The legal notice was duly advertised in the North Andover Citizen on May 1.8 and May 25, 1994 and all parties of interest were properly notified. The following members were present: Richard Nardella, hairman, Richard Rowen, Chairman, Joseph Mahoney, Vice C Clerk, John Simons and John Daghlian. The petitioner was requesting a special permit for the construction of 20 single family homes within the Residential-6 Zoning District on property located on Willow Street. Mr. Rowen read the legal notice to open the public hearing, Mr. Phil Christiansen, of Christiansen & Sergi, spoke to the Board on the proposed project. The project is located on the corner of Route 125 and Willow Street. The following is proposed: 3 1/2 acre parcel. 20 lots single road, looped through 570 ' pavement sewer .installed drainage with catch basins road 2 to 4 ft above existing grade houses 2 to 5 ft. above existing grade wetland line confirmed by the Conservation Commission 6% grade on Willow Street, 1% grade on new road 4 F i 5 i tie into existing water and sewer on Willow Street (John Simons arrived) » add water main on Route 125 per D. P.W. request discussion regarding water easement to Meadowood III with pedestrian easement across water easement Mr. Simons stated that applicant should work with Meadowood 111 to provide a plan showing Meadowood I , Meadowood II , Meadowood III and Nadine Lane, need to show entire R-6 Zone, what is built and is not built. Mr. Christiansen will do a 1"=100 ' plan showing the R-6 Zone with topo. Architectural drawings submitted 40 ft right-of-way provided 24 ft pavement 5 ft pavement for sidewalk discussion at TRC to shift roadway off center to give room for sidewalk Mr. Nardella stated that he will want curbing. 3 ft. grass strip provided Mr. Rowen asked how many driveways from Route 125. Mr. Christiansen stated that one lot would need to come off of Route 125, would be willing to move driveway off of Nadine Lane with an easement across another lot. The applicant would seek a Special Permit to do this. Mr. Nardella to review plan to see if any lots can be moved away from center. Mr. Simons asked which house style will go on which lot? Mr. Christiansen stated that it was driven by what fits on each lot, driven by lot size. Mr. Simons asked how it differs from existing homes? Mr. ,lames Grifoni, developer, told the Board they would be similar to existing styles in Meadowood I . Mr. Nardella wants all zoning information on front sheet. Asked if any variances required? Mr. Christiansen stated that no variances required. Mr. Mahoney stated the need to delineate between road and grass strip with curbing. Mr. Daghlian asked how drainage is controlled. Mr. Christiansen answered by catch basins in road drain to Swale, no y ` I detention proposed, steady slope to wetlands currently, finished grade is flatter, water will be slowed down by grass and street. Houses will have sprinkler systems. The existing structures will be demolished. Mr. Nardella stated that site screening will need to be discussed on site. Mr. James Towle, Andover By-pass asked what happens to wetlands in Meadowood I when Willow Street is raised. Mr. Christiansen answered work on road stays in existing right-of--way and will not effect Meadowood I wetland. (Ms. Colwell to make sure Conservation Commission reviews this) . Mr. Christiansen stated that granite curb will be provided to channel water on 6% slope. Mr. Nardella wants to review how Meadowood II drainage and Nadine Lane interact. Mr. Rowen stated that there may be a need for independent review of drainage for all projects combined. Mr. Ray Parker, Meadowood Road, concerned about traffic, Jim Towle, Willow Street, questioned if anything could be done to address traffic issues on Route 125. Mr. Nardella questioned why Hillside Road was closed off. Mr. Thomas Laudani stated that there was a fatal accident at the intersection, the State put a barrier across Hillside Road. Mr. Nardella stated that traffic issues need to be addressed. Ms. Bea Fink, Turnpike Street, questioned the impact on sewer and water pipes. Mr. Nardella said that D.P.W. will review loading capabilities . On a motion by Mr. Simons, seconded by Mr. Mahoney, the Board voted to continue the public hearing to June 21, 1994 . On June 21, 1994 , the Planning Board held a regular meeting. The following members were present: Richard Nardella, Chairman, John Simons and Alison Lescarbeau. Due to the lack of a quorum, the Board tabled the discussion to July 5, 1994 . On July 5, 1994 , the Planning Board held a regular meeting. