposed parking lot is shown at the top of the slope, draining to the
abutting property. Snow storage in this area should be revised to limit off-site runoff.
11. The Applicant should coordinate with the Town of North Andover Fire Department to confirm
that the provided fire access is acceptable.
12. TEC encourages the Applicant to coordinate directly with the abutting residential owners to
design a "residential buffer zone" that is amenable to all parties.
13. The Site Plan (sheet 4) shows a proposed building expansion of 8,700 square feet, but the
architectural plan shows a 7,300 square foot expansion. The Applicant should clarify which
dimension is accurate.
14. TEC does not agree with the use of"Storage" as a use in the required parking formula. It
appears that the deliverylstorage area in the floor plan are a vital part of the proposed J&M
Market (retail), and not a separate industrial storage use as listed in the Town of North Andover
required parking tables.
15. The Applicant should clarify the required parking calculations, specifically if each individual area
in the equation is meant to be separate uses. For example, Restaurant is comprised of 1,900
SF + 350 SF +400 SF = 2,650 SF. Is this meant to be one restaurant use? Or three separate
restaurants?
16. The Applicant should clarify if the existing refuse and trash removal operations are adequate for
the proposed expansion, or if a new, larger container will be needed.

4n behalf of the applicant, Virginia, Inc., Civil Design Group, LLC (CDG) is in receipt of your Town
Department comment email dated 05/29/19. In coordination with the development team, CDG's
responses are provided in bold below the original comments and supporting plans and documentation
are enclosed herein:
Fire Department
1. While an analysis was already shown on the plan, we'd like to see how the vehicle
compares to our ladder to ensure it will be able to navigate the site.
The site plan has been revised to reflect the North Andover fire truck apparatus
including the specifications provided by the Fire Department. As depicted on the
plans, the apparatus circulates throughout the site.
2. Where will the fire alarm panel be located and how will it interface with existing fire
alarm?
The project will include replacing the existing fire alarm panel to be installed in the
new electrical room. All devices and wiring shall be replaced with new. Existing
FACP is 22 years old and the system is approaching its expected life.
3. Where will the new sprinkler riser be [right side?] and how will it interface with the
existing sprinkler system? Would like to see an analysis of fire protection systems done
by a design professional to ensure systems in old and new sections can work cohesively
as required by code.
The existing sprinkler riser will stay where it is. The new 6" line on the right side of
the building has been removed from the plans. Since the hazard level is not
increasing and the expansion is not significant, the existing 4" line remains

acceptable to protect the existing and proposed building area. This will be reviewed
during the design document phase.
4. Plan shows FD connection on right side of proposed building. Nearest hydrant appears to
be more than 100 ft away. Per NFPA 14 [2013 ed.] the nearest hydrant must be within
100 ft of a Fl) connection, May need to add a hydrant if so.
The plan.is to have the Fl) connection in the same location. The proposed 6" line has
been removed from the plans.
5. Wire building for radio enhancement system for public safety - fire and police radios per
NFPA 72 Ch 24, 527 CMR 11.10.2 and 780 CMR 916.
A new bi-directional amplifier will need to be installed throughout the building. If
not, a test will need to be performed to determine if the fire alarm signal would be
acceptable without the BDA.
6. Institute a site safety plan during construction in accordance w/NFPA 241 and 527 CMR
Ch 16.
The general contractor will provide their Standard for Safeguarding Construction
at the time of permitting.
Buildine Department
1. It is allowed use in General Business zoning.
No response required.
2. 1 have calculated the parking at 72 to include 2 standard handicap I Van handicap. They
are proposing 70.
No response required.
3. All set backs are correct to include 15 ' abutting residential zoning.
No response required.
4. Lighting design appears correct.
No response required.
5. Building Height and Lot coverage.comply with GB zoning.
No response required.

6. Signage must be permitted to meet bylaw sizes and regulations.

permit approval process.
Department of Public Works
Water
1. The water service for 25 Abbott Street appears to cut through the Applicant's property
and may need to be re-routed due to proposed construction,
The applicant has discussed the water service relocation with the Owners of 25
Abbott Street and have agreed to move the service to Abbott Street. The applicant
will work with the Water Department prior to construction to determine the
preferred connection point within Abbott Street.
2, The existing water lines for the Plaza do not appear to be accurately shown on the plan.
The plans have been revised to reflect the correct water services lines.
3. The former water service line as shown on the plans for the Plaza is shut off at the curb
stop and must be abandoned at the Town's maul line.
The plans have been updated to include removal of the remaining water service line
from the curb stop to the main.
4. The existing service line for 695 Salem St is not shown. It should be added to the plans
and abandoned at the Town's main line prior to demolition
The plans have been updated to depict the existing water service line for 695 Salem
Street,
5. Water services for 37 and 49 Abbott Street have been re-routed to Abbott Street.
The remaining water service lines from curb stop to main line for 37 and 49 Abbott
Street are approximately 100 feet north of the anticipated limit of work between lots
677 and 687 Sale Street.

