Please accept this letter as a request to postpone the continued public hearing for the above
referenced project for an additional two weeks. Due to an illness in the family I was unable to make
any substantial progress in regards to the concerns that have been raised by the Planning Board
Consultant and the Abutters engineer.

Re: Old Center Lane Subdivision
Dear Mr. Chairman:
Please accept this letter as a response to the issues raised in letters from John Chessia of Coler and
Colontonio,the towns consultant,and Mr. Robert Gill,a consultant that was hired by the abutters to the
north of the proposed roadway. A response to each comment is listed below.
RESPONSE TO LETTER FROM JOHN CHESS1A DATED DECEMBER 16,1996
LA test pit has been performed in the area of the proposed detention pond. It indicates a water
table elevation 22 inches below the ground. A log of the soils found is attached to this letter.
2, Drainage issues are discussed in another letter.
3.The haybale details have been revised and the location of haybates has been shown on the
plan.
4. The plan is still drawn at 1"=30'. We feel that the ability to see details is better at this scale.
5,The watershed zoning district has been indicated on sheet 1 of the plans.
6. Centerline stations are now indicated on the plans. Access is not shown to the property to the
easterly side of the site. This office has demonstrated that the connection to the property to the
East would require roadway slopes in excess of 12%,Further,the present developer of the
property is now dealing with the planning board to redesign the plans to meet current zoning
with access from Salem Street.
7.The locations of the sewer lines have been revised to enable future replacement or repair to be
done totally within the right of way.
8.Additional existing topography and features have been added to the plans,

9. The plan has been revised to show all of the spruce trees.The grading has been adjusted to
save all of the spruce trees except the ones closest to the outlet of the detention pond.
10,The roadway profile has been revised to meet the bylaw.Tire vertical curve information has
been provided.Tile water line is not shown on the profile plan.
11. Sidewalks are not shown on the plan. It is the impression of this office that they are not
usually required in projects of this size,
12.Proposed street trees have been shown.
13. A slope easement has been indicated on sheet I of the plans for the slopes that exceed 4:1.
14. The drainage has been redesigned to a catch basin manhole system.
15. A headwall detail has been provided.
16. The swale that presently exists on the site has been located and added to the plans.The outlet
of the pond is proposed to discharge to this swale.
17, The pavement radii has been shown on the plan.
18. Spot grades have been added to demonstrate that water will flow out of the driveway on Lot
32B.
Items 19 to 24 will be addressed in a separate letter.
RESPONSE TO LETTER FROM MR.ROBERT M. GILL
1. In regards to the slope of the road. The roadway and all of the adjacent slopes meet the
requirements of the planning board regulations. A guard rail has been added to the plans in all
areas that have side slopes of 2:1.
2.The height of the fill area is quite high,but a 2:1 slope is an adequate slope to stabilize the
surface.This has been demonstrated in many areas in town.
3, The detention pond has been designed in the customary rnanner that detention ponds are
designed in North Andover.A guard rail has been added to the top of the slope and the inlet pipe
has been lowered so it is at the maximum water level of the pond, Calculations for the size of rip
rap needed to prevent erosion at the inlet pipe will be submitted in a separate letter.
4. This property cannot be designed to have zero effect on the flow of water in the area.The
drainage design meets the North Andover requirements, and in fact lowers the peak flow off of
the site. The creation of a wetlands is not necessarily a bad situation since a wetland would act to
improve the quality of runoff water from the property.The effect upon the land owned by the
Rodriques's will be shown on the plan as far as offsets to wetlands under current laws are
concerned.

RESPONSE TO LETTER PROM JOHN CHESSIA DATED JANUARY 21,1997
This letter generally answers khe questions raised by Mr, Gill that have been addressed above.
The continents in this letter generally match the opinions of this office,The only item that needs
to be addressed here is item number 4 in Mr, Chessia's letter.
A test pit has been done in the area of the proposed detention basin.The soil log indicates that a
seasonal High water table 22 inches below the ground surface can be found in this area. Tile
construction of the pond as proposed will put the bottom of the pond below the seasonal high
ground water table.It is likely that wetland vegetation will grow if the pond is not graded to slope
slightly towards the outlet of the pond.This will be done to hinder the growth of wetlands plants.
I hope this letter addresses all of the concerns that have been raised. I will be at your meeting February 4,
1997 to discuss this matter further. If you have any other questions or concerns,please do not hesitate to
call.

