ATRUE COPY' AT C-ST": (� YArt'[1cnlC,4py , -ro1YA��let i FjEGIStEn ar OF-EDS Bk 14564 Pg7 #6114 1812 Turnpike Street Map 106D,Parcel 47 Site Plan Special Permit-Auto Repair FaoiliW!=-Sub Shop The Planning Board herein APPROVES a Site Plan Review Special Permit to allow the renovation to an existing structure in order to construct a 5,000 +1- sq. ft. one and a half story building for an auto repair facility with an attached pizza/sub restaurant construction of a porous pavement parking area, associated landscaping, stormwater management and installation of utilities within the General Business (GB) Zoning District, The project is located at 1812 Turnpike Street, North Andover, Massachusetts, 01845, Assessors Map 106D, Parcel 47 within the General Business (GB) Zoning District, The parcel totals approximately 40,521 sq, ft. with frontage on Turnpike Street. This Special Permit was requested by C&C Auto Corporation,268 Raleigh Tavem Lane,North Andovor,Ma 01845. The application was filed with the Planning Board on or about November 13,2015, The public hearing on the above referenced application was opened on December 15, 2015, with additional hearings on January 5, 20)6, January 19, 2016, February 2, 2016, and closed by the North Andover Planning Board on February 16,2016. The applicant submitted a complete application,-which was noticed and reviewed in accordance with Section 8.3, 10.3 and 10,31 of the Town of North Andover Zoning Bylaw and MOL C.40A,Sec.9. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Section 8.3 and 10.3; FDMWGS OF FACT: 1) The specific site is an appropriate location for the project as it is the construction of an auto repair facility with an attached pizza/sub restaurant in a General Business District (G13), and includes changes to the storrawater management system that will improve the drainage on the lot, as well as landscaping that will provide a buffer to Route 114 existing properties. 2) Based on input received from both the Planning Board and the Planning Board's stormwater peer review consultant, Eggleston Environmental, the applicant has provided sufficient stormwater management facilities to mitigate flow of stormwater by providing a combination of porous pavement, a surface infiltration basin, and an existing drainage pipe. (See L. Eggleston memo dated January 14, 2016, Haight Engineering, PLLC review response memo dated January 29, 206, Eggleston Environmental response email comments dated February 1, 2016, and February 12,2016) 3) The Traffic,Assessment submitted by the applicant(and referenced in this document)concludes that the redevelopment is anticipated to have no signifteant overall traffic impact. The analysis indicates that the proposed use does not racet or exceed any WPA thresholds and that the accesses are suffiolent and adequate for the intended uses. 4) There are no' changes required to the accesses to accommodate the now uses. The proposed project will utilize the existing, shared 26' wide driveway (With the abutting lot) off of Burry Street and the main 29' wide entrance off of Turnpike Street. 5) The property is currently serviced by an onsitc,subsurface disposal system. Ws system will be abandoned and the new building will be connected to municipal sewer and water. 6) The redeveloped building will be constructed within the existing building envelop thereby maintaining current building setbacks to property lines. 7) The use as developed will not adversely affect the neighborhood and ihare,will be no nuisance or serious hazard to vehicles or pedestrians. 8) Finally the Planning Board finds that this project generally oomplies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.3.5, but requires conditions in order to be filly in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met-, 2 i Bk 14564 Rg8 #6114 1812 Turnpike Street Map 106D,Parcel 47 Site flan Spacial Permit-Auto Repair Faaility(Pi=-Sub Shop PFRwr DFFRo'noNs and WAMPS 1 9) The"Locus"or"Site"refers to the 40,521 sq. ft, parcel of land with land fronting on Turnpike Street as shown on Assessors Map 106D, Parcel 47, and also known as 1812 Turnpike Street, North Andover,Massachusetts, 10) The "Plans" refer to the plans prepared by Haight Engineering, PPLC, 181 Watson Road, Dover, N.H. 03920, entitled "Site Development Plan for Turnpike Automotive Repair,North Andover, MA.", dated November 11, 2015, as most recently revised on February8,2016, consisting of Sheets 1 through 10,and L-1. 11) The"Project"refers to the renovation to an existing structure in order to construct a 5,000 +!- sq, ft. one axtd a halt' story building fear an auto repair facility with an attached pizza/sub restaurant, construction of a porous pavement parking, area, associated landscaping, stormwater management and installation of utilities within the General Business (GB)Zoning District, 12) The "Applicant' refers to C&C Auto Corporation, 268 Raleigh Tavern Lane,North Andover, MA 01845,the applicant for the Special Permit,its successors and assigns. 