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Richard Rowen, Clerk, John Simons, and John Daghlian> The item was not discussed. Mr. Phil Christiansen spoke to the Board on the proposed. - went to Conservation regarding the roadway connection, Commission does not want connection original plan had homes closer than 25 ' from the wetland, moved homes away from wetland spread lots apart in the center of the circle designed roadway connection to line up with Peterson Circle -- Federal approval may be required for wetland filling on site request variance for frontage on Lot 20 , request Planning Board support for variance will request common driveway with Lot 9 and Lot 20 - Lot 20 - 25 ' frontage, need 75 ' frontage could turn house on Lot 10 to face subdivision Mr. Rowen stated the need for possible variance on both Lot 20 and Lot 8 . The Planning Board reviewed house designs. The starting price is approximately $180, 000 . Mr Nardella asked if there was any place to locate a bus shelter.. Mr. Christiansen stated that it could by an easement on Lots 18 and 19 . Mr. Simons asked if Lots 1-5 had 5 , 000 sq. ft. of upland (each) . Mr. Christiansen replied "yes" . Mr. Christiansen gave the Board the following information: - 40 ' right-of-way 24 ' of pavement 5 ' sidewalk 3 ' grass strip cape cod berm put on top of binder coat - asphalt - curbed Ms . Colwell told Mr. Christiansen to ask D. P.W. what type of curb they would want on the street. Mr. Nardella asked if wetland line been determined. Mr. Christiansen replied, "yes, wetland line has been delineated and approved. " Ms. Colwell stated that the Technical Review Committee discussed connection of water main in Route 125 . Applicant agrees to replace water main to center of Gallant property. • 1 i d Mr. Mahoney suggested changing lot numbers so that Lot 20 is not isolated. Mr. Christiansen requested that the public hearing be closed tonight due to the time constraints with option agreement. Mr. Nardella would like to see lights at end of driveways uniform with those of Meadowood I . A motion was made by Mr. Rowen to close the public hearing. Mr.' Steve Stapinski expressed concern that if the Planning Board closes the public hearing tonight there maybe difficulties in moving roadway to connect with Meadowood III if necessary. Mr. Nardella stated that the decision will be drafted to allow flexibility of the location of the roadway to connect with Meadowood II. Mr. Simons seconded Mr, Rowen' s motion and the Board voted to close the public hearing. Ms. Colwell to draft decision if possible for next meeting. On August 2 , 1994 the Planning Board held a regular meeting. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Richard Rowen, Clerk, John Daghlian and Alison Lescarbeau, Associate Member. Mr. Nardella attended the Conservation Meeting regarding Nadine and Meadowood roadway connection, which entails wetland filling. On August 16, 1994 the Planning Board held a regular meeting. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Vice Chairman, Richard Rowen, Clerk, John Simons, and Alison Lescarbeau, Associate Member. Ms. Colwell read letter from D.P.W. Mr. Nardella concerned about number 3 , discussing permission to use sewer pump station. Condition. approval upon receipt of approval . Mr. Christiansen asked that the condition be phrased so that another alternative via gravity feed may be feasible. Mr. Mahoney said consider what happens if road is not constructed. Mr. Rowen - could modify subdivision approval in the future if not built. On a motion by Mr. Rowen, seconded by Mr. Mahoney, the Board voted to approve the Definitive Subdivision for Nadine Lane as amended. Set site opening Bond at $15, 000. Alison Lescarbeau is voting on this special permit. On a motion by Ms. Lescarbeau, seconded by Mr. Rowen, the Board voted to approve the Special Permit for the R-6 District as amended. Nardella, Chairman attachment cc: Director of Public Works Building inspector Conservation Administrator Health Sanitarian Assessors Police Chief Fire Chief Applicant Engineer File I 1 ` 4• t 5 t ' Nadine Lane Special Permit, Residential - 6 Zoning District (R-6) The Planning Board herein approves the Special Permit requested by Willow Tree Development, 12 Rogers Road, Haverhill , MA 01835, dated May 13 , 1994 , This Special Permit allows the creation of 20 lots on a 3 . 2 acre parcel in the R--6 Zone off of Willow Street as allowed under Section 4 . 125 of the Zoning Bylaw. The Planning Board makes the following findings as required by Section 10 . 31 of the Zoning Bylaw: A. The specific site is an appropriate location for 5, 000 square feet lots as it is zoned R-6 and is adjacent to a subdivision with similar lot sizes . B . The use as developed will not adversely affect the neighborhood as the site is adjacent to similarly sized lots . C. There will be no nuisance or serious hazard to vehicles or pedestrians as a roadway connection between this subdivision and the adjacent subdivision has been created thereby allowing residents to exit onto . either Willow Street or Hillside Road. D. Adequate and appropriate facilities will be provided for the proper operation of the proposed use . The Planning Board also makes the specific finding that this use is in harmony with the general purpose and intent of the zoning Bylaw. The development is sufficiently advantageous to the Town and promotes the public wealth, safety, and general welfare of the citizens of the Town of North Andover. In particular, the Planning Board finds that this project will : A. Permit greater flexibility and more diverse efficient , and economical design of residential developments; B . Facilitate economical and efficient provisions of utilities; C. Meet the Town' s housing needs by promoting different types of housing which is a benefit to the residents of North Andover. D. Conform to the overall intent of the R-6 District concerning the lot design, road Layout and other site features . Finally the Board finds that this site complies with the Zoning Bylaw requirements so long as the following additional