Driveway Shoulder Regrading and Repaving Project
Conditions of Approval,NACC #324
Pursuant to section 4.4.2 of the North Andover Wetlands Protection Regulations, homeowner Kate
HaJjar, filed a Small Project Permit application for work proposed at 1200 Salem Street. The project
includes regrading the shoulder of the driveway to prevent vehicles from continuing to fall off the edge
of the tipper driveway, requiring tow truck assistance, as well as repaving the existing driveway. The
regrading will occur between 50'-100' Buffer Zone to a deciduous wooded swamp. The wetland is
located offsite, and is separated by a lawn, wooded area with a stone wall, and a neighboring driveway.
The applicant is proposing to import fill to raise the grade of the existing lawn along the shoulder to
better match the elevation of the driveway, create an extended flat shelf for vehicle maneuvering, and
an area to eventually place a shed (shed will conic under a future NACC permit request). There is a
large rhododendron bush about halfway up the driveway that will remain in place and act as a bearing
for the driveway work.
* The south end of the driveway closer to the road (in front the rhododendron) will be filled with
screen loath:
* 60' (Length) by 19' (Width), 4" (Depth).
*At its closest point, this area of fill will be about 65' from the wetland as
measured by staff.
* On the north side of the driveway closer to the house (behind/at the rhododendron)will also be
filled with screen loam:
*—10' width, fanning to wider area off the corner of the garage (this is where a
future shed will go under separate application)
*At its closest, this fill will be 50' from the wetland at this location
Aside from one dead/dying pine tree in the area of proposed fill, no vegetation will be removed for this
project. Areas of fill will be seeded for lawn. Driveway will be repaved.
During the May 8, 2023 public meeting, the North Andover Conservation Commission (NACC) found
this project to qualify as a Small Project Permit and voted unanimously to approve this project as
proposed under Categ-ory "L" 01her shnilarprojecis of'inininial impact, as delerInined by the North
Andoi,er Conservation Connnission, subject to compliance with the conditions listed below. The
project is approved only as it relates to the Conservation Commission and any and all other approvals
should be obtained by the applicant/homeowner.

All work shall conform to the following:
RECORD DOCUMENTS:
• Small Project Application,including application checklist with supporting narrative and
attachments, dated April 24, 2024
• Annotated Aerial Map with Wetland Measurements
The following conditions are hereby mandated:
CONDITIONS:
l. Prior to work commencing, erosion controls,in the form of 8"mulch soxx, must be installed at
the toe of the slope, between the limit of work and the wetland resource. To guide their
installation, erosion controls shall be installed at locations which shall be measured and staked
by Conservation Department staff(at the 50' No Build Zone and 65' from wetland edge). The
applicant, the contractor, and Conservation Department staff shall meet on site to review the
scope of work and conditions of approval.
2. Conservation Dept. staff shall perform a follow up inspection to verify proper erosion control
location.
3. Once desired grading has been achieved, the slopes shall be seeded and further stabilized with
100%biodegradable erosion control blankets (no plastic netting).
4. A post-construction (which includes post driveway repaving) inspection shall be scheduled
with the Conservation Department to verify compliance when work is complete, inspect the
seeded biodegradable erosion control blankets, and approve removal of the 12" mulch soxx.
when site stabilization(growing grass that has been mowed at least once) is achieved.
* The aoolicant, homeowner and their contractors are advised that NO other work on the property is
allowed under this permit. The NACC has jurisdiction over all of the wetlands and associated 100-
Foot buffer zones on site and any work that involves ground disturbance or changing,the current
conditions in these areas will_require permitting;with. the NACC. This.includes but are not limited to
house additions, pools, patios, decksl sheds, fences, harden beds, landscaping, bridge installation,
tree or vegetation cutting_/pruning. These activities shall be held to the current standards under the
Bylaw aLid..the WPA. **-
