Al ... lotrtt im Town Clerk Bk 16513 Pg248 #25896 West Mill Definitive Subdivision Plan Map 54, Lot 1 and Map 53, Lot 25 The Planning Board herein APPROVES the application for a Definitive Subdivision Plan to subdivide real property which is depicted on the Town of North Andover Assessors Map 54,Lot 1, and Map 53,Lot 25, into three(3) lots and to create a new subdivision, including the construction of a private roadway, the installation of stormwater management infrastructure,the installation of underground utilities, connections to town water and sewer, and site grading The proposed subdivision is located within the Downtown Overlay District A: Historic Mill Area,as well as the underlying Industrial—S(I-S), Residential 4(R-4), Machine Shop Village,and General Business(G-B)Zoning Districts.The project is located at 4 High Street,North Andover,Massachusetts, 01845,Assessors Map 54,Parcel 1 and Map 53, Parcel 25, and as more particularly shown on the"Plans", as defined below.This Definitive Subdivision Plan was requested by RCG West Mill NA,LLC. 17 Ivaloo Street, Somerville,MA 02143.A complete Application conforming with the requirements of Article V of Subdivision Regulations was filed with the Town on June 7,2019, in accordance with the requirements of§ 255-5. The application was noticed and reviewed in accordance with procedures for approval described in Article V, § 255-5.5,of the Subdivision Regulations. The public hearing on the above referenced Application,opened on July 9,2019,and a site visit was conducted on November 24,2019. The public hearing was closed by the North Andover Planning,Board on January 7, 2020. Approval of a Definitive Subdivision Plan by the Planning Board,as the permit granting authority, requires a vote of at least three members of a five-member board. The Planning Board's vote to approve the proposed Subdivision Plan was 5 to 0 in favor of the application. The Applicant is hereby notified that should the Applicant disagree with this decision,the Applicant has the right, under MGL Chapter 40A, Section 17,to appeal this decision within Twenty(20)days after the date this decision has been filed with the Town Clerk. The Planning Board finds that the intent of Chapter 255,as well as its specific criteria are met. Accordingly,the Planning Board makes the following FINDINGS OF FACT in accordance with § 255- 5.6.A. of Part V of Chapter 255: FINDINGS OF FACT: 1) A Preliminary Subdivision Plan was filed with the Planning Board on January 31,2019. The Plan was denied on March 5,2019,as the Planning Board determined that inadequate information on street design, and that the Board was unable to satisfactorily review technical issues required by Section 255-6.7 without a traffic impact analysis as required in Section 255-5.4(D)(6). 2) An Application for a Definitive Subdivision Approval was filed with the Town on June 7,2019, in accordance with the requirements of§ 255-5. 3) The Definitive Subdivision Plan dated May,2019 and last revised November 27,2019 includes all of the information indicated in Section 255 of the Planning Board Rules and Regulations Governing the Subdivision of Land concerning the procedure for the submission of Plans except as specially waived by this decision. Bk 16513 Pg249 #25896 West Mill Definitive Subdivision Plan Map 54, Lot I and Map 53, Lot 25 4) The Definitive Plan is in conformance with the purpose and intent of the Subdivision Control Law. 5) The Definitive Plan complies with all of the review comments submitted by various town departments in order to comply with state law,town by-laws and insure the public health,safety, and welfare of the town. Finally,the Planning Board finds that the Definitive Subdivision complies with the Town Bylaw requirements so long as the following conditions are complied with: 6) The Subdivision Plan does not include any new public ways and will not have a significant impact on congestion and adjacent ways. Access to all lots will be from the subdivision road,minimizing vehicular and pedestrian conflict on High Street. 7) The Subdivision Plan creates legal frontage to all lots. 8) The proposed roadway layout provides for adequate access to the Sutton Pond Condominiums,and provide formal access to Lots 1 through 3,parking and two loading docks associated with the mixed- use mill buildings located at 4 High Street. The subdivision roadway will remain private. 9) The"Lot Layout Plan"(sheet C-108)for the Definitive Subdivision Plan dated May 14, 2019 and revised to November 27,2019 shows a lot layout that depicts the creation of three(3)lots, each of which has adequate frontage on the proposed private subdivision roadway layout which is 20,158 sq. ft. in area. The Plan thus conforms to all applicable zoning requirements for lots within the Industrial S("IS"),Residence 4(R4),General Business(G-B)and Subdistrict A:Historic Mill Area. 10) The Property is subject to an easement allowing access to Sutton Pond Condominium. The easement is recorded with the Essex North Registry of Deeds in Book 4067,Page 301. This easement, as may be amended from time to time, will continue to provide access to the Sutton Pond Condominium. 