Attached please find the revised Stormwater Management Report for referenced project dated January 28,
1997. The report and computations included therewith reflect the resolution of review comments of Mr. John
C.Chessia, P.E.of Coler and Colontonio, Inc., transmitted by your December 17, 1996 letter(copy attached).
Please note that we have incorporated stormwater runoff originating from the adjacent Lot 6, in accordance
with the additional survey information which your office provided. As a result, the geomerty of the detention
pond proposed has been modified (see report for plan view @ 1" = 30' ), and the diameter of the outlet pipe
increased to 12".
The revised project design incorporates resolutions of Mr. Chessia's comments and continues to result in a
decreased rate of runoff under predicted conditions for 2, 5, 10 and 100 year storm events at all locations
where runoff leaves the property.
As discussed, we anticipate that you will incorporate onto the plans appropriate details for a "trash rack"to
be installed at the inlet end of the 12"outlet pipe needed to protect same from cloggong.
We trust that this submittal will meet with your approval. Should you have any questions, please contact our

Comment Resolution
The following presents the methods used to resolve review comments of Mr. John C. Chessia, P.E., Coler
and Colantonio, Inc. on the October 31, 1996 report.
Response to Comment 19
Sub-Area plans and computations have been revised to reflect offsite upgradient areas contributing
flow to the detention basin. As a result, the detention basin outlet pipe was revised from an 8"
diameter pipe to a 12" pipe. As a result of this change and others described below, both pre and
post development peak runoff rates were recomputed as follows:
At Detention Basin Outlet
Pre Development Peak (100 yr.) 10.9 cfs
Post Development Peak (100 yr.) 7.9 cfs
Reduction 3.0 efs
At NortherlvPropP,ft Line
Pre Development Peak (100 yr.) 6.3 cfs
Post Development Peak (100 yr.) 0.8 cfs
Reduction 5.5 cfs
The peak elevation within the detention basin is computed to be 249.4 (revised from an elevation of
249.1 previously computed -see October 31, 1996 report).
Response to Comment 20
Computations utilize Curve Numbers 74, 79 and 98.
Response to Comment 21
The 300' maximum length for sheet flow was utilized in the original computations in accordance with
published SCS methodology (TR 55). We understand (based on review comments received) that
Natural Resource Conservation Service personnel have told Coler and Colantonio personnel that a
maximum length of 50 to 100' is typical in New England. We have no objection to the use of a lower
maximum and have revised computations accordingly.
Response to Comment 22
The detention basin outlet has been modeled as a culvert rather than an orifice. The plans contain
details for protecting the outlet pipe from clogging.
Response to Comment 23
The detention basin has been modified as follows:
• An 8' top width is provided
2:1 downstream slopes have been used.
3:1 upstream slopes have been used (outlet side).
• Material to be used for side slopes for embankment (except where concentric with cul-de-sac)
has been specified to be Clay CH Clayey sand SC Sandy clay CL, consistent with the
Guideline in ASCE Manuals and Reports of Engineering Practice No. 77, "Design and
Construction of Urban Stormwater Runoff Systems" (Table 11.5)

Enclosed are 7 sets of a revised plan for the definitive
subdivision submittal entitled "Old Center Lane" . This
revised plan shows the access to the two proposed lots in the
subdivision being a large private driveway versus the

Dear Mr. Chairman:
This letter is being submitted to address the concerns of the
North Andover Planning Board that were raised at the last
public hearing regarding this matter, and the concerns raised
by Mr. John Chessia of Coler and Colantonio.
At the March 18, 1997 planning Board public hearing the
revised plan that was submitted on March 5 and the associated
waiver requests were discussed. There were a total of 15
waivers requested. In a meeting with Kathleen Colwell these
waivers were modified in three .cases and two of them were
eliminated. The new list of waiver requests is as follows:
1) 7 A 3 a) Roadway grade increased from 6% to 10%
2) 7 A 3 b) Length of leveling area reduced from 50 feet
to 25 feet.
3) 7 A 3 d) Allow the use of bituminous curb in lieu of
granite curb on a grade steeper than 60
4} 7 B 1 Clear, Grub, and remove loam only in the
area directly under the roadway and 3 feet
to either side of the roadway in lieu of the
whole right of way.
5) 7 B 3 Allow inspection of the roadway by a private
party in lieu of the public works. Utilities
would be inspected as with any house tie in.