Sewer
1. The drain maffliole as shown on the plan may be a sewer manhole on the service line for
695 Salem Street. It should be abandoned at the right location, which can be determined
at a later date.
The plans have been revised to reflect the structure as a sewer manhole and
furthermore, noted to remain in the post development condition.
2. It appears there is a sewer easement to the rear of the property, not shown on the
plans. Research is necessary to determine who has rights to this sewer line, including 25
Abbott Street.
The Owner has indicated that the sewer easement is for the benefit of 695 Salem
Street and is not aware of any rights for the benefit of 25 Abbott Street. However,
the Owner is willing to grant 25 Abbott Street sewer easement connection rights
provided all work is done so at the expense of 25 Abbott Street.
Health
We do not have any issues with the site plan and only have one comment regarding the
dumpster which is already existing. It was pre-existing when the Town of North
Andover Board of Health adopted Dumpster Regulations which now require it to be
located 20` from the building. It is proposed in the same location and appears to be
within 20'. We will work with them on the interior design when it moves along to that
stage in the permitting process.

The applicant does not want to retain the existing tree along Salem Street.
According to the Owner, the electric company requested that the tree be
removed in order to mitigate power outages.
7. The Applicant should label the location of the one loading space on the Site Plan that
meets the requirement of Section 8.5 of the Zoning Bylaw.
Space 70 on the Site Plan has been expanded to be 12'x25' and is labeled as
"Employee Parking/Loading Area" to satisfy the requirement. The inside curb line
adjacent to this space has been modified to maintain the 24' drive aisle.
8. The Applicant should include the limit of work on all sheets.
The limit of work line has been added to the Cover sheet and Site Plan sheet.
9. The Applicant should confirm the locations of the lights on the photometric plan align
with the photometric calculations. The calculations show an Fc of 3.7 in parking space
#14 but a light is not shown in the area.
The revised photometric plan shows accurate Fe values based on the locations of the
proposed site lights.

12. TEC encourages the Applicant to coordinate directly with the abutting residential owners

The Owner has reached out and is currently working with the abutters to satisfy
their concerns.
13. The Site Plan (sheet 4) shows a proposed building expansion of 8,700 square feet, but the

The proposed building expansion is approximately 8,700 SF. The 7,300 SF indicated
on the Architectural Plan represents the net increase in building area since there is
approximately 1,400 SF of demolition.
14. TEC does not agree with the use of"Storage" as a use in the required parking formula. It
appears that the delivery/storage area in the floor plan are a vital part of the proposed
,1&M Market (retail), and not a separate industrial storage use as listed in the Town of
North Andover required parking tables.
The building inspector has reviewed and provided written feedback on the project.
The Building Inspector has confirmed that 72 required parking spaces meets the
applicable zoning requirements.
15. The Applicant should clarify the required parking calculations, specifically if each
individual area in the equation is meant to be separate uses. For example, Restaurant is
comprised of 1,900 SF + 350 SF+400 SF=2,650 SF. Is this meant to be one restaurant
use? Or three separate restaurants?
The restaurant uses are limited to a pizzeria, a sit down restaurant, and a Dunkin'.
16. The Applicant should clarify if the existing refuse and trash removal operations are
adequate for the proposed expansion, or if a new, larger container will be needed.
The applicant has confirmed that the existing refuse and trash areas can
accommodate the proposed expansion.

Good Morning Phil,
During the last meeting, the Planning Board asked for screening (a fence or shrubs)along Salem Street to shield abutters
from headlights. Please make sure that this is incorporated into the plan revision. Also, I spoke with Lt. Daniel Lanen
about the large vehicles that park along Abutt Street, he suggested the installation of"no parking"signs on the Taki's side
of the street(the addition of this still requires approval by the Board of Selectmen). Lt. Lanen expressed that he thought
that the street was wide enough to allow parking on the other side of the road, but I will need to check with DPW to see
what their thoughts are on this. Lt. Lanen has confirmed his attendance at the July 30th meeting as requested by the
Planning Board. Please let me know if you have any questions or concerns.

Thanks Monica. We have incorporated the signage as indicated below and also improved the parking areas to provide
larger spaces for trucks. We are still working out the fencing/LA and we anticipate filing tomorrow, We can hand deliver

Below in the link, please find our HW response to 2nd round of comments letter and revised plan set for your review. In
addition to the making the requested peer review changes, the following is a list of changes incorporated from the
Planning Board takeaways:
1. The parking plan has been improved upon by:
a. Adding 'truck only' signage for spaces 1, 2, 69 and 70
b. Elongated spaces 3-8 to 26 feet
2. Updated fire truck circulation per Eire Department comment.
3. Updated the Landscape plan per Con Com comments,
4. Updated water service connections per water department comment.
5. Lowered the perimeter building wall 2 feet and the ridge of the main roof 5'4'.The gable over the market entrance
was dropped 2'-0", The floor plan is the same.
6. In addition, it is noted that while the Owner/Applicant has added the fence along Salem Street for screening, the
Owner continues to believe that this is not an ideal solution for reasons discussed at the hearing (ie, likely to be damaged
and/or knocked over given site constraints, will not have intended effect based on circulation, reduced site lines for
traffic/safety and much less aesthetically pleasing.) It is noted that the Applicant has approached neighbors and offered to
install a row of arborvitaes for screening on the property of the neighboring land owners across Salem Street and Abbott
Street, along their property lines, in lieu of fence and has yet to hear back from a number of them. It is believed that this
would provide a better solution to address the stated concerns of the neighbors across the street with respect to buffering
and screening for both fighting and noise. The Owner/Applicant would agree to a condition in a decision where the
Owner/Applicant could at its option elect to install such landscape screening,with the consent of the two applicable
neighbors across Salem Street, in lieu of installing the fencing along Salem Street.