conditions are complied with. Therefore, in order to fully comply with the approval necessary to construct the project as specified in the 1 a i .k Special Permit application, the Planning Board herein grants this approval provided the following conditions are met : 1 . Prior to Endorsement of the Plans by the Planning Board, the applicant agrees to the following : a . The applicant shall post a site opening bond in the amount of fifteen thousand dollars ($15, 000) to be held by the Town of North Andover . The Guarantee shall be in the form of a check made out to the Town of North Andover which will be deposited in an interest bearing escrow account . This amount shall cover any contingencies that might affect the public welfare such as site opening, clearing, erosion control and performance of any other condition contained herein, prior to the posting of the Performance Guarantee in Condition 3 (c) in the Definitive Subdivision Approval . This site opening bond may, at the discretion of the Planning Board, be released in full or partially retained in accordance with the recommendation of the Planning Staff as directed by the vote of the North Andover Planning Board. Covenants shall be recorded to insure that the architectural style of the proposed dwellings conform to those presented to the Planning Board and referenced below: Booklet Titled: Willow Tree at North Andover, Massachusetts; Scott Construction Inc . Note : The following three house designs are presented in booklet : i , The Jefferson ii , The Adams iii . The Oxford 2 . Prior to any lots being released from the statutory covenants, the conditions outlined in the Nadine Lane Definitive Subdivision Conditional. Approval must be followed. 3 . Prior to FORM U verification for an individual lot, the conditions outlined in the Nadine Lane Definitive Subdivision Conditional Approval must be followed. 4 . Prior to a Certificate of Occupancy being issued for an individual lot, the conditions outlined in the Nadine Lane Definitive Subdivision Conditional Approval must be followed. In addition: 2 a . The site shall be continuously reviewed by the Planning Board and Staff . Any additional screening as may be reasonably required by the Planning Board shall be j added at the applicant ' s expense . b. All disturbed areas on the lot in question must be stabilized. c'. All site - amenities associated with the lot in question shall be installed. (ie . fences, landscaping, walkways and driveways) 5 . Prior to the final release of security, the conditions ` outlined in the Nadine Lane Definitive Subdivision. Conditional Approval must be followed as well as the following: a . A bus shelter must be constructed as shown on the plan. �V r A design of the shelter must be presented to the Planning Board for review and approval prior to construction. b . A stockade fence must be constructed as shown on the ' plan along Route 125 on Lots 11 and 12 . G . A complete set of signed plans, a copy of the Planning Board V decision and a copy of the Conservation Commission "Order of Conditions" must be on file at the Division of Public Works 41 prior to issuance of permits for connections to utilities . 0\0 7 . The applicant shall adhere to the following requirements of the Fare Department : a . All proposed structures are to contain residential fire sprinkler systems in conformance with the North Andover Fire Department . 8 . Any tree cutting shall be kept to a minimum throughout the project in order to minimize erosion and preserve the natural features of the site . The applicant shall inform the Town Planner when tree cutting is to occur. 9 . Any action by a Town Board or Commission or Department which requires changes in the roadway alignment, drainage facilities, grading or no-cut lines may subject this decision to a modification by the Planning Board. 10 . The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control . 3 I 11 . All construction shall commence within two (2) years from the date of this approval and shall be completed within five (5) years from the date of this approval . If construction has not been commenced or completed in this time frame this decision will be automatically rescinded. 1.2 . This Special Permit approval is based upon a Definitive Subdivision Conditional Approval . The Special Permit and Definitive Subdivision Approvals are both based upon the following information : a . The application was submitted by Willow Tree Development, 12 Rogers Road, Haverhill, MA 01835 dated May 13 , 1994 . The area affected contains approximately 3 :2 acres in a Residential- 6 Zone off of Willow Street . The Planning Board makes the following findings as required by the Rules and Regulations Governing the Subdivision of Land: A. The Definitive Plan, dated May 5, 1994 rev. 8/1/94 includes all of the information indicated in Section 3 of the Rules and Regulations concerning the procedure for the submission of plans except as noted in Condition 1 . B . The Definitive Plan adheres to all of the design standards as indicated in Section 7 of the Rules and Regulations except as noted in Condition. 