13) The "Project Owner" refers to the pemn or entity holding the fee interest to the title to the Locus from time to time, which can include but is not limited to the applicant, developer, and owner. SPECIAL CONDITIONS 14) PFJOR TO T=START OF SITE'WORD OR CONSTRUCTION A. Three (3) copies of the signed, recorded decision and the recorded plans must be delivered to the Planning Department. B. In consultation with the Town Planner, the Applicant shall designate an independent construction monitor. The monitor shall read, sign, and return to the Town Planner the Letter of Agreement for Independent Monitors. The monitor shall make weekly inspections of the project, provide monthly reports to the Planning Department,and detail any areas of noncompliance and corrective actions. The monitor will also provide reports following heavy rain events. The monitor must also be available upon notice to inspeot the site accompanying a Planning Department designated official, C. A detailed construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. D. Confirmatory test pits shall be required in each proposed irtfrltration location. B. Evidence of a MassDOT access pemiit allowing access to shut off the existing water at the main must be submitted to the Planning Department. F. A bond in the amount of fifteen thousand dollars ($15,004,00) shall be posted for the purpose of insuring that the site is constricted in accordance with the approved plan and that a final as-built plan is provided, showing the location of all on-site structures. This bond shall be in the form of a check made out to the Town of North Andover. This oheck will then be deposited into an interest bearing bond account, G. All stormwater management best practices shall be maintained as specified in the Storrnwater Operations and Maintenance Plan that was submitted with the application. H. All applicable erosion control measures must be in place and reviewed and approved by the Planning Department, These measures must include erosion control to protect all existing and proposed catch basins and oil traps on the site or an the streets adjacent to the project. I. This "Projeot7 approval does not include automobile sales of new or used eats, This restrictions required due to the parking spaces provided and the parking limitations of the site. If the development chooses to include automobile sales,a modification,to the Site Plan Special Permit must be applied for through the Planning Deparment. 15))M1 G CONSTRUCTION A. Dust mitigation must be performed weekly, or more frequently as directed by the Town Planner,thmughout the eomtruction process. B. Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off to minimize ,any dust problems that may occur with adjacent properties. C, It shall be the responsibility of the developer to assure that no erosion from the construction site sball occur which will cause deposition of soil or sedimant upon adjacent properties or public ways,except as normally ancillary to off-site construction. Off-site erosion will be a basis for the Planning Board making a finding that the project is not it compliance with the plan;provided,However, that the Planning Board shall give the developer written notice of any such finding and ten days to cure said condition. 16) PRIOR TO A CERTIFICATE OF OCCUPANCY A. The applicant must submit a letter from the architect and enginm of the project stating that the building, landscaping, lighting and site layout substantially comply with the plazas referenced at the end of this decision as endorsed by the Planning Board and that the stormwateir management structures are functioning as designed, Alternatively,the applicant and/or property owner may provide a bond,determined by tho Planning Board,to cover the full amount of the landscaping materials and installation if weather conditions do not permit the completion of the landscaping prior to the use of the building, $. All stormwator structures shall be cleaned, in Accordance with the approved Storrnwater• Operation&Maintenance Plan. C. The contractor shall oontact Dig Safe at least 72 hours prior to commencing any excavation. B. Gas,Telephone,Cable and Electric utilities shall be installed underground as specified by the respective utility companies, C. The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m. Monday through Friday and between 8:00 a,m, and 5:06 p.m.on Saturday. D. No open burning shall be done except as is permitted during burning smon under the 'Fire Department regulations. E. The owner shall apply to the Board of Health for the appropriate dumpster permit, F. The provisions of this conditional approval shall apply to and be binding upon the applicant its employees and all successors and assignsin interest or control. G, Any action by a Tom Board, Commission,or Department,which requires changes in the plan or design of the building, as presented to the Planning Board, may be subject to modification by the Planning Board.