a rate of $ 10 .00 per lin. ft. for twice the
length of the roadway. The money would be
paid to the Town prior to the bonds being
released.
1.1) 7 F Waive the requirement for a street sign. In
lieu of a street sign a granite boulard 4'
tall out of the ground and II" square with 4"
numbers engraved on all sides of the boulard
shall be installed where the private
roadway .intersects Johnson Street. The
numbers will reflect Johnson street
addresses. Also, a private drive sign will
be installed at the front of the roadway.
12) 7 H 4 Waive the requirements for the easements to
be granted to the Town. The utilities and
the right of way will be privately
maintained. A copy of the proposed common
roadway and utility agreements will be
provided to the planning board prior to
endorsement of the plan.
13 ) 7 O Waive the requirements for a fire alarm
system.
The above .list addresses two of the largest concerns raised
by the planning board. The first, the width of the drive,
which was proposed at 20 feet wide, has been addressed by
narrowing the drive to 16 feet. The second, lack of
sidewalks, has been addressed by an agreement to contribute
an amount of money to the sidewalk fund equal to the cost of
the sidewalks that would have had to be installed in the
subdivision.

All of the above waivers, if granted, would be predicated
upon the following conditions.

1 . The detention pond does extend into the water table
at it' s deepest elevation. There may be a development
of wetlands vegetation. The development of wetland
vegetation is not bad, and in fact is good for
stormwater pollution attenuation, an issue that is of
concern in the watershed. Also, if a wetland
develops, it will not have an affect on the abutters
ability to develop his land since the wetland will be
an isolated wetland. Under state law the Conservation
Commission does not have any jurisdiction over
isolated wetlands.

3 . Stationing has been added to the plan.
4 . A profile has not been included on the plan, however
a driveway design of this size does not usually
contain a profile. The road can easily be constructed
without a profile.
5 . A tree detail has been included on the plans. The
offset between any tree and the sewer should be a
minimum of 10 feet.
6 . A pavement radius has been added to the plans.
7 . Erosion control has been added around the catch
basins .

DRAINAGE ISSUES:
1 . A catch basin to manhole configuration was not used
at the side of the driveway because the design was to
direct the water flow overland through swales, sheet
flow, or rip-rap, in order to attain the maximum
amount of storm water treatment possible. A catch
basin to manhole system does not provide as effective
a treatment as overland flow. This is pointed out in
the new stormwater regulations published by D.E.P. .
2 . The typographical error has been corrected.
3 . A catch basin detail has been added to the plans.
4 . The corrections requested in this comment have all
been made.
5 . The pipe is shown as a pipe out of the side slope
because an effort was made to try and keep the
drainage structures from being too obtrusive. The
side slopes of the detention pond were made more
shallow, the headwall left off , and the general scope
of the project were scaled down to make the visual
impacts of the development as small as possible. If
the Planning Board sees a need for the headwall then
it can be added.
6 . Calculations for the size of the rip-rap will be
submitted by Hiyashi Corp. under separate cover.
7 . The drainage calculations will be stamped by a
registered professional engineer.
8 . All of the comments in this item will be addressed by
Hiyashi Corp.
This letter, along with the newly revised plans and the
additional information to be submitted by Hiyashi Corp.
should address all of the remaining concerns. If there are
any outstanding items not mentioned here please contact this

The purpose of this letter is to address two of the remaining
concerns in regards to the above referenced definitive plan
submittal.
The first issue is the ability to access the detention pond
in the plan that complies with the subdivision regulations of
the Town. Enclosed with this letter is a copy of a sketch
that has had the house location and topography near the
detention pond revised so access is provided.
The second issue is in regards to providing a buffer strip of
trees and shrubs along the boundary between the proposed
roadway and the property of the Rodrigues. The owners have
retained the services of George Materazzo of Materazzo
Planning Consultants, Inc. to develop a landscaping plan for
this area. They are willing to have an on site meeting with
the Rodrigues ' so they may have input into the proposed
design. A plan will be developed taking into consideration
the input from the Rodrigues ' and the owners.