15 . C . The Definitive Plan is in conformance with the purpose and intent of the Subdivision Control Law. D . A covenant (FORM T), securing all lots within the subdivision for the construction of ways and municipal services must be submitted to the Planning Board. Said lots may be released from the covenant upon posting of security as requested in Condition 3 (c) . f . Right of way dedication easements for the proposed roadway shall be prepared at the applicant ' s expense and provided to the Planning Office . g. The applicant must submit to the Town Planner a FORM M for all utilities and easements placed on the subdivision. The Board will sign the document and it must be recorded at the Essex North Registry of Deeds . All drainage, water, and sewage facility designs shall be approved by the North Andover Division of Public Works . Provisions for water intrusion mitigation shall be included in the design and shown on the construction schedule required in Condition 1 (d) . ,i All application fees must be paid in full and verified 1/ by the Town Planner. J . A detailed street tree planting list shall be prepared listing specific material to be used. This list shall indicate quantity and size of all proposed material . , k The Special Permit and Subdivision Decision for this project must be included as part of the plans . 1 . ��The plans must be endorsed within ninety (90) days of the filing of the decision with the Town Clerk or this approval is deemed automatically rescinded. All documents shall be prepared at the expense of the applicant, as required by the Planning Board Rules and Regulations Governing the Subdivision of Land. Endorsement of the plans is proof of satisfaction of the above conditions . 2 . Prior to the start of construction: a . The referenced plans must be endorsed by the Planning Board and referenced by the applicant at the Essex North Registry of Deeds . b . , Three (3) complete copies of the recorded plans and two (2) copies of the following recorded documents must be submitted to the Planning Office : Subdivision Approval, Special Permit Approval, FORM 1 Covenant , FORM M Utility Easement, Roadway Easement . �c All erosion control must be in place and reviewed by the Town Planner . d. The subdivision construction and installation shall in all respects conform to the rules and regulations and specifications of the Division of Public Works . e . Prior to any lots being released from the statutory covenant : a . All site erosion control measures required to protect off-site properties from the effects of work on the lot proposed to be released must be in place . The Town Planning Staff shall determine whether the applicant has satisfied the requirements of this provision prior to each lot release and shall report to the Planning Board prior to a vote to release said lot . b .) Prior to a FORM U verification for an individual lot, the following information is required by the Planning Department : a . Lot 4 does not have sufficient frontage , Prior to any building permit being issued for this lot, a variance from the Zoning Board of Appeals must be obtained and a copy of the decision received by the Planning Office . V Lots 9 & 11 require a special Permit for access via a 1/ common driveway. No building permit will be issued for either lot until a special permit has been obtained • j j from the Planning Board and a copy of the decision has been received by the Planning Office . C . A plot plan for the lot in question must be submitted, which includes all of the following: i . location of the structure, ii . location of the driveways, iii . location of the septic systems if applicable, iv. Location of all water and sewer lines, v, location of wetlands and any site improvements required under a NACC order of condition, vi . any grading called for on the lot , vii . all- required zoning setbacks, including buffer zones and no-cut lines, viii . location of any drainage, utility and other easements . d. All appropriate erosion control measures for the lot shall be in place . Final determination of appropriate measures shall be made by the Planning Board or Staff . e . All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction . f . The lot in question shall be staked in the field. The location of any major departures from the plan must be shown. The Town Planner shall verify this information. g . Lot numbers visible from the roadways must be posted on all lots . 5 . Prior to a Certificate of Occupancy being requested for an individual lot, the following shall be required: a . The roadway must be constructed to at least binder coat of pavement to properly access the lot in question. Prior to construction of the binder coat , the applicant shall ensure that all required inspection and testing of water, sewer, and drainage facilities' has been completed. The applicant must submit to the Town Planner an interim as -built , certified by a professional engineer, verifying that all utilities have been installed in accordance with the plans and profile sheet . b . All necessary permits and approvals for the lot in question shall be obtained from the North Andover Board of Health and Conservation Commission. c . Permanent house numbers must be posted on dwellings and be visible from the road. r. a d. All slopes on the lot in question shall be stabilized, as solely determined by the Planning Board in regards to erosion, water run off and safety. e . All lots must be raked, loamed and seeded, sodded or mulched if the weather does not permit seeding or sodding. f . There shall be no driveways placed where stone bound monuments and/or catch basins are to be set . It shall be the developer' s responsibility to assure the proper id placement of the driveways regardless of whether individual lots are sold. The Planning Board requires any driveway to be moved at the owner' s expense if such driveway is at a catch basin or stone-bound position. g . The Planning Board reserves the right to review the site after construction is complete and require additional site screening as it deems necessary and reasonable . 