11) The Applicant received the recommendations and comments from the Town Engineer,John Borgesi, on the subdivision roadway design. The roadway has been designed in a way that it is located further away from the Prescott Street intersection and realigned with the East Mill Parking lot across the street in order to improve sight distance for vehicular traffic on High Street. The Applicant shall continue to work with the DPW on developing a conceptual design for the realignment of Prescott Street and High Street taking in account the existing East Mill access driveway. The Applicant must implement low cost measures to improve traffic and safety at the Sutton Street Intersection with High Street as identified by the traffic engineers. (see correspondence from John Borgesi dated November 25,2019). 12) The roadway layout and stormwater management systems as depicted on sheet 5 of 12(Grading and Drainage Plan)has been found: (a) to comply with applicable requirements;(b)to provide adequate drainage that is compatible with the surrounding neighborhood;and, (c)to provide for adequate drainage and stormwater management. Bk 16513 Pg250 #25896 West Mill Definitive Subdivision Plan Map 54,Lot I and Map 53, Lot 25 13) All Plans and related submissions were reviewed by the town's outside consultants and were found to be in conformance with,Chapter 255, the Town of North Andover's Rules and Regulations Governing the Subdivision of Land(correspondence from TEC dated December 17,2019). 14) The Definitive Plan has been prepared to lessen congestion in such ways and in the adjacent public ways. All site access will be from the subdivision road. 15) The roadway depicted on the Definitive Plan has been designed to reduce danger to life and limb in the operation of motor vehicles. The Plan includes a 50 ft. right-of-way as well as an ADA compliant sidewalk 16) The Definitive Plan secures safety in the case of fire,flood,panic and other emergencies. The new roadway will provide adequate access and egress for emergency situations. 17) The Definitive Plan secures adequate provisions for water, sewage,drainage,underground utility services,fire,police and other similar municipal equipment and street lighting and other requirements where necessary in a subdivision. 18) The Definitive Plan has been reviewed by the Health Department and states that the project will be on town sewer(email from July 2,2019). ' 19) Fire,Department has reviewed the swept path analysis of the proposed roadway,site and parking areas to ensure Fire Department and other emergency vehicle apparatus has adequate access to the site and associated buildings in accordance with 527 CMR Ch 18. Consideration for installation of a hydrant,based on applicable requirements/standards,along the roadway for fire protection at the proposed multi-unit residential project is to be included in the decision. (see email from Michael Beime dated November 21,2019 and November 26,2019). 20) The plan has been reviewed by North Andover Public School Department and representative of the School Department attended the July 16,2019,Planning Board meeting at which the representative expressed no concerns. 2 1) The plan has been reviewed by the North Andover Police Department. A detail officer will be required for any work that impedes the flow of traffic during construction(email from Daniel Laneri dated October 31,2019). 22) The Subdivision Plan conforms to town design and construction standards,with the exception of waivers granted in Condition 30.These waivers that have been granted will not impair the functioning,long-term maintenance,nor appearance of the future development of the land,will not result in an adverse impact on the areas adjacent to the land,and are consistent with the Board's development objectives. 23) The applicant has demonstrated consideration of maintaining the existing street character,minimizing the impact on the environment,utilizing existing slopes to reduce the need for grading,retaining Bk 16513 Pg251 #25896 West Mill Definitive Subdivision Plan Map 54, Lot 1 and Map 53, Lot 25 existing trees where appropriate, and minimizing paved space, all consistent with principles of Low- Impact Development, Permit Definitions: 24) The "Locus"or"Site" refers to the 18.489+/-acre parcel of land,as shown on Assessors Maps s3 & 54,Parcels 1&25, also known as 4 High Street,North Andover,Massachusetts. 25) The "Plans"refer to the plans prepared by Tighe&Bond, 53 Southampton Road,Westfield, NIA 01085, entitled "Definitive Subdivision Plan for Improvement of 4 High Street in North Andover, MA", dated May,2019 and revised to November 27,2019, prepared for RCG West Mill NA LLC. 26) The "Project"refers to the subdivision of Map 54,Lot I and Map 53,Lot 25 into three(3)lots and to create a new subdivision road. The property on which the proposed subdivision is proposed is located within the Downtown Overlay District Subdistrict A:Historic Nfill Area, and within the underlying Industrial—S(I-S),Residential 4(R-4),Machine Shop Village,and General Business(G-B)Zoning Districts. 27) The"Applicant"refers to RCG West Mill NA LLC, 17 Ivaloo Street, Somerville,MA 02143,the applicant for the Definitive Subdivision Plan, its successors and assigns. 28) The"Project Owner" refers to the person or entity holding the fee interest to the title to the locus from time to time,which can include but is not limited to the applicant, developer,and owner. SPECIAL CONDITIONS Upon reaching the above findings, the Planning Board approves this Definitive Subdivision Plan with the following conditions: 29) The roadway,utilities,and stormwater management infrastructure will be constructed according to the Plans, with the following waivers granted by the Town of North Andover Planning Board, according to the provisions of the Town of North Andover Rules and Regulations Governing the Subdivision of Land: 30) The following requested waivers are granted to with regard to the private way identified on Sheet C- 108 of the Plans as 50' Wide Right of Way. These waivers are hereby granted in consideration of the fact that the design of the roadway was changed from that of a through street to the less intrusive roadway design as presented on the approved Definitive Subdivision Plan: a) Section 255-5.1(E) and 5.4 regarding submittal of an environmental and community impact statement; The Environmental and Community Impact statement will be submitted as part of the Site-Plan Review process associated with lots 1,2 and 3. b) Section 255-5.1(J)and 5.7 regarding a performance guarantee;and c) Section 255-5.1(E)requirement that the Applicant submit a Community Impact Statement. d) § 255-5.2.F.2.d Vertical datum requiring All benchmarks and elevations shown on the subdivision plans shall be based on the National Geodetic Vertical Datum of 1929(NGVD). A verticle datum of Vertical datum used for development of the drawings is NAVD88,not NGVD29 as NAVD88 is Bk 16513 Pg252 #25896 West Mill Definitive Subdivision Plan Map 54, Lot l and Map 53, Lot 25 the datum associated with GIS information and was used by the surveyor in developing the existing site survey. e) § 255-5.2.F.2.h Lot/House requiring Numbers Lot numbers enclosed in a circle and house numbers as assigned by the DPW. The Applicant requests that street numbers be assigned by DPW after Definitive Approval. f) §255-6.18.Street Trees and other plantings are required to be planted by the applicant on all streets within the tract being subdivided. Trees shall be planted along the roadway and within the subdivided parcels as per the Landscape Plan and Special Permit Plan for lots 2&3. g) § 255-6.20 which requires Street signs shall be installed at all intersections in conformity with the specifications of the Department of Public Works. No street signs are proposed as part of this project. h) § 255-6.21. Requires provisions for street lighting connections at locations determined by the Board. Currently no lighting is located on the easement drive. No street lighting is proposed outside of the proposed new lighting located on lots 1, 2 &3 as part of the Special Permit application. i) §255-6.4 The specifications for construction,as referenced in the Appendices 1 through VI of these rules and regulations, shall be used as a guide for required construction specifications unless otherwise directed. Waived as to 255 Attachment 1 Town of North Andover Appendix Street Construction Specifications,except Subparagraph C(sidewalks). j) § 255-6.8.A Streets: design standards Requires a Minimum foot ROW width for nonresidential streets. The ROW proposed is 50 feet which is consistent with the adjoining streets and the existing driveway. k) § 255-6.8.G requires the construction of a cul-de-sac if a street will not extend beyond the subdivision boundaries and its continuation is not required for access to an adjoining property. No cul-de-sac will be provided as the end of the private way serves as the entrance and egress for the Sutton Pond Condominium complex. In accordance with § 255-2.7,the Board deems that each of the foregoing waivers is in the public interest and consistent with the intended purpose of the Subdivision Control Law and the Rules and Regulations and such waivers are hereby granted. With Respect to those waivers concerning development standards above,the Planning Board also makes a fording, in accordance with § 255-2.7.of the Subdivision Regulations,that the waived requirements will not impair the functioning, long term maintenance nor appearance of the future development of the land shown on the Plan,will not result in an adverse impact for the areas adjacent to the land shown on the Plan,and is consistent with the Board's development objectives for the reasons described in the Applicant's request for waivers and subsequent discussions during the hearing. 31)All of the stormwater management facilities will be maintained in perpetuity by the Applicant,with the terms of ownership and maintenance to be documented in a declaration of easements,restrictions, and covenants,an association agreement,or other form of agreement acceptable to the Planning Director encumbering the roadway and each lot in the subdivision. Bk 16513 Pg253 #25896 West.mill Definitive Subdivision Plan Map 54, Lot I and Map 53, Lot 25 32)An access and maintenance easement shall provide the Town with the right,but shall not impose any obligation on the Town,to maintain,repair,and monitor the storrnwater management facilities for the subdivision roadway. 33) The Stormwater Pollution Prevention Plan and the Operations&Maintenance Plan shall be updated to reflect the ownership and maintenance responsibilities as outlined in Special Condition 31 and 32. 34)The Applicant will complete, at no cost to the Town of North Andover, improvements at the intersection of the current driveway located on High Street, Improvements will include the realignment of the drive with the driveway located across the street at 21 High Street, also known at Maps 69 &68 Lots 10&1. The aforementioned intersection improvements shall be completed by the time of occupancy permits for any new buildings approved. 35) In consideration of the approval of the Plan,there is to be no further division or subdivision of a part or portion of the parcels created through this Subdivision Plan.This restriction is to be documented in the respective deeds for each lot within this subdivision. 36) All easement documents, deed restrictions,covenants,Owner's Association Agreements if necessary, and/or maintenance agreements required as part of this decision must be submitted,reviewed,and approved by the Planning Department,Town Counsel, and the Town Engineer as deemed necessary by the Town Planner prior to recording. The Applicant will submit a reciprocal easement or similar document,to the Town,which agreement will govern the relationship between the three lots. PRIOR TO THE ENDORSEMENT OF THE PLAN Prior to endorsement of the plans by the Planning Board,the applicant shall adhere to the following: 37) A Covenant(Form 1)securing all lots within the subdivision for the construction of ways and municipal services must be submitted to the Planning Board. Said lots may be released from the covenant upon satisfactorily completing Conditions#6947 1. 38) The Applicant must submit to the Staff Planner a Form M for all utilities and easements placed on the subdivision, 39) The Applicant must meet with the Town Planner in order to ensure that the final plans conform to this Notice of Decision.These plans must be submitted within ninety(90)days of filing this Notice of Decision with the Town Clerk. 40) A detailed construction schedule must be submitted as part of The plans. 4 1) The Approved Decision must be submitted as part of the Plans. 42) Right of way dedication easements for the proposed roadway shall be prepared at the Applicant's expense and provided to the Planning Office. Bk 16513 Pg254 #25896 West Mill Definitive Subdivision Plan Map 54, Lot 1 and Map 53, Lot 25 43) All drainage,water and sewage facilities designs shall be approved by the Town of North Andover Department of Public Works. A letter must be provided to the Planning Department. 44) The Subdivision Decision must be recorded with the Northern Essex Registry of Deeds within six(6) months of its endorsement and the list of waivers for this project must appear on the recorded plan. 45) A form of Deed for the lots within the subdivision shall be submitted,reviewed and approved by Town Counsel. 46) If as a result of any decision made by another Town Board,the proposed Plan as approved by the Planning Board is changed,the Applicant shall provide those changes to the Planning Board for approval. 47) All documents shall be prepared at the expense of the applicant,as required by the Planning Board Rules and Regulations Governing the Subdivision of Land. PRIOR TO ANY SITE WORK/START OF CONSTRUCTION 48)A deed restriction must be placed on the Right-of-Way regarding the fact that it is a private way and shall never be maintained by the Town,nor accepted as a public way. A notation must be placed on the Plan noting that the subdivision roadway is a private way. The roadway shall not be paved or otherwise constructed beyond the limits of pavement shown on the Plans. In addition, a deed restriction and/or covenant must be recorded on all subdivision lots requiring the proposed roadway to remain a private way and shall never be maintained by the Town,nor accepted as a public way. 49) A Site Opening Bond in the amount of ten thousand dollars($10,000.00)is to be held by the Town of North Andover. The Site Opening Bond shall be in the form of a check made out to the Town of North Andover that will be placed into an interest bearing bond account. 50) The record plans must be endorsed by the Planning Board. Both the decision and plans must be recorded by the applicant at the Registry of Deeds. 51) The Subdivision Notice of Decision and accompanying plans must be recorded with the Northern Essex Registry of Deeds,The Approved Decision and the list of approved waivers must appear on the approved plans. The Applicant shall provide the Planning Department with two(2)copies of the recorded Notice of Decision and accompanying plans. 52) Easement documents,deed restrictions,covenants,and maintenance agreements concerning the stormwater facilities must be submitted,reviewed and approved by Town Counsel and the Town Engineer prior to recording.All easements and restrictions shall remain in perpetuity or the longest term allowed by law. The applicant shall record all such documents with the Registry of Deeds and shall provide the Planning Board with a copy of the recorded documents. 53) Every Form 1,Form M,Form J, Covenant, easement document,declaration of easements, restrictions and covenants,and other pertinent maintenance document must be recorded with the Essex North Bk 16513 Pg255 #25896 West Mill Definitive Subdivision Plan Map 54, Lot I and Map 53, Lot 25 Registry of Deeds as noted in this decision.The Applicant shall provide the Planning Department with two copies of each recorded document. 54) A detailed construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. 55) The developer shall provide the Planning Board with copies of permits,plans and decisions received from all North Andover land use boards, including one copy of a recorded Wetlands Order of Conditions issued under the State Wetlands Protection Act and North Andover Wetlands Protection Bylaw. 56) In consultation with the Staff Planner,the Applicant shall designate an independent construction monitor.The monitor shall read, sign, and return to the Planning Department the Letter of Agreement for Independent Monitors.Upon the start of site work the monitor shall make weekly inspections of the project(any suspension in monitoring due to inactivity on the site shall be pre-approved by the Town Planner),provide monthly reports to the Planning Department, and detail any areas of non- compliance and corrective actions.The monitor will also provide reports following heavy rain events. The monitor must also be available upon notice to inspect the site accompanying a Planning Department designated official. 57) Prior to the commencement of any work,the Applicant shall submit to the Planning Department a copy of the approved NPDES Storm Water Pollution Prevention Plan(SWPPP). 58)A pre-construction meeting must be held with the developer,their construction employees, Planning Department,Conservation Department and Building Department(and other applicable departments) to discuss scheduling of inspections to be conducted on the project and the construction schedule. All erosion control measures as shown on the plan must be in place and reviewed by the Planning Staff during the meeting. 59) A Plot Plan for the lot in question must be submitted to include: A. Location of the curb cuts B. Location of all water and sewer lines C. Proposed grading D. Location of drainage infrastructure E. identification of all easements 60) The lot in question shall be staked in the field;the location of any major departures from the plan must be shown, 61) All applicable erosion control measures must be in place and reviewed and approved by the Planning Department. 62) Catch basins shall be adequately protected and maintained to prevent siltation into drainage structures. Bk 16513 Pg256 #25896 West Mill Definitive Subdivision Plan Map 54, Lot I and Map 53, Lot 25 63) Lot numbers,visible from the frontage,must be posted on lots. DURING CONSTRUCTION 64) A police detail must be provided if determined necessary by the Planning Board. This detail is to be paid for by the applicant. 65) Dust mitigation must be performed weekly, or more frequently as directed by the Director of Planning,throughout the construction process. 66) Any stockpiling of materials(dirt,wood, construction material,etc.)must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off except for during active construction in order to minimize any dust problems that may occur with adjacent properties. It shall be the responsibility of the developer to assure that no erosion from the construction site shall occur which will cause deposition of soil or sediment upon adjacent properties or public ways,except as normally ancillary to off-site construction. 67) Off-site erosion caused by the Project during construction will be a basis for the Planning Board finding that the project is not in compliance with the plan;provided,however,the Planning Board shall give the developer written notice of any such finding and three days to cure said condition. 68) In an effort to reduce noise levels,the developer shall keep in optimum working order,through regular maintenance,any and all equipment that shall emanate sounds from the construction site. PRIOR TO ANY LOTS BEING RELEASED FROM THE STATUTORY COVENANTS 69) The roadway must be constructed to at least binder coat of pavement to properly access the lot in question. 70) All easement documents must be provided to the Planning Department. 7 1) The applicant must submit a lot release(FORM J)to the Planning Board for Signature. PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY 72) Address numbers for each lot must be posted so as to the seen from the street. 73) All slopes shall be stabilized, as determined by the Planning Board,with regard to erosion and safety. 74) It shall be the developer's responsibility to assure the proper placement of the driveways regardless of whether the individual lots are sold. The Planning Board requires any driveways to be moved at the developer's expense if such driveway is located at a catch basin or stone bound position. 75) The Planning Board reserves the right to review the site after construction is complete and require additional site screening as it deems necessary and reasonable. Bk 16513 Pg257 #25896 West Mill Definitive Subdivision Plan Map 54, Lot 1 and Map 53,Lot 25 76) The Applicant must submit a letter from the project engineer stating that the building and Site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. 77) The lot must be raked, foamed, and seeded, sodded or mulched. 78) Prior to the issuance of a final certificate of occupancy for a development on Lot 2 or Lot 3 the subdivision roadway shall be completed according to the Plan. A final as-built plan showing final building design site improvements,on- site structures,curb cuts and parking spaces,roadway as-built and layout plan must be submitted to the Planning Department and the Department of Public Works. The as-built must be provided in paper form as well as in SDF(Standard Digital File)format.