6 . Prior to the final release of security retained for the site by the Town, the following shall be completed by the applicant . a . The Planning Board will, by a majority, vote to release any security retained. b . An as-built plan and profile of the site shall -be submitted for review and approval . C . The applicant shall petition Town Meeting for public acceptance of the street . Prior to submitting a warrant article for such petition the applicant shall review the subdivision and all remaining work with the Town Planner and Department of Public Works . The Planning Board shall hold a portion of the subdivision bond for continued maintenance and operations until such time as Town Meeting has accepted (or rejected in favor of private ownership) the roadways . it shall be the developer' s responsibility to insure that all proper easements have been recorded at the Registry of Deeds . d. The Town Planner shall ensure that all Planning, Conservation Commission, Board of Health and Division of Public Works requirements are satisfied and that construction was in strict compliance with all approved plans and conditions . V . The Town Planner will review any signs utilized for this project . The applicant must obtain a sign permit as required by Section 6 of the Bylaw. The Planning Board shall approve any entrance structures . Any lighting used for entrance signs must be removed prior to acceptance of the subdivision by the Town. 8 . The applicant shall adhere to the following requirements of the Division of Public Works : a . The proposed drain pipe on lots 2 , 3 , 4 and a should be installed in the center of 20 foot wade drainage easements . b . Peak stormwater flowrates at the boundaries of the development shall be no higher following development than prior to development . C . A sewer extension permit must be obtained from the Division of Water Pollution Control of the Massachusetts Department of Environmental Protection. d. A statement must be obtained from the operator of the Rt . 114 sewer pumping station quantifying existing sewage flows, and available excess permitted capacity to accept projected flows from Nadine Lane if sewer is to be constructed as currently designed. e , The sewer extension will be subject to the policies of the Division of Public Works regarding removal of existing infiltration/Inflow in the receiving sewage system. f . Sewer manhole 43 should be moved to Station 2+86 . g . A hydrant should be installed at Station 3+0 . h. The water services should be sized to deliver adequate volume for both domestic use and residential sprinkler flows . i . A permit must be obtained from Mass . Highway for excavating in the Route 1.2S "Right of Way" for the water main installation. j . A complete set of signed plans, a copy of the Planning Board' s decision and a copy of the Conservation Commission' s "Order of Conditions" must be on file at the Division of Public Works prior to issuance of permit for connection to utilities . 9 . The applicant shall adhere to the following requirements of the Fire Department : a . Open burning is allowed by permit only after consultation with the Fire Department . r i b. Underground fuel storage will be allowed in conformance with the Town Bylaws and State Statute and only with the review and approval of the Fire Department and Conservation Commission. 10 . There shall be no burying or dumping of construction material on site . 11 . The location of any stump dumps on site must be pre-approved by the Planning Board. 12 . The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 13 . Gas, Telephone, Cable, and Electric utilities shall be installed as specified by the respective utility companies . 14 . Any action by a Town Board, Commission, or Department which requires changes in the roadway alignment, placement of any easements or utilities, drainage facilities, grading or no-- cut lines, may be subject to modification by the Planning Board. 15 , The following waivers from the. Rules and Regulations Governing the Subdivision of Land, North Andover, Massachusetts - Revised February, 1989 have been granted by the Planning Board: Section 7 (A) (2) Width: The right-of-way requirement of fifty (50) feet is waived to forty (40) feet . The Planning Board waives this requirement as this site is located in the R-6 zone which warrants smaller right--of-ways . 16 . This decision will automatically be rescinded if the utilities have not been installed and the street has not been constructed to binder coat within two (2) years from the date this decision is filed with the Town Clerk' s office . 17 . This Definitive Subdivision Approval is based upon a Special Permit granted in accordance with Section 4 . 125, 10 . 3 and 10 . 31 of the North Andover Zoning Bylaw. The